HomeMy WebLinkAbout3151 r-~r ~ ~ 1 ORDINANCE N0. 2 AN ORDINANCE OF TBE MAYOR AND COMMON COUNCIL OF THE CTTY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0, 261 (LAFC 945). 3 ,¢ WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, to annex to the g City of San Bernardino certain contiguous uninhabited territory hereinafter 7 described; and $ WHEREAS, on the 4th day of January, 1971, a resolution was adopted g by the aforesaid Common Council of the City of San Bernardino, California, ],Q declaring that proceedings had been initiated by said Council, and proposing 11 i the annexation, for the reasons therein stated, of the aforementioned 12 I uninhabited territory to the City of San Bernardino, and that said resolution 13 ~ provided that the proposed annexation should be generally known and identified 14 as Annexation District No. 261; and 15 WHEREAS, said resolution set forth therein that all the property 16 included in the aforesaid territory should be taxed equally with the other lry property within the City to pay the bonded indebtedness and any and all general i ],g indebtedness and liability of the City of San Bernardino contracted prior to 19 or existing or outstanding at the time of the aforesaid proposed annexation QQ of the aforesaid property as provided in the hereinbefore mentioned Government 21 Code; and 22 WHEREAS, said resolution did fix, determine and declare that a 23 hearing be held on the 16th day of February, 1971, at the hour of 9x30 o'clock 2e} A, M., in the Council Chambers located in the Garner Building, 392 Court Street, 25 San Bernardino, California, and the same was the day, hour and place designated 26 where any person owning real estate within such territory so proposed to be 2'7 annexed and having any objections to the proposed annexation, might object 2$ before the Coon Council and show cause why such territory should not be 2g annexed; furthermore, the said resolution provided that at any time not later 30 than the said hour set, as mentioned hereinbefore for the said hearing, any 31 owner of property within the said territory proposed to be annexed might file 32 written protest with the City of San Bernardino against such annexation; and -1- 1 WHEREAS, said protest hearing date was continued to the 22nd day of 2 February, 1971, and thereafter continued to March 1, 1971; and 3 WHEREAS, there were'~~.~-~ written protests filed with the City '4 Clerk of the City of San Bernardino prior to 9:30 o~clock A, M., on the 1st 5 day of March, 1971; and 6 WHEREAS, on the 1st day of March, 1971, the continued date set 7 ~ for the hearing of protests against the proposed annexation, Resolution No. $ /(C'~ ~a_~~~ was adopted by the Common Council of the Gity of San Bernardino I 9 i declaring that a majority protest has not been presented; and 10 WHEREAS, it appears to the Common Council of the City of San I~ 11 ~ Bernardino that the aforesaid annexation proceedings have been completed and I 12 ~ everything performed at this time .im accordance with said Government Code, as 13 imentioned hereinbefore, and any and all other laws in any way connected with 14 the said annexation procedure having been complied with; and 15 WHEREAS, the Common Council of the City of San Bernardino desires to 16 approve at this time the annexation of the aforesaid territory. 17 NOWy THEREFORE THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN ~ 18 BERNARDINO DO ORDAIN AS FOLLOWS: ' 19 i SECTION ONE: That said territory herein described as Annexation 20 iDistrict No. 261 is hereby annexed and incorporated in and made a part of the 21 (City of San Bernardino. 22 SECTION TWO: The territor herein referred to as bei annexed to Y ng i 23 the City of San Bernardino is particularly described as follows, to wit: f 24 Lot 9 and that portion of Lot 10, ARROWHEAD SUBURBAN FARMS 25 TRACT "A" as per plat thereof recorded in Book 21 of Maps, Page 6, records of the County Recorder of San Bernardino j County, State of California; and Lots 1 and 6 ARROWHEAD 26 SUBURBAN FARMS TRACT "D" as per plat thereof recorded in fJ 27 Book 23 of Maps, Page 35, records of the County Recorder i of said County and those portions of adjoining streets, j described as follows: 28 Beginning at a point on the present corporate limits of the 29 City of San Bernardino, said point being the intersection of the centerlines of "C" Street, now known as Fortieth Street 30 and Newmark Avenue; thence West along said center line of Fortieth Street and said City Limit Line, a distance of 330 31 feet more or less to the East line of Acre Lane, said point being an angle point in said City Limit Line; thence North 32 along said East line of Acre Lane and said City Limit Line, a distance of 276 feet more or less to the North line of the -2- I i ~I i~ 1 it South 256 feet of said Lot 10; thence leaving said City ~ Limit Line, West along said North line of the South 256 2 feet of said Lot 10, a distance of 330 feet to the East line of said Lot 9; thence North along said East line, a 3 distance of 384 feet more or less to the Northeast corner thereof; thence West along the North line of said Lot 9, 4 ~ a distance of 330 feet more or less to the Northwest corner thereof; ~ thence South along the West line and the Southerly prolonga- 5 I tion thereof, a distance of 660 feet more or less to the center line of said Fortieth Street, said point being on the Corporate 6 Limit line of said City; thence East along said center line and said City Limit Line, a distance of 330 feet more or less 7 to the Northerly prolongation of the West line of said Lot 1, Ili said point being an angle point in said Corporate Limit Line 8 of said City; thence South along said City Limit Line and 9 I said Northerly prolongation and said West line of Lot 1, a ~ distance of 148 feet more or less to the Southwest corner thereof; thence leaving said City Limit Line and East along 10 ~ the South line of said Lot 1, a distance of 310 feet to the ! Southeast corner thereof, said point being on the West line 11 ', of said Acre Lane; thence continuing East 20 feet to the South- 12 i west corner of said Lot 6, said point being on the East line of i said Acre Lane; thence continuing East along the South line of 13 said Lot 6 and the Easterly prolongation thereof, a distance of 330 feet to the center line of said Newmark Avenue; thence North along said center line a distance of 148 feet to the 14 i point of beginning. j 15 ~ Containing approximately 9.75 acres.
