HomeMy WebLinkAbout3204 ii I l ORDINANCE N0, J ~C ~ 1 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 273 (LAFC 1008). 3 ,4 WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, to annex to the g City of San Bernardino certain contiguous uninhabited territory hereinafter ry described; and g WHEREAS, on the 13th day of August, 1971, a resolution was adopted g by the aforesaid Common Council of the City of San Bernardino, California, 10 declaring that proceedings had been initiated by said Council, and proposing 11 ithe annexation, for the reasons therein stated, of the aforementioned ],2 uninhabited territory to the City of San Bernardino, and that said resolution 13 Provided that the proposed annexation should be generally known and identified 14 as Annexation District No, 273; and 15 WHEREAS, said resolution set forth therein that all the property 16 'included in the aforesaid territory should be taxed equally with the other 17 property within the City to pay the bonded indebtedness and any and all general 18 indebtedness and liability of the City of Ssn Bernardino contracted prior to lg or existing or outstanding at the time of the aforesaid proposed annexation 20 of the aforesaid property as provided in the hereinbefore mentioned Government 21 ~ Code; and 22 WHEREAS, said resolution did fix, determine and declare that a 23 hearing be held on the 27th day of September, 1971, at the hour of 9:30 o~clock ~4 A. M., in the Council Chambers located in the Garner Building, 392 Court Street, 25 San Bernardino, California, and the same was the day, hour and place designated 26 where any person owning real estate within such territory so proposed to be 27 annexed and having any objections to the proposed annexation, might object 2g before the Common Council and show cause why such territory should not be 29 annexed; furthermore, the said resolution provided that at any time not later 30 than the said hour set, as mentioned hereinbefore for the said hearing, any 31 owner of property within the said territory proposed to be annexed might file 32 written protest with the City of San Bernardino against such annexation; and 1 WHEREAS, a quorum not being present at the meeting on the 27th day 2 of September, 1971, the time and place for hearing objections to the proposed 3 annexation was continued to the 4th day of October, 1971, at the hour of ¢ 9:30 o'clock A, M,; and 5 WHEREAS, there were written protests filed with the City Clerk 6 of the City of San Bernardino prior to 9:30 o'clock A, M„ on October 4, 1971; ry and thereafter, on the day of (~1..~~Cu~ , 1971, Resolution No.~_ $ was adopted by the Mayor and Common Council declaring that a majority protest I g ~ has not been presented; and 10 WHEREAS, it appears to the Common Council of the City of San 11 Bernardino that the aforesaid annexation proceedings have been completed and 12 everything performed at this time in accordance with said Government Code, as 13 mentioned hereinbefore, and any and all other laws in any way connected with 14 the said annexation procedure having been complied with; and 15 WHEREAS, the Common Council of the City of San Bernardino desires to 16 aPProve at this time the annexation of the aforesaid territory. 17 NOW, THEREFORE, THE MAYOR AND COMMON CODNCIL OF THE CITY OF SAN 18 BERNARDINO DO ORDAIN AS FOLIAWS: lg SECTION ONE: That said territory herein described as Annexation 20 District No. 273 is hereby annexed and incorporated in and made a part of the 21 City of San Bernardino. 22 SECTION TWO: The territory herein referred to as being annexed to 23 the City of San Bernardino is particularly described as follows: to wit: 24 That portion of the Southwest one-quarter of Section 16 Township 1 North, Range 4 West, San Bernardino Meridian if 25 said section lines were extended across the Rancho Muscupiabe as per plat thereof recorded in Book 7 of Maps, Page 23, 26 records of the County Recorder of San Bernardino County, State of California and those portions of the adjoining 27 streets, described as follows: 28 Beginning at a point on the Present Corporate Limits of the City of San Bernardino, said point being on the North line of 29 Forty-second (42nd) Street, and 450 feet East of the West line of said Section 16, said point being approximately 861 feet 30 i more or less West of the center line of Fourth Avenue; thence East along said North line of Forty-second Street, a distance 31 of 187 feet more or less to the Northerly prolongation of the East line of that certain parcel described in the deed to 32 Robert E, Halbert et-ux recorded November 20, 1947, Document 2 - I I 1 No. 83 in Book 2162, Page 518, Official Records of said County; thence South along said Northerly prolongation and Q said East line, a distance of 360 feet more or less to the North line of that certain parcel described in the deed to 3 Minnin Mattis recorded October 28, 1953, Document No. 291 in Book 3266, Page 440, Official Records of said County; 4 thence East along said North line of Mattis property, a distance of 12.00 feet more or less to a point on a line 5 that is 660 feet West of the center line of said Fourth, Avenue, said point also being the West line of Road Improvement 6 District No. 38; thence South along said West line of Road Improvement District No. 38, a distance of 404 feet 7 more or less to the Southwest corner of that certain parcel described in the deed to Laurence J. Lambert, et~al 8 recorded December 2, 1964, Document No. 143 in Book 6283, Page 806, Official Records of said County; thence East 9 along the South line of said Lambert property and the Easterly prolongation thereof, a distance of 660 feet more or less to 10 said center line of Fourth Avenue; thence South along said center line, a distance of 1153 feet more or less to a point 11 on said Corporate Limit Line of the City of San Bernardino; thence following said Corporate Limit Line the following 12 courses and distances; thence Northwesterly 1350 feet more or less to an angle point; thence North, 685 feet more or 13 less to an angle point; thence East 150 feet more or less to an angle point; thence North 206 feet more or less to 14 an angle point; thence East 150 feet more or less to an ' angle point; thence North 360 feet more or less to the 15 Point of Beginning. 16 (Containing approximately 28.65 Acres.) 17 SECTION THREE: That the above described property will be subject 18 to taxation equally with the property within such municipal corporation to 19 pay its proportion of the following bonded indebtedness of the City of San 20 Bernardino, which said bonded indebtedness was outstanding or theretofore 21 authorized and is outstanding at the time of said annexation, to wit: 22 A bonded indebtedness of $490,000.00 incurred for the acquisition 23 and construction of a public library, including additions to and enlargements 2¢ of the public library system of said City, the outstanding indebtedness 25 thereon being $240,000.00, bearing interest at the rates of 4-3/4%, 3a1/4% 25 and 3-1/2% per annum; 27 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 2$ and construction of additions to, relocations of and replacements of the fire 29 fighting system of said City, the outstanding indebtedness thereon being 30 ' $710,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2% 31 per annum. 32 SECTION FOUR: The property herein annexed is declared to be a part - 3 I i it 7, of Ward 5, and the boundaries of Ward 5 are hereby altered to include said 2 annexed territory, with zoning class ificationa as shown on map titled Exhibit 3 "A" and described as follows: r~ R-3-3000 Multiple Family Residential District 5 That portion of the southwest one-quarter of Section 16, Township 1 North, Range 4 West, 6 San Bernardino Meridian if said section lines were extended across the Muscupiabe as per 7 plat thereof recorded in Book 7 of Maps, Page 23, records of the County Recorder of San $ Bernardino County, State of California lying ~ within the boundaries of the proposed g ~ annexation and excepting therefrom land owned by the San Bernardino County Flood Control 10 District. 11 "0" Open District 12 I That portion of the southwest one-quarter of Section 16, Township 1 North, Range 4 West, 13 San Bernardino Meridian if said section lines were extended across the Muscupiabe as per 14 plat thereof recorded in Book 7 of Maps, Page 23, records of the County Recorder of San 15 Bernardino County, State of California owned by the San Bernardino County Flood Control 16 District. 17 SECTION FIVE: That the area included in the above annexation is 1$ hereby detached from County Service Area SL-1, County Service Areas No. 38 and 19 X70 and Improvement Zone A of County Service Area 70, 20 I I HEREBY CERTIFY that the foregoing ordinance was duly adopted by 21 the Mayor and Coon ouncil of the City of San Bernardino at a J ~ 22 meeting thereof, held on the~'day of i , ~ 23 19 , by the following vote, to~/w~it: ~ ,~i ~-y 24 AYES: Counci en (/8~~„a-,~~r-~!~/ ~~~~~Z 25 ~iT/// 26 NOES: 27 ABSENT• h ~ ~ a 281 City Cler c 30 % //1 The foregoing ordinance is hereby approved this y~~,day of ~ L g / , 1971. 32 - 4 it I 1 ~ L_ 2 Mayor~of t e City of San Bernardino Pro Tempore 3 4 Approved as to form; 5 citycity A 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 ' 26 27 28 29 30 31 32 - 5 - I
