2 AN ORDINANCE OF THE MAYOR AND COMMON COIINCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0. 266 (LAFC 987).

4 WHEREAS, heretofore, proceedings were initiated by the Common
5 Council of the City of San Bernardino, on its own motion, to annex to the
6 City of San Bernardino certain contiguous uninhabited territory hereinafter
7 described; and
$ WHEREAS, on the 26th day of April, 1971, a resolution was adopted
9 by the aforesaid Common Council of the City of San Bernardino, California,
10 declaring that proceedings had been initiated by said Council, and proposing
11 ~ the annexation, for the reasons therein stated, of the aforementioned
12 uninhabited territory to the City of San Bernardino, and that said resolution
13 provided that the proposed annexation should be generally known and identified
14 as Annexation District No. 266; and
15 WHEREAS, said resolution set forth therein that all the property
16 included in the aforesaid territory should be taxed equally with the other
17 property within the City to pay the bonded indebtedness and any and all general
indebtedness and liability of the City of San Bernardino contracted prior to
19 or existing or outstanding at the time of the aforesaid proposed annexation
20 of the aforesaid property as provided in the hereinbefore mentioned Government
21 Code; and
22 WHEREAS, said resolution did fix, determine and declare that a
23 I hearing be held on the 7th day of June, 1971, at the hour of 9:30 o'clock
24 A. M., in the Council Chambers located in the Garner Building, 392 Court Street,
25 San Bernardino, California, and the same was the day, hour and place designated
26 where any person owning real estate within such territory so proposed to be
27 annexed and having any objections to the proposed annexation, might object
2$ before the Common Council and show cause why such territory should not be
2g annexed; furthermore, the said resolution provided that at any time not later
30 than the said hour set, as mentioned hereinbefore for the said hearing, any
31 owner of property within the said territory proposed to be annexed might file
32 written protest with the City of San Bernardino against such annexation; and

written protests filed with the City Clerk of
2 ithe City of San Bernardino prior to 9:30 o'clock A. M., on June 7, 1971;/and
3 i thereafter, on the ~~day of _ 1971, Resolution No. !0'7~v ~7
4 was adopted by the Mayor and Coa¢non Council declaring that a majority protest
5 has not been presented; and
6 WHEREAS, it appears to the Common Council of the City of San
7 Bernardino that the aforesaid annexation proceedings have been completed and
$ everything performed at this time in accordance with said Government Code, as
g mentioned hereinbefore, and any and all other laws in any way connected with
10 the said annexation procedure having been complied with; and
11 WHEREAS, the Common Council of the City of San Bernardino desires to
12 approve at this time the annexation of the aforesaid territory.
13 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
14 BERNARDINO DO ORDAIN AS FOLLOWS:
15 SECTION ONE: That said territory herein described as Annexation
16 District No. 266 is hereby annexed and incorporated in and made apart of the
17 City of San Bernardino.
lg SECTION TWO: The territory herein referred to as being annexed to
lg the City of San Bernardino is particularly described as follows: to wits
2Q That portion of Blocks 14 and 15, ORANGE GROVE TRACT as per
plat thereof recorded in Book 11 of Maps, Page 14, records
21 of the County Recorder of San Bernardino County, State of
California, described as follows:

Beginning at a point on the Present Corporate City Limit
23 Line of the City of San Bernardino, said point being the
intersection of the centerlines of Del Rosa Avenue and
24 Date Street; thence leaving said City limit line South
along said center line of Del Rosa Avenue, a distance of
25 495 feet to the Southwest corner of that certain parcel
described in the Deed to John E. Perrone et ux recorded
26 July 24, 1964, Document No. 310 in Book 6197, Page 216,
Official Records of said County; thence East along the
27 South line of said Perrone property, a distance of 352
feet to the Southeast corner thereof; thence continuing
2g East 20 feet to the Southwest corner of that certain parcel
described in the deed to Donald J. Davenport et ux recorded
29 June 2, 1969, Document No. 90 in Book 7242, Page 139,
Official Records of said County; thence continuing East
30 along the South line of said Davenport property, a distance
of 210 feet to the Southeast corner thereof; thence North
31 along the East line of said Davenport property, a distance
of 130.73 feet to the Northeast corner thereof, said point
32 being on the South line of that certain parcel described as

1 parcel No, 1 in the Deed to Harrell Dees et ux recorded
' September 8, 1961, Document No, 231 in Book 5530, Page
2 344, Official Records of said County; thence East along
said South line of Dees property, a distance of 15 feet
3 more or less to the Southwest corner of that certain
parcel described in the Deed to Jack W. McCabe et ux
4 recorded April 1, 1970, Document No, 434 in Book 7416,
Page 300, Official Records of said County; thence East
5 along the South line of said McCabe's property, a distance
of 117.33 feet to the Southeast corner thereof, said point
6 being on the West line of that certain parcel described in
the Deed to Jack W. McCabe et ux recorded February 21,
7 1964, Document No, 344 in Book 6093, Page 55, Official
Records of said County; thence South along said West line
8 a distance of 125 feet, more or less, to the Southwest
corner thereof; thence East along the South line of said
9 last mentioned McCabe property, a distance of 88 feet to
the Southeast corner thereof; thence North along the East
~0 line of said McCabe property, a distance of 50 feet more
or less to the Southwest corner of that certain parcel
11 described in the Deed to Jack W. Delray McCabe et ux
recorded April 28, 1970, Document No, 258 in Book 7432,
12 Page 429, Official Records of said County; thence East
along the South line of said last mentioned McCabe
13 property, a distance of 88 feet to the Southeast corner
thereof, said point also being on the West line of Lot 5,
14 Tract 5304 as per plat thereof recorded in Book 63 of
Maps, Page 89, records of said County; thence North along
15 the East line of said last mentioned McCabe property and
the West line of said Lot 5, a distance of 95 feet more
16 or less to the Northwest corner of said Lot 5, thence
East along the North line of said Lot 5 a distance of
17 108.50 feet to the Northeast corner thereof; thence
continuing East, 60 feet to the Northwest corner of Lot
18 9 of said Tract No, 5304, thence continuing East along
the North line of said Lot 9 and the Easterly prolongation
19 thereof a distance of 250 feet more or less to the East
line of Lot 3 of said Block 14; thence North along said
20 East line and the East line of Lot 3, Block 15, a distance
of 1320 feet more or less to the North line of the A, T. &
21 S,F. R, R, right of way, 50 feet wide, as delineated on
the Public Utility Map number 804-33-113A, Parcel No. 2,
22 a copy of which is on file in the Assessor's Office of said
County, said North line is also the City Limit Line of
23 said City; thence Westerly along said City Limits Line a
distance of 450 feet more or less to an angle point; thence

or less to a point on the North line of Citrus Street;
25 thence leaving said City Limit Line, West along said North
line of Citrus Street, a distance of 915 feet more or less
26 to the centerline of said Del Rosa Avenue, said centerline
being also said City Limit Line; thence South along said
27 centerline and said City Limit Line, a distance of 1070
feet more or less to the point of beginning,

29 SECTION THREE: That the above described property will be subject
to taxation e uall with the ro erty within such municipal corporation to

31 I Pay its proportion of the following bonded indebtedness of the City of San
32 Bernardino, which said bonded indebtedness was outstanding or theretofore

1 authorized and is outstanding at the time of said annexation, to wit:
2 A bonded indebtedness of $490,000,00 incurred for the acquisition
3 and construction of a public library, including additions to and enlargements
4 of the public library system of said City, the outstanding indebtedness
5 thereon being $240,000.00, bearing interest at the rates of 4-3/4%, 3-1/2%
6 and 3-1/4% per annum;
7 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
8 and construction of additions to, relocations of and replacements of the fire
9 fighting system of said City, the outstanding indebtedness thereon being
10 $765,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2%
11 per annum.
12 SECTION FOUR: The property herein annexed is declared to be a part
13 of Ward 7, and the boundaries of Ward 7 are hereby altered to include said
14 annexed territory, with zoning to be in the R-1-7200, R-3-2000, A-P, C-3A
15 and "O" Districts and to be applied as shown on the map titled, "Exhibit A",
16 and described as follows:
17 R-1-7200 Single Family Residential District
1g Lot 4 and 10, Tract No, 5304.
19 R-3-2000 - - Multiple Family Residential District
20 Those portions Lots 2 and 3, Block 15, Orange Grove
Tract bounded by the north line Date Street, the
21 easterly line of the San Bernardino County Flood
Control property, the southerly line of the A,T. &
22 S.F. Railroad property, and the west line of Tract
No. 4683.

A-P - - Administrative - Professional District

That portion Lot 2, Block 14, Orange Grove Tract
25 described as follows: Beginning at a point on the
south line Date Street and the east line said Lot 2;
26 thence northwesterly along the south line Date Street
300 feet, more or less; thence south 285 feet, more or
27 less; thence east 117.33 feet; thence south 125 feet;
more or less; thence east 88 feet; thence north 50
2$ feet, more or less; thence east 88 feet; thence north
to Point of Beginning.

15 SECTION FIVE: That the area included in the above annexation is
16 hereby detached from County Service Areas No, 38 and 70.
17 I HEREBY CERTIFY that the foregoing ordinance was duly adopted by
the Mayor and Common Council of the City of San Bernardino at a
