2 AN ORDINANCE OF THE MAYOR AND COMMON CODNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0, 260 (LAFC 934).

4 WHEREAS, heretofore, proceedings were initiated by the Common
5 Council of the City of San Bernardino, on its own motion, to annex to the
6 City of San Bernardino certain contiguous uninhabited territory hereinafter
7 described; and
8 WHEREAS, on the 16th day of November, 1970, a resolution was adopted
9 by the aforesaid Common Council of the City of San Bernardino, California,
10 declaring that proceedings had been initiated by said Council, and proposing
11 the annexation, for the reasons therein stated, of the aforementioned
12 uninhabited territory to the City of San Bernardino, and that said resolution
13 provided that the proposed annexation should be generally known and identified
14 as Annexation District No. 260; and
15 WHEREAS, said resolution set forth therein that all the property
16 included in the aforesaid territory should be taxed equally with the other
17 property within the City to pay the bonded indebtedness and any and all general
1$ indebtedness and liability of the City of San Bernardino contracted prior to
19 or existing or outstanding at the time of the aforesaid proposed annexation
20 of the aforesaid property as provided in the hereinbefore mentioned Government
21 Code; and
22 WHEREAS, said resolution did fix, determine and declare that a
2 3 hearing be held on the 28th day of December, 1970, at the hour of 9:30 o'clock
24 A, M„ in the Council Chambers located in the Garner Building, 392 Court Street,
25 San Bernardino, California, and the same was the day, hour and place designated
26 where any person owning real estate within such territory so proposed to be
27 annexed and having any objections to the proposed annexation, might object
28 before the Common Council and show cause why such territory should not be
29 annexed; furthermore, the said resolution provided that at any time not later
30 than the said hour set, as mentioned hereinbefore for the said hearing, any
31 owner of property within the said territory proposed to be annexed might file
32 written protest with the City of San Bernardino against such annexation; and

1 WHEREAS, there not having been a quorum of the Council present on
2 December 28, 1970, said protest hearing was continued to January 11, 1971; and
3 WHEREAS9 there were no writtsa protests of any kind or nature whatso-
4 ever filed with the City Clerk of the City of San Bernardino prior to 9:30 o'cloc
5 A, M., on January 11, 1971; and thereafter, on the 11th day of January, 1971,
6 Resolution No. ~(far7Z was adopted by the Mayor and Common Council declaring
7 that a majority protest has not been presented; and
8 I~ WHEREAS, it appears to the Common Council of the City of San
9 Bernardino that the aforesaid annexation proceedings have been completed and
10 everything performed at this time in accordance with said Government Code, as
11 mentioned hereinbefore, and any and all other laws in any way connection with
12 lithe said annexation procedure having been complied with; and
13 I WHEREAS the Common Council of the City of San Bernardino desires to
14 iapprove at this time the annexation of the aforesaid territory.
15 i NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY QF SAN
16 BERNARDINO DO ORDAIN AS FOLLOWS:
17 SECTION ONE: That said territory herein described as Annexation
18 District No. 260 is hereby annexed and incorporated in and made a part of the
19 li City of San Bernardino.
20 I SECTION TWO: The territory herein referred to as being annexed to
21 the City of San Bernardino is particularly described as follows, to wit:
22 i That portion of Lot 2, Block 3, ORANGE G@ORE TRACT as per
plat thereof recorded in Book 11 of Maps, Page 14, records
23 i of the County Recorder of San Bernardino County, State of
California, described as follows:

Commencing at a point on the present corporate limits of the
25 City of San Bernardino, said point being the Northeast corner
of said Lot 2, said point also being on the South line of
26 Nineteenth Street, 100 feet, more or less west of the West
line of Merito Avenue; thence West along the South line of
27 said Nineteenth Street, and said City Limit Line, a distance
of 292.21 feet to the true point of beginning, said point
28 being the Northeast corner of that certain parcel of land
described as parcel No. 1 in the deed to Harold E. Snodgrass
29 et-ux by deed recorded Februayy 25, 1963, document No. 88
in Book 5857, Page 716, Official Records of said County;
30 thence South 0° 14' 45" East along the East line of said
last mentioned parcel, a distance of 244.31 feet to the
31 Southeast corner of Parcel No. 2 as contained in said parcel;
thence North 89° 51' 40" West along the South line of said
32 last mentioned parcel, a distance of 116.63 feet to the
! Southwest corner thereof; thence North along

1 the west line of said last mentioned parcels, a distance
of 244.31 feet to the South line of said Nineteenth Street,
2 said point being the City Limit Line of said City; thence
East along said City Limit Line, a distance of 116.63 feet
3 to the True Point of Beginning.
4 Containing approximately 0.65 of an acre.
5 SECTION THREE: That the above described property will be subject
6 to taxation equally with the property within such municipal corporation to
7 pay its proportion of the following bonded indebtedness of the City of San
8 Bernardino, which said bonded indebtedness was outstanding or theretofore
9 authorized and is outstanding at the time of said annexation, to wit:
10 A bonded indebtedness of $490,000.00 incurred for the acquisition
11 and construction of a public library, including additions to and enlargements
i 12 of the public library system of said City, the outstanding indebtedness
13 thereon being $240,000.00, bearing interest at the rates of 4-3/4%, 3-1/2%
14 and 3-1/4% per annum;
15 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
16 and construction of additions to, relocations of and replacements of the fire
17 fighting system of said City, the outstanding indebtedness thereon being
18 $765,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2,9% and 2-1/2%
19 per annum.
20 SECTION FOUR: The property herein annexed is declared to be apart
21 of Ward 2, and the boundaries of Ward 2 are hereby altered to include said
22 annexed territory, with zoning classification of R-1-7200 Single Family
23 Residential zoning district.
24 SECTION FIVE: That the area included in the above annexation is
25 hereby detached from County Service Areas Nos. 38 and 70.
26 I HEREBY CERTIFY that the foregoing ordinance was duly adopt
