21~ AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMINDING ORDI-
NANCE N0. 2158 ENTITLED IN PART "AN ORDINANCE REGULATING THE
3'', INSTALLATION AND CONNECTION OF SEWER LATERALS TO EXISTING SEWER
MAINS AND INCREASING THE SEWER CONNECTION FEES.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 ~ DO ORDAIN AS FOLLOWS :

6 SECTION 1. Ordinance No. 2158 Section Four Subsection (b)
7 is amended to read as follows:
8 "(b) A connection fee shall be deposited with the Street
9 Superintendent of the City before connecting any parcel of
10 property to an existing sewer main which was not constructed by
11 and paid for by the owners, prior owners, or developers of the
12 eu~ject property or if the subject property has never been
13 assessed in an assessment district for sanitary sewers under the
14 Improvement Act of 1911 or any similar acto The connection fees
15 shall be as follows;
16 For each sewer lateral 4" (four inch) diameter - four
17 hundred dollars ($400.00)
18 For each sewer lateral 6" (six inch) diameter - eight
19 hundred dollars ($800000)
20 For each sewer lateral 8" (eight inch) diameter - sixteen i
21 hundred dollars ($1600.00)0
22 All fees deposited with the Street Superintendent of the
23 City, as required by this subsection (b) shall be deposited into
24 the Sewer Fund of the Cityo
25 The amount of any sewer connection fee shall be deemed a
26 debt owing to the City, and any person who connects to a street
27 sewer without having paid the connection fee in full as in this j
28 section provided or any portion thereof, shall be liable to an
29 action in the name of the City in any court of competent juris-
30 diction for the amount of such fee and costs. The conviction
31 and punishment of any person for connecting to a street sewer
32 without obtaining a permit so to do shall not relieve such

l!,person from paying the connection fee due and unpaid at the time
2iof such conviction, nor shall the payment of any connection fee
3~prevent a criminal prosecution for the violation of any of the
4 provisions of Ordinance 2158. All remedies prescribed hereunder
5~sha11 be cumulative, and the use of any one or more remedies
6 shall not bar the use of any other remedy for the purpose of
7 enforcing the provisions of Ordinance 2158."
8 SECTION 3. This ordinance shall become operative and
9 effective on January 1, 1972 and is subject to such application
10 as the President's Executive Order on Stabilization may have
11 thereto, said order being derived from the authority of the
12 Economic Stabilization Act of 1970, as amended and related con-
13 stitutional and statutory provisions.'
14 I HEREBY CERTIFY that the foregoing ordinance was duly
I 15 adopted by the Mayor and Common Council of the City of San Ber-
16 nardino at a meeting thereof, held on
