2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0. 268 (LAFC 997).

4 WHEREAS, heretofore, proceedings were initiated by the Common
5 Council of the City of San Bernardino, on its own motion, to annex to the
6 City of San Bernardino certain contiguous uninhabited territory hereinafter
7 described; and
8 WHEREAS, on the 28th day of June, 1971, a resolution was adopted
9 by the aforesaid Common Council of the City of San Bernardino, California,
10 declaring that proceedings had been initiated by said Council, and proposing
11 the annexation, for the reasons therein stated, of the aforementioned
12 uninhabited territory to the City of San Bernardino, and that said resolution
13 provided that the proposed annexation should be generally known and identified
14 as Annexation District No. 268; and
15 WHEREAS, said resolution set forth therein that all the property
16 included in the aforesaid territory should be taxed equally with the other
17 property within the City to pay the bonded indebtedness and any and all general
18 indebtedness and liability of the City of San Bernardino contracted prior to
1.9 or existing or outstanding at the time of the aforesaid proposed annexation
20 of the aforesaid property as provided in the hereinbefore mentioned Government
21 Code; and
22 WHEREAS, said resolution did fix, determine and declare that a
23 hearing be held on the 9th day of August, 1971, at the hour of 9:30 oYClock
24 A, M., in the Council Chambers located in the Garner Building, 392 Court Street,
25 San Bernardino, California, and the same was the day, hour and place designated
26 where any person owning real estate within such territory so proposed to be
27 annexed and having any objections to the proposed annexation, might object
28 before the Common Council and show cause why such territory should not be
29 annexed; furthermore, the said resolution provided that at any time not later
30 than the said hour set, as mentioned hereinbefore for the said hearing, any
31 owner of property within the said territory proposed to be annexed might file
32 written protest with the City of San Bernardino against such annexation; and

WHEREAS, a quorum not being present at the meeting on the 9th day
Q of August, 1971, the time and place for hearing objections to the proposed
3 annexation was continued to the 16th day of August, 1971, at the hour of
4 9:30 o'clock A. M.; and
5 WHEREAS, there were written protests filed with the City Clerk
6 of the City of San Bernardino prior to 9:30 o'clock A. M., on August 16, 1971;
7 and thereafter, on the day of 1971, Resolution No. G'~'~
$ was adopted by the Mayor and Common Council declaring that a majority protest
9 has not been presented; and
10 WHEREAS, it appears to the Common Council of the City of San
11 Bernardino that the aforesaid annexation proceedings have been completed and
12 everything performed at this time in accordance with said Government Code, as
13 mentioned hereinbefore, and any and all other laws in any way connected with
14 the said annexation procedure having been complied with; and
15 WHEREAS, the Common Council of the City of San Bernardino desires to
16 approve at this time the annexation of the aforesaid territory.
17 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
1$ BERNARDINO DO ORDAIN AS FOLLOWS:
19 SECTION ONE: That said territory herein described as Annexation
20 District No. 268 is hereby annexed and incorporated in and made apart of the
21 City of San Bernardino.
22 SECTION TWO: The territory herein referred to as being annexed to
23 the City of San Bernardino is particularly described as follows: to wit:
24 That portion of Government Lots 3 and 4 Section 14 Township
1 North, Range 4 West San Bernardino Base and Meridian; and
25 that portion of the Muscupiabe Rancho as per plat thereof
recorded in Book 7 of Maps, Page 23, records of the County
26 Recorder of San Bernardino County, State of California, and
those portions of the adjoining street, described as follows:

Beginning at a point on the present Corporate Limit Line of
2$ the City of San Bernardino, said point being the intersection
of the North line said Muscupiabe Rancho with the East line
29 of said Government Lot 4, said point also being approximately
1275 feet East of the East line of Waterman Avenue; thence
30 following said Corporate Limit line the following courses
and distances; thence Northwesterly 425 feet more or less to
31 an angle point; thence South 86.20 feet more or less to an
angle point; thence West 970.53 feet more or less to an
32 angle point; thence North 725 feet to angle point said point

1 being on the Northexly line of State Highway 18; thence
Northeasterly, a distance of 72b feet more or less to an
2 angle point, thence South, a distance of 100 feet more or
less to an angle point; thence East, a distance of 715
3 feet more or less to the East line of said Government
Lot 3; thence leaving said Corporate Limit line, South
¢ along the East line of said Government Lots 3 and 4, a
distance of 1160 feet more or less to the point of
5 beginning.
6 (Containing approximately 18 acres.)
7 i SECTION THREE; That the above described property will be subject
8 to taxation equally with the property within such municipal corporation to
9 pay its proportion of the following bonded indebtedness of the City of San
10 ~Bernaxdino, which said bonded indebtedness was outstanding or theretofore
11 authorized and is outstanding at the time of said annexation, to wit;
12 A bonded indebtedness of $490,000.00 incurred for the acquisition

13 sand construction of a public library, including additions to and enlargements
14 of the public library system of said City, the outstanding indebtedness
15 (thereon being $240,000.00, bearing interest at the rates of 4-~3/4%, 3-1/4%
16 (and 3-1/2% per annum;
17 A bonded indebtedness of $1,1169000.00 incurred for the acquisition
1$ and construction of additions to, relocations of and replacements of the fire
19 fighting system of said City, the outstanding indebtedness thereon being
20 $7109000.00, bearing interest at the rates of 4%, 3%, 23/4%, 2.99, and 2-1/2%
21 per annum.
22 SECTION FOUR: The property herein annexed is declared to be apart
23 of Ward 4, and the boundaries of Ward 4 are hereby altered to include said
24 annexed territory, with zoning to be in the R-1-1 Acre Zoning District.
I 25 SECTION FIVE: That the area included in the above annexation is
26 hereby detached fxom County Service Areas No. 38 and 70 and Improvement Zone
27 "A" of County Service Area 70.
