2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0, 258 (LAFC 931).

4 WHEREAS, heretofore, proceedings were initiated by the Common
5 Council of the City of San Bernardino, on its own motion, to annex to the
6 City of San Bernardino certain contiguous uninhabited territory hereinafter
7 described; and
8 WHEREAS, on the 30th day of November, 1970, a resolution was adopted
9 by the aforesaid Common Council of the City of San Bernardino, California,
10 declaring that proceedings had been initiated by said Council, and proposing
11 the annexation, for the reasons therein stated, of the aforementioned
12 uninhabited territory to the City of San Bernardino, and that said resolution
13 provided that the proposed annexation should be generally known and identified
14 as Annexation District No. 258; and
15 WHEREAS, said resolution set forth therein that all the property
16 included in the aforesaid territory should be taxed equally with the other
17 property within the City to pay the bonded indebtedness and any and all generaX
18 indebtedness and liability of tha City of San Bernardino contracted prior to
19 or existing or outstanding at the time of the aforesaid proposed annexation
20 of the aforesaid property as provided in the hereinbefore mentioned Government
21 Code; and
22 WHEREAS, said resolution did fix, determine and declare that a
23 hearing be held on the 11th day of January, 1971, at the hour of 9:30 o'clock
24 A, M., in the Council Chambers located in the Garner Building, 392 Court Street,
25 San Bernardino, California, and the same was the day, hour and place designated
26 where any person owning real estate within such territory so proposed to be
27 annexed and having any objections to the proposed annexation, might object
28 before the Common Council and show cause why such territory should not be
29 annexed; furthermore, the said resolution provided that at any time not later
30 than the said hour set, as mentioned hereinbefore for the said hearing, any
31 owner of property within the said territory proposed to be annexed might file

32 written protest with the Gity of San Bernardino against such annexation; and

1 ~I WHEREAS, there were three written protests filed with the

2 City Clerk of the City of San Bernardino prior to 9:30 o'clock A, M„ on the
3 11th day of January, 1971; and
4 WHEREAS9 on the 11th day of January, 1971, the date set for the
5 ~ hearing of protests against the proposed annexation, Resolution No. 10577
6 was adopted by the Common Council of the City of San Bernardino declaring that
7 i a majority protest has not been presented; and
$ ~ WHEREASy it appears to the Common Council of the City of San

9 j Bernardino that the aforesaid annexation proceedings have been completed and

10 i, everything performed at this time in accordance with said Government Code, as
I
11 ', mentioned hereinbefore, and any and all other laws in any way connected with
12 I, the said annexation procedure having been cgmplied with; and

13 i WHEREAS, the Common Council of the City of San Bernardino desires to
14 ~ approve at this time the annexation of the aforesaid territory.
15 i NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
16 ~ BERNARDINO DO ORDAIN AS FOLLOWS:
17 SECTION ONE: That said territory herein described as Annexation
],$ District No. 258 is hereby annexed and incorporated in and made a part of the
19 City of San Bernardino.
20 SECTION TWO: The territory herein referred to as being annexed to
21 the City of San Bernardino is particularly described as follows, to wit:
22 That portion of the RANCHO MUSCUPIABE as per plat thereof
recorded in Book 7 of Maps, Page 23 records of the County!
23 ~ Recorder of San Bernardino County, State of California;
Lots C, E, Fy G, Hy N, 0, P, Q of the Meyer Barclay Resub-
24 division as per plat thereof recorded in Book 12 of Maps,
page 18 records of the County Recorder of said County; Lots
25 14 and 15 of the Meyer and Barclay Subdivisdon as per plat
thereof recorded in Book 2 of Maps, Page 32 records of the
26 County Recorder of said County; that portion of Blocks 79
and 80 of the Irvington Land and Water Subdivision as per
27 plat thereof recorded in Book 1 Page 32 records of Survey of
the County Recorder of said County, and those portions of
28 adjoining streetsy: described as follows:
29 Beginning at a point on the present corporate limits of the
City of San Bernardino, said point being the most Westerly
30 terminus of Belmont Avenue, said point also being on the
South line of said Lot "H" of Meyer and Barclay Resubdivision;
31 thence following the City Limits of the City of San Bernardino,
the following courses and distances; thence Westerly along
32 the South line of said Lot "H", a distance of 75.00 feet more
or less to the Southeast corner of that certain property
conveyed to Bernice Nyda Bonstein as parcel three in the

1 i deed recorded September 18, 1958, Document No. 435 in Book
4607, page 214 Official Records of said County; thence
2 North 31° 53' West, a distance of 449.90 feet to the most
Northerly corner thereof; thence South 57° 31' West along
$ the Northwesterly line of said Bonstein property, a
distance of 132.69 feet to a point on the Easterly line
4 of said Lot "I" of said Meyer and Barclay Resubdivision;
thence Northwesterly along the Northeasterly line of said
5 Lot "I" and the Northeasterly Line of Lots J, K and L of
said Meyer and Barclay Resubdivision, a distance of 3282.00
g feet more or less to the Northeast corner of Lot 11 of said
Meyer and Barclay Sub.; thence Northwesterly along the

along said Northerly line a distance of 700 feet more or less
29 to a point on the West line of said Block 80 of the Irvington
Land and Water Company Subdivision; thence Northerly along said
30 West line and the Northerly prolongation thereof, a distance of
480 feet more or less to the center line of Pennsylvania Avenue;
31 thence Southeasterly along said center line, a distance of 500
feet more or less to a point on the Perrin Survey line so called;

Rancho Muscupiabe as Surveyed by Perrin, said point being a
2 point on the East line of that certain parcel described as
parcel No. 2 in the deed to Donald L Dreese et al recorded
3 May 11, 1964, Document No. 103 in Book 6145, Page 808 Official
Records of said County; thence Southeasterly along said Perrin
4 Survey line a distance of 1470 feet more or less to the center
line of Cypress Street and said City Limit line; thence following
5 said City Limit line, the following courses and distances; thence
Southwesterly along said center line, a distance of 890 feet
6 more or less to the center line of Ohio Street; tlSence North-
westerly along said center line of Ohio street, a distance of
7 1230 feet more or less to the point of termination of said
Street, said point being the Northerly prolongation of the
8 Westerly line of Lot 81 of said Irvington Land and Water
Company Subdivision; thence Southerly along said Northerly
9 prolongation and West line of said Lot 81, a distance of 1500
feet to an angle point in said Lot 81; thence Westerly along
10 the lot line of said Lot 81 and the Westerly prolongation thereof,
a distance of 350 feet more or less to the point of beginning.
11 Containing 590 Acres more or less.
12 SECTION THREE: That the above described property will be sub3ect
13 to taxation equally with the property within such municipal corporation to
14 pay its proportion of the following bonded indebtedness of the City of San
15 Bernardino, which said bonded indebtedness was outstanding or theretofore
16 authorized and is outstanding at the time of said annexation, to wit:
17 A bonded indebtedness of $490,000.00 incurred for the acquisition
18 and construction of a public library, including additions to and enlargements
19 of the public library system of said City, the outstanding indebtedness
20 thereon being $240,000.00, bearing interest at the rates of 4-3/4%, 3-1/2%
21 and 3-1/4% per annum;
22 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
23 and construction of additions to, relocations of and replacements of the fire
24 fighting system of said City, the outstanding indebtedness thereon being
2 5 $765,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2%
26 per annum.
27 SECTION FOUR: The property herein annexed is declared to a part of
28 Ward 5, and the boundaries of Ward 5 are hereby altered to include said
29 annexed territory, with zoning classifications as shown on a map filed in the
30 office of the City Clerk titled, "Exhibit B", and described as follows:
31 "0" Open District
32 That portion Lot 13, Meyer & Barclay Subdivision and
Lot Q, Meyer & Barclay Resubdivision described as follows:

1 A 200 foot wide strip of land lying southerly
and westerly of the following described line:
2 Beginning at the northeasterly corner of Lot Q
said Meyer and Barclay Resubdivision; thence
3 northwesterly along the southerly and westerly
line Lot 14, Meyer ~ Barclay Subdivision to a
4 point in the westerly line said Lot 14, said
point also a northeasterly point of Lot 13,
5 Meyer & Barclay Subdivision.
6 R-1-20,000 SinEle Family Residential District
7 Those portions of the Rancho Muscupiabe, Lots C, E,
F, G, R, N9 0, F, Q, of=hhe Meyer & Barclay Resubdivision,
$ Lots 13, 14 & 15 of the Meyer & Barclay Subdivision,
portions of Blocks 79 & 80 of the Irvington Land & Water
9 Subdivision lying within the boundaries of the proposed
annexation and excepting therefrom that property previously
10 described herein for the "0" zone district.
11 SECTION FIVE: That the area included in the above annexation is
12 hereby detached from County Service Areas No. 38 and No. 70.
