2 AN ORDINANCE OF THE MAYOR AND COMI~DN COUNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0. 270 (LAFC 995).

4 WHEREAS, heretofore, proceedings were initiated by the Common
5 Council of the City of San Bernardino, on its own motion, to annex to the
6 City of San Bernardino certain contiguous uninhabited territory hereinafter
7 described; and
$ WHEREAS, on the 19th day of July, 1971, a resolution was adopted
9 I by the aforesaid Common Council of the City of San Bernardino, California,
10 declaring that proceedings had been initiated by said Council, and proposing
11 I the annexation, for the reasons therein stated, of the aforementioned
12 I uninhabited territory to the City of San Bernardino, and that said resolution
13 I provided that the proposed annexation should be generally known and identified
14 as Annexation District No. 270; and
15 WHEREAS, said resolution set forth therein that all the property
16 ~ included in the aforesaid territory should be taxed equally with the other
17 property within the City to pay the bonded indebtedness and any and all general
1S indebtedness and liability of the City of San Bernardino contracted prior to
7.9 or existing or outstanding at the time of the aforesaid proposed annexation
20 of the aforesaid property as provided in the hereinbefore mentioned Government
21 Code; and
22 WHEREAS, said resolution did fix, determine and declare that a
23 hearing be held on the 30th day of August, 1971, at the hour of 9:30 o=clock
24 A. M., in the Council Chambers located in the Garner Building, 392 Court Street,
25 San Bernardino, California, and the same was the day, hour and place designated
26 where any person owning real estate within such territory so proposed to be
27 annexed and having any objections to the proposed annexation, might object
28 before the Common Council and show cause why such territory should not be
29 annexed; furthermore, the said resolution provided that at any time not later
30 than the said hour set, as mentioned hereinbefore for the said hearing, any
31 ~ owner of property within the said territory proposed to be annexed might file
32 wzitten protest with the City of San Bernardino against such annexation; and
1 WHEREAS, there were ~_written protests filed with the City Clerk
2 of the City of San Bernardino prior to 9:30 o°clock A. M., on August 30, 1971;
3 and thereafter on the~~t~- day of ~2c.r 1971, Resolution No.l['~'.~
4 was adopted by the Mayor and Common Council declaring that a majority protest
5 has not been presented; and
6 WHEREAS, it appears to the Common Council of the City of San
~ 7 Bernardino that the aforesaid annexation proceedings have been completed and
$ ever thin erformed at this time in accordance with said Government Code, as

g mentioned hereinbefore, and any and all other laws in any way connected with
10 the said annexation procedure having been complied with; and
11 WHEREAS, the Common Council of the City of San Bernardino desires to

12 I approve at this time the annexation of the aforesaid territory.
13 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
14 BERNARDINO DO ORDAIN, AS FOLLOWS:
15 SECTION ONE: That said territory herein described as Annexation
16 District No. 270 is hereby annexed and incorporated in and made apart of the
17 City of San Bernardino.
1$ SECTION TWO: The territory herein referred to as being annexed to
19 the City of San Bernardino is particularly described as follows, to wit:
20 That portion of Sections 4 and 5 Township 1 North, Range 4
West, San Bernardino Base and Meridian and that portion of
21 Sections 5 and 8, Township 1 North, Range 4 Weat San
Bernardino Base and Meridian if said Section lines were ax-
22 tended across the Muscupiabe Rancho as per plat thereof
recorded in Book 7 of Maps, Page 23, records of the County
23 Recorder, San Bernardino County, State of California,
described as follows:

Beginning at a point on the Corporate Limit Line of the Gity
25 of San Bernardino, said point being the intersection of the
North line of said Rancho Muscupiabe and the North-South
26 centerline of said Section 5; thence following said Corporate
Limit Line, the following courses and distances; South along
try said centerline and the North-South centerline of said Section
8, a distance of 1600 feet more or less to a Northerly line
2$ of Parcel No. 4 as described in the deed to the San Bernardino
County Flood Control District, recorded April 23, 1940 in
29 Book 1415, Page 37 Official Records of said County, said
Northerly line being described in said deed as, "thence South
30 82° 40' East, 513.88 feet to the beginning of a curve concave
to the right with a central angle of 23° 33' 30" and a radius
31 of 2050 feet;" thence South 82° 40' East, a distance of 100
feet more or less to the termination of the above mentioned
32 course; thence along said curve 842,90 feet; thence North 72°

1 10' 30" East, 318.82 feet; thence South 69° 17' 30" East
302.06 feet; thence 84° 50' East, 906.65 feet to the West
2 line of that certain parcel comreyed to C. F. Martin by
deed recorded in Book 740 of Deeds, Page 199 records of
3 said County; thence Northerly along the West line of said
Martin property, a distance of 1800 feet more or less to
4 the Northwest corner thereof; thence Easterly along said
Corporate City Limit Line, a distance of 1640 feet more or
5 less to an angle point, said point being shown as station
M-28 on said map of the Muscupiabe Rancho; thence Southerly
6 135 feet more or less to the South line of said Section 4;
thence leaving said Corporate City Limit Line, East along
7 said South line of said Section 4, a distance of 1320 feet
more or less to the Southeast corner of the Southwest one-
$ quarter of said Section 4; thence North along the East line
of said Southwest one-quarter, a distance of 2640 feet more
9 or less to the Northeast corner of the Southwest one-
quarter of said Section 4; thence West along the North line
10 of said Southwest one-quarter, a distance of 2640 feet more
or less to the East line of said Section 5; thence South
11 along said East line, a distance of 1320 feet more or less
to the Northeast corner of that certain parcel described
12 in the deed to First American Trust Company, as Trustee,
under Trust No. P-640 recorded June 16, 1970, document No.
13 435 in Book 7462, Page 310 Official Records of said County;
thence following said last mentioned property the following
14 various courses and distances, West, a distance of 1938 feet
more or less to an angle point; thence South 00° 08' West,
15 a distance of 456 feet more or less to an angle point;
thence South 82° 11' 40" West, a distance of 720 feet more
16 or less to said North-South centerline of said Section 5;
thence South along said centerline, a distance of 560.34
17 feet more or less to the point of beginning.
18 (Containing approximately 303.71 acres).
19 SECTION THREE: That the above described property will be subject
20 to taxation equally with the property within such municipal corporation to
j 21 pay its proportion of the following bonded indebtedness of the City of San
22 (Bernardino, which said bonded indebtedness was outstanding or theretofore
23 authorized and is outstanding at the time of said annexation, to wit:
24 A bonded indebtedness of $490,000.00 incurred for the acquisition
25 and construction of a public library, including additions to and enlargements
26 of the public library systems of said City, the outstanding indebtedness
27 thereon being $240,000,00, bearing interest at the rates of 4-3/4%, 3-1/4%
28 and 3-1/2% per annum;
29 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
30 and construction of additions to, relocations of and replacements of the fire
31 fighting system of said City, the outstanding indebtedness thereon being
32 $710,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2%

per annum.
2 SECTION FOUR: The property herein annexed is declared to be a part
3 of Ward 5, and the boundaries of Ward 5 are hereby altered to include said
t~ annexed territory, with zoning classification of R-1-5 acre Single Family
5 Residential zoning district.
g SECTION FIVE: That the area included in the above annexation is
7 hereby detached from County Service Area Nos. 38, 70 and 70 Improvement Zone A.
$ I AEREBY CERTIFY that the foregoing ordinance was duly adopted by
9 the Mayor and Common Council of the City of San Bernardino at a ~
10 meeting thereof, held on theay of
