HomeMy WebLinkAbout3152 i 1 ORDINANCE NO s_~~~. 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN ERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0. 262 (L.4FC 932). 3 WHF,REAS, heretofore, proceedings were initiated by the Common 4 Council of the City of San Bernardino, on its own motion, to annex 5 to the City of San Bernardino certain contiguous uninhabited territory 6 hereinafter described; and 7 WHEREAS, on the 18th day of January, 1971, a resolution was 8 dopted by the aforesaid Common Council of the City of San Bernardin , 9 California, declaring that proceedings had been initiated by said 10 'j ;Council, and proposing the annexation, for the reasons therein state , 11 f the aforementioned uninhabited territory to the City of San 12 ~iernardino, and that said resolution provided that the proposed ann- 13 xation should be generally known and identified as Annexation 14 istrict No. 262; and 15 WHEREAS, said resolution set forth therein that all the propert 16 •ncluded in the aforesaid territory should be taxed equally with the 17 ther property within the City to pay the bonded indebtedness and 18 ny and all general indebtedness and liability of the City of San 19 ernardino contracted prior to or existing or outstanding at the 20 ime of the aforesaid proposed annexation of the aforesaid property 21 ~s provided in the hereinbefore mentianed Government Code; and 22 ~I WHEREAS, said resolution did fix, determine and declare that a 23 Baring be held on the lst day of March, 1971, at the hour of 9:30 24 'clock A.M., in the Council Chambers located in the Garner Building 25 92 Court Street, San Bernardino, C-~lifornia, and the same was the 26 day, hour and place designated where any person owning real estate 27 ithin such territory so proposed to be annexed and having any 28 objections to the proposed annexation, might object before the 29 Common Council and show cause why such territory should not be ann- 30 exed; furthermore, the said resolution provided that at any time 31 snot later than the said hour set, as mentioned hereinbefore for the 32 said hearing, any owner of property within the said territory -1- I 1 proposed to be annexed might file written protest with the City d' 2 San Bernardino against such annexation; and 3 WHEREAS, there were~~p written protests filed with 4 the City Clerk of the City of San Bernardino prior to 9:30 o'clock 5 A.M., on the 1st day of March, 1971; and g WHEREAS, on the 1st day of March, the date set for hearing of 7lprotests against the proposed annexation, Resolution No./C ~ ~ g Was adopted by the Common Council of the City of San Bernardino de- g Glaring that a majority protest has not been presented; and l0i WHEREAS, it appears to the Common Council of the City of San 11 rnardino that the aforesaid annexation proceedings have been com- 12 leted and everything performed at this time in accordance with said 13 overnment Code, as mentioned hereinbefore, and any and all other 14 aws in any way connected with the said annexation procedure having 15 een complied with; and 16 WHEREAS, the Common Council of the City of San Bernardino de- 17 sires to approve at this time the annexation of the aforesaid terr- 18 story. 19 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF CIE CITY OF 20 SAN BERNARDINO DO ORDAIN AS FOLLOWS: 21 SECTION ONE: ThEt said territory herein described as Annex- 22 ation District No. 262 is hereby annexed and incorporated in and 23 ade a part of the City of San Bernardino. 24 SECTION TWO: The territory herein referred to as being ann- 25 xed to the City of San Bernardino is particularly described as 26 ollows, to wit: 27 Portion of Tract No. 2228 as per plat thereof recorded in Book 31 of Maps, Page 95 records of the County Recorder of 28 San Bernardino County, State of California; a portion of Trac No. 2424 es per plat thereof recorded in Book 34 of Maps, 29 Page 60 records of the County Recorder of said County; a por- tion of Lots 1 and 14, Block 55 and a portion of Lot 12 Block 30 72 Rancho San Bernardino as per plat thereof recorded in Book 7 of Maps, Page 2 records of the County Recorder of said 31 County; and those portions of the adjoining Streets, describe as follows: 32 -2 - l' Beginning at point on the Present Corporate Limits of the City of San Bernardino, said point being on the centerline of 2 Pioneer Road, a distance of 1600 feet more or less West of the centerline of Tippecanor Avenue; thence Southwesterly 3 along said City Limit Line being the centerline of the San Bernardino County Flood Control Channel as said centerline 4 is delineated on the San Bernardino County Flood Control District Map, File No. 2-701, Drawing Number 8, dated May 17, 51 1960 in the office of the Chief Engineer of said District, a distance of 2400 feet more or less to the East line of Lot 6 6 ~ of said Tract 2424; thence leaving said City Limit Line,North 7 along the East line of said Lot 6 a distance of 415 feet more or less to the Northeast corner thereof; thence West along the North line of said Lot 6, a distance of 20 feet to the 8i centerline of Emmet Way; thence North along the centerline of said Emmet Way, a distance of 1028 feet more or less to 9I the centerline of said Pioneer Road; thence East along said ~ centerline of Pioneer Road, a distance of 650 feet more or 10 ~ less to the intersection with the Southerly prolongation of the West line of Lot 49 of said Tract 2228; thence North along 11~ said Southerly prolongation and said West line and the North- erly prolongation thereof, a distance of 595.41 feet more or 12i less to the centerline of Norman Road; thence Easterly along i said centerline of Norman Road, a distance of 1500 feet more 13~ or less to the Southerly prolongation of the Northwesterly '~, line of the San Bernardino County Flood Control District 14` Right of Way as delineated on San Bernardino County Flood Control District Map File No. _2__-~O_1_, Drawing No.~,, dated 15 December 13. 1967 in the office of the Chief Engineer of said I Distric , t ence Northeasterly along said Northwesterly line 16j a distance of 1350 feet more or less to the centerline of said Tippecanoe Avenue, said point also being on the City 17I Limit Line of said City; thence South along said centerline and said City Limit Line a distance of ~ feet more or less 18 to an angle point in said City Limit Line and being the said centerline of the above mentioned Flood Control Channel;thence 19 Southwesterly along said City Limit Line, and said centerline, a distance of 1800 feet more or less to the point of beginning 20 (Containing 75 acres more or less) 21 22 SECTION THREE: That the above described property will be sub- 23 sect to taxation equally with the property within such municipal 24 corporation to pay its proportion of the following bonded indebted- 25 ness of the City of San Bernardino, which said bonded indebtedness 26 -was outstanding or theretofore authorized and is outstanding at 27 the time of said annexation, to wit: 28 A bonded indebtedness of $490,000.00 incurred for the acquis- 29 ition and construction of a public library, including additions to 30 'and enlargements of the public library system of said City, the 31 outstanding indebtedness thereon being $240,000.00, bearing interes 32 `rates of 4-3/4~, 3-1/2~ and3-1/4~ per annum: -3 - 1 il, ~I'` ~ i 1 A bonded indebtedness of $1,116,000.00 incurred for the ac- t quisition and construction of additions to, relocations of and re- 3 placements of the fire fighting system of said City, the outstanding 4l indebtedness thereon being $765,000.00 bearing interest at the rates 5 of 4~, 3~, 2-3/4%, 2.9~ and 2-1 /2% per annum. 6I SECTION FOUR: The property herein annexed is declared to 7 be a part of Ward 1, and the boundaries of Ward 1 are hereby altered 8 to include said annexed territory, with zoning classifications as 9lshown on a map Piled in the office of the City Clerk titled, l0"Exhibit B", and described as follows: 11~I R-2 Two-family Residential District 12 All of lots 48 and 49, Tract 2228, Valley Truck Farms No. 4 and Lot 7, Chew Tract, Tract No.2424; 13 those portions Lots 8,9,10,12 and 13, Chew Tract,Tract No. 2424 and Lots 40 through ~F7, inclusive, Tract 14 2228, Valley Truck Farms No. 4 lying northerly of the flood plain zones as shown on the San Bernardino 15 County Flood Control District drawings #8 and ~{9, File 2-701. 16 "0" Open District 17 Lots 35 through 47 inclusive, Tract 2228, Valley lg Truck Farms No. 4; those portions Lots 1 and 14, Block 55, Rancho San Bernardino, lots 1, 2 3, and ],g 4, Tract No. 2228, Valley Truck Farms No. ~F, and lots 8 through 16 inclusive, Chew Tract, Tract No. 20 2424 lying within FP-1 and FP-2 as shown on the San Bernardino County Flood Control drawings #8 and ~9, 21 ~ File 2-701. 22 SECTION FIVE: That the area included in the above annexation 23 is hereby detached from County Service Areas No. 38 and No. 70. 24 I HEREBY CERTIFX that the foregoing ordinance was duly adopt- 25 ed by the Mayo~r/> and Common Council of the City of San Bern~ar~din/o`~ , 2B at an/r~u~ meting thereof, held on the~~day of~j~~/AA~L.~f 27 1871,! by the following vote, to wit: 2g AYES: Councilmen ~ 29 30 NOES: ,'~_ 31 ' ABSENT ~ ~,l 32 i -4 - 1''~ ~ l - `'` i~.
