HomeMy WebLinkAbout3198 „I ORDINANCE N0. 2 AN ORDINANCE OF THE MAYOR AND COMI~N COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0. 272 (LAFC 1009). 3 4 WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, to annex to the 6 City of San Bernardino certain contiguous uninhabited territory hereinafter 7 described; and $ ~ WHEREAS, on the 19th day of July, 1971, a resolution was adopted 9 Iby the aforesaid Common Council of the City of San Bernardino, California, 10 (declaring that proceedings had been initiated by said Council, and proposing 11 the annexation, for the reasons therein stated, of the aforementioned 12 uninhabited territory to the City of San Bernardino, and that said resolution 13 provided that the proposed annexation should be generally known and identified 14 as Annexation District No. 272; and 15 WHEREAS, said resolution set forth therein that all the property 16 included in the aforesaid territory should be taxed equally with the other 17 property within the City to pay the bonded indebtedness and any and all general 1$ indebtedness and liability of the City of San Bernardino contracted prior to 19 or existing or outstanding at the time of the aforesaid proposed annexation 20 of the aforesaid property as provided in the hereinbefore mentioned Government 21 ,Code; and 2Q WHEREAS, said resolution did fix, determine and declare that a 23 hearing be held on the 30th day of August, 1971, .at the hour of 9:30 o'clock 24 A. M., in the Council Chambers located in the Garner Building, 392 Court Street, 25 San Bernardino, California, and the same was the day, hour and place designated 26 where any person owning real estate within such territory so proposed to be try annexed and having any objections to the proposed annexation, might object 2$ before the Common Council and show cause why such territory should not be 2g annexed; furthermore, the said resolution provided that at any time not later 30 than the said hour set, as mentioned hereinbefore for the said hearing, any 31 owner of property within the said territory proposed to be annexed might file 32 written protest with the City of San Bernardino against such annexation; and I 1 WHEREAS, there were written protests filed with the City Clerk 2 of the City of San Bernardino prior to 9:30 o'clock A. M., on August 30, 1971; 3 and thereafter on the I~iday of ~ ~ , 1971, Resolution No.r~ ~ 8c, 4 was adopted by the Mayor and Common Co~unc~il declaring that a majority protest has 5 not been presented; and 6 WHEREAS, it appears to the Common Council of the City of San 7 Bernardino that the aforesaid annexation proceedings have been completed and 8 everything performed at this time in accordance with said Government Code, as 9 mentioned hereinbefore, and any and all other laws in any way connected with 10 the said annexation procedure having been complied with; and 11 WHEREAS, the Common Council of the City of San Bernardino desires to 12 approve at this time the annexation of the aforesaid territory. 13 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 14 BERNARDINO DO ORDAIN, AS FOLLOWS: 15 SECTION ONE: That said territory herein described as Annexation 16 District No. 272 is hereby annexed and incorporated in and made a part of the 17 City of San Bernardino. 18 SECTION TWO: The territory herein referred to as being annexed to 19 the City of San Bernardino is particularly described as follows, to wit: 20 That portion of Lot 40 and all of Lot 42, Block 54, Rancho San Bernardino as per plat thereof recorded in Book 7 of 21 Maps, Page 2, records of the County Recorder of San Bernardino County, State of California, and that portion 22 of Tract 1995 as per plat thereof recorded in Book 29 of Maps, Page 13, records of the County Recorder of said 23 County, and those portions of the adjoining streets, described as follows: 24 Beginning at a point on the Present Corporate Limit Line 25 of the City of San Bernardino, said point being the intersection of the Northerly prolongation of the East 26 line of said Lot 40 with the center line of Mill Street, said point being 525 feet more or less West of the center 27 line of Waterman Avenue; thence following the various courses and distances of said Corporate Limit Line West 28 a distance of 290 feet more or less to an angle point; thence South a distance of 700 feet more or less to an 29 angle point; thence West a distance of 140 feet more or leas to an angle point; thence South a distance of 1475 30 feet more or less to an angle point; thence West 40 feet more or less to an angle point; thence South, a distance 31 i of 241.25 feet more or less to an angle point, said point being the Southwest corner of Lot 82 of said Tract 1995; 32 thence leaving said Corporate Limit Line East along the - 2 - ~I I! i 1 South line of said Lot 82 and the Southline of Lots 83 and 84 of said Tract 1995 and the Easterly prolongation of the 2 South line of said Lot 84 and continuing East along the South line of Lots 121, 122, 123, 124, 125, and 126 of said 3 Tract 1995 and the Easterly prolongation thereof, a distance of 995 feet more or less to the center line of said Waterman 4 Avenue, said center line being said Corporate Limit Line of the City of San Bernardino; thence following said Corporate 5 Limit Line the following course and distances; thence North along said center line of Waterman Avenue, a distance of 6 1715 feet more or less to an angle point; thence West, a distance of 525 feet more or less to an angle point; thence 7 North a distance of 700 feet more or less to the point of beginning. 8 (Containing approximately 40.66 acres). 9 SECTION THREE: That the above described property will be subject 10 to taxation equally with the property within such municipal corporation to 11 ay its proportion of the following bonded indebtedness of the City of San 12 ernardino, which said bonded indebtedness was outstanding or theretofore 13 uthorized and is outstanding at the time of said annexation, to wit: 14 A bonded indebtedness of $490,000.00 incurred for the acquisition 15 16 and construction of a public library, including additions to and enlargements 17 °f the public library systems of said City, the outstanding indebtedness hereon being $240,000.00, bearing interest at the rates of 4-3/4%, 3-1/4% 18 19 nd 3-1/2% per annum; A bonded indebtedness of $1,116,000.00 incurred for the acquisition 20 nd construction of additions to, relocations of and replacements of the fire 21 22 fighting system of said City, the outstanding indebtedness thereon being 23 x$710,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2% er annum. 24 SECTION FOUR: The property herein annexed is declared to be a part 25 f Ward 1 and the boundaries of Ward 1 are hereby altered to include said 26 nnexad territory, with zoning classification of C-M Commercial-Manufacturing 27 oning district. 28 SECTION FIVE: That the area included in the above annexation is 29 ereby detached from County Service Area Nos. 28, 38, 70 and County Service 30 rea SL-1. 31 32 I HEREBY CERTIFY that the foregoing ordinance was duly adopted by - 3 - I~ 1 the Mayor and Common Council of the City of San Bernardino at a 9 2 ~ meeting thereof, held on the „[day of 3 '19 by the following vote, to wit; 4 it AYES; Councilmen ~ ~ ~ ?s.~,r-z.~~v ~ T 5 6 NOES: 7 ABSENT^ 8 9 10 City Clerk 11 12 The foregoing ordinance is hereby approved this ~~r~day of 13 1971. 14 15 i 16 ~ ~ - 17 Mayor of t~ a Cit of San Bern. dino 18 C lg pproved as to form; 7 20 , i 21 City A ey 22 23 24 25 26 27 28 29 310 Y ~ ~3 lid LUL:LL GOFORTH, City CI2rk 4 eu~.
