HomeMy WebLinkAbout3137 1 ORDINANCE N0. 2 AN ORDINANCE OF THE CITY OF SAN ERNARDINO AMENDING ORDI- NANCE N0. 1987 ENTTTLED IN PART "AN ORDINANCE REGULATING 3 THE OPERATION OF TAXICABS TOWING VEHICLES r, „"; AND MODI- FYING THE REQUIREMENTS FOR A DRIVERIIS PERMIT. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 5 DO ORDAIN AS FOLLOWSo 6 SECTION 1. Ordinance No. 1987 Section Twenty-Two Subsectio 7 (e) is hereby amended to read as follows8 $ "(e) No Driver,as Permit or Temporary Driver,IIS Permit shall 9 be issued to any applicant who is under the age of twenty-one 10 (21) years, or who has failed to obtain a Driver4s License of the 11 requisite type or class from the State of California, or who has 12 to the knowledge of the Chief of Police been convicted of or suf- 13 fered a penalty for any of the crimes or administrative decisions 14 as set forth in Section Twenty-Three of this ordinance, or who 15 shall be deemed by him after an investigation to be morally un- 16 fit." 17 SECTION 2, Ordinance No. 1987 Section Twenty-Three Sub- 18 section (a) is hereby amended to read as follows; 19 ~~(a) The Chief of Police shall summarily revoke any 20 Driverfs Permit issued under the provisions of this ordinance if 21 he has knowledge that the holder thereof has been convicted of 22 violating any of the provisions of this ordinance or has been con 23 victed of theft or any sex offense or of hit and run driving or 24 drunk drivin or an narcotic violation durin the g y g previous five 25 years, or whose driving privilege has been suspended or revoked 26 for cause involving the unsafe operation of a motor vehicle dur- 27 ing the past five years, or is addicted to the use of narcotic or 28 habit forming drugs or the use of intoxicating beverages to ex- 29 cess, or has practiced or attempted to practice any deception or 30 fraud in his application. Whenever charges involving any of the 31 above offenses are formally made by the filing of a complaint 32 indictment or information against the holder of such Permit, and 1 the Chief of Police has lmowledge thereof, he shall temporarily 2 suspend such Driver°s Permit, pending determination of such charg s 3 but such suspension shall not remain in force after an acquittal 4 or dismissal of said charges.
