HomeMy WebLinkAbout3139 1 ORDINANCE NO ~ 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0, 259 (LAFC 933). 3 4 WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, to annex to the 6 City of San Bernardino certain contiguous uninhabited territory hereinafter 7 described; and 8 WHEREAS, on the 16th day of November, 1970, a resolution was adopted 9 by the aforesaid Coon Council of the City of San Bernardino, California, 10 declaring that proceedings had been initiated by said Council, and proposing 11 the annexation, for the reasons therein stated, of the aforementioned 12 uninhabited territory to the City of San Bernardino, and that said resolution 13 provided that the proposed annexation should be generally known and identified 14 as Annexation District No. 259; and 15 WHEREAS, said resolution set forth therein that all the property 16 included in the aforesaid territory should be taxed equally with the other 17 property within the City to pay the bonded indebtedness and any and all general I8 indebtedness and liability of the City of San Bernardino contracted prior to I ~ 19 or existing or outstanding at the time of the aforesaid proposed annexation 20 of the aforesaid property as provided in the hereinbefore mentioned Government 21 Code; and 22 WHEREAS, said resolution did fix, determine and declare that a 23 hearing be held on the 28th day of December, 1970, at the hour of 9:30 o'clock 24 A, M„ in the Council Chambers located in the Garner Building, 392 Court Street, 25 San Bernardino, California, and the same was the day, hour and place designated 26 where any person owning real estate within such territory so proposed to be 27 annexed and having any objections to the proposed annexation, might object 2$ before the Common Council and show cause why such territory should not be 29 annexed; furthermore, the said resolution provided that at any time not later 3Q than the said hour set, as mentioned hereinbefore for the said hearing, any 31 owner of property within the said territory proposed to be annexed might file 32 written protest with the City of San Bernardino against such annexation; and -1- i. i 1 i, WHEREAS, there not having been a quorum of the Council present on 2 I December 28, 1970, said protesting hearing was continued to January 11, 1971; an~ 3 i WHEREAS, there were two written protests filed with the City Clerk of ~ 4 I the City of San Bernardino prior to 9x30 o'clock A, M., on January 11, 1971; and 5 Iii thereafter, on the 11th day of January, 1971, Resolution No.~ was 6 adopted by the Mayor and Common Council declaring that a majority protest has 7 I not been presented; and 8 i WHEREAS, it appears to the Common Council of the City of San 9 ~i Bernardino that the aforesaid annexation proceedings have been competed and I' I 10 ICI everything performed at this time in accordance with said Government Code, as 11 j mentioned hereinbefore, and any and all other laws in any way connected with 12 i the said annexation procedure having been complied with; and j 13 I WHEREAS, the Common Council of the City of San Bernardino desires to 14 approve at this time the annexation of the aforesaid territory. 15 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CTTY OF SAN 16 BERNARDINO DO ORDAIN AS FOLLOWS: 17 SECTION ONE; That said territory herein described as Annexation 18 District No. 259 is hereby annexed and incorporated in and made apart of the 19 City of San Bernardino. 20 i SECTION TWO; The territory herein referred to as being annexed to 21 j the City of San Bernardino is particularly described as follows: to wit: 22 Those portions of Lot 6, Block 10; Lot 1, Block 9; Lot 1, Block 14; all of ORANGE GROVE TRACT as per plat thereof 23 recorded in Book 11 of Maps, Page 14, Records of the County Recorder of San Bernardino County, State of California 24 and those portions of the adjoining street, described as follows: 25 Beginning at a point on the present corporate limits of the 26 City of San Bernardino, said point being the intersection of the center line of Pumalo Street and the Northerly 27 prolongation of the West line of the easement conveyed to the San Bernardino County Flood Control District recorded 28 December 13, 1948 in Book 2334, Page 282, Official Records of the County Recorder of said County; thence following 29 said City Limit Line, the various courses and distances; thence South 220 feet more or less to an angle point; thence 30 West 340 feet more or less to an angle point, said point being on the center line of Del Rosa Avenue; thence South 31 along said center line, a distance of 200 feet more or less to angle point; thence West 41.25 feet more or less to an 32 i angle point, said point being on the West line of said Del I ~ -2- 1 Rosa Avenue; thence South along said West line 80 feet more or less to an angle point; thence West 438.94 feet more or 2 less to the West line of said Lot 6; thence North along said West line, and leaving said City Limit Line, a distance 3 of 490.78 feet more or less to the center line of said Pumalo Street; thence East along said center line, a distance ¢ of 678.93 feet more or less to the Southerly prolongation of the West line of that certain parcel of land described 5 in the Deed to Neal T. Baker Enterprises, Inc., a California Corporation by deed recorded April 14, 1964, Document No. g 176 in Book 6127, Page 715, Official Records of said County thence North along said Southerly prolongation and said 7 West line, a distance of 228 feet more or less to the Northwest corner thereof; thence East along the North line $ of said Neal T. Baker Enterprises property, a distance of 113 feet more or less to the Northeast corner thereof; 9 thence South along the East line of said Neal T.
