HomeMy WebLinkAbout3223 i 'I I i l ORDINANCE N0. ~~2 3 Ij 2~'! AN ORDINANCE OF TAE MAYOR AND COM[~N CODNCIL OF TAE CITY OF SAN iBERNARDINO APPROVING THE ANNIXATION OF DISTRICT N0. 276 (LAFC 1039). I 3~ WHEREAS, heretofore, proceedings were initiated by the Common 41 ~iCouncil of the City of San Bernardino, on its own motion, to annex to the 5 (City of San Bernardino certain contiguous uninhabited territory hereinafter 6 described; and 7 WHEREAS, on the 1st day of November, 1971, a resolution was adopted 8 by the aforesaid Common Council of the City of San Bernardino, 6~lifornia, 9 declaring that proceedings had been initiated by said Council, and proposing 10 the annexation, for the reasons therein stated, of the aforementioned 11 uninhabited territory to the City of San Bernardino, and that said resolution 12 provided that the proposed annexation should be generally known and identified 13 as Annexation District No. 276; and 14 15 WHEREAS, said resolution set forth therein that all the property included in the aforesaid territory should be taxed equally with the other 16 i property within the City to pay the bonded indebtedness and any and all general ~ 17 indebtedness and liability of the City of San Bernardino contracted prior to 18 or existing or outstanding at the time of the aforesaid proposed annexation 19 of the aforesaid property as provided in the hereinbefore mentioned Government 20 Code; and 21 WHEREAS, said resolution did fix, determine and declare that a 22 hearing be held on the 20th day of December, 1971, at the hour of 9:30 o'clock 23 A. M., in the Council Chambers located in the Garner Building, 392 Court Street, 24 San Bernardino, California, and the same was the day, hour and place designated 25 where any person owning real estate within such territory so proposed to be j 26 ' annexed and having any objections to the proposed annexation, might object 27 before the Common Council and show cause why such territory should not be 28 annexed; furthermore, the said resolution provided that at any time not latex 29 than the said hour set, as mentioned hereinbefore for the said hearing, any 30 ' owner of property within the said territory proposed to be annexed might file 31 written protest with the City of San Bernardino against such annexation; and 32 I ~I 1 ~ WHEREAS, there were • L8' written protests filed with the City Clerk i I 2 Hof the City of San Bernardino prior to 9:30 o'clock A. M., on December 20, 1971; 3 and thereafter on the~day of ~~r f.~n 1471, Resolution No./ 0902. 4 was adopted by the Mayor and Common Council declaring that a majority protest Shas not been presented; and g WHEREAS, it appears to the Common Council of the City of San '7 Bernardino that the aforesaid annexation proceedings have been completed and $ everything performed at this time in accordance with said Government Code, as g mentioned hereinbefore, and any and all other laws in any way connected with 10 the said annexation procedure having been complied with; and 11 WHEREAS, the Common Council of the City of San Bernardino desires to 12 pprove at this time the annexation of the aforesaid territory. 13 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 14 ERNARDINO DO ORDAIN, AS FOLLOWS: 15 SECTION ONE: That said territory herein described as Annexation 16 istrict No. 276 is hereby annexed and incorporated in and made a part of the 17 ity of San Bernardino. 18 SECTION TWO; The territory herein referred to as being annexed to lg he City o£ San Bernardino is particularly described as follows, to wit: 20 That portion of Sections 26, 27 and 34 Township 2 North, Range 5, West San Bernardino Base and Meridian if said 21 Section lines were extended across the RANCO MUSCUPIABE as per plat thaxeof recorded in Book 7 of Maps, Page 23, 22 records of the County Recorder of San Bernardino County, State of California and that portion of the Meyer and 23 Barclay Subdivision as per plat recorded in Book 2, page 32, records of the County Recorder of said County and 2¢ those portions of the adjoining streets described as follows: 25 Commencing at a point on the Present Corporate Limit line of 2g the Gity of San Bernardino, said point being the intersection of the centerline of State Highway No. 31 (Highway 395) and try the Northeasterly prolongation of the centerline of Rex Cole Drive; thence Northwesterly along said City Limit line, and 28 said center line 620 feet, more or less to the West line of that certain parcel described in the deed to W. L. Howarth 29 by document recorded May 14, 1947, Document No. 83 in Book 2053, Page 198, Official Records of said County; thence 30 North 16° 06' 10" East along said Corporate Limit line, a distance of 1275 feet more or less to an angle point; thence 31 southeasterly along said Corporate Limit line, a distance of 898.58 feet to the TRUE POINT OF BEGINNING said point being 32 on the West line of that certain parcel described in the 2 I ~~I i i 1 Deed to Edward B. Ballard et-ux recorded July 1, 1955, Document No. 152 in Book 3681, Page 238, Official Records 2 ~ of said County; thence following said Corporate Limit line the following courses and distances; thence continuing 3 southeasterly a distance of 2005.78 feet to an angle point; thence North 59° 44' 20" East, a distance of 1500 feet more 4, or less to the most Southerly corner of that certain parcel described in the Quitclaim Deed to Joseph C. Bonadiman 5 recorded September 1, 1970, Document No. 740 in Book 7509, Page 749, Official Records of said County; thence leaving 6 said City Limit line, North 37° 22' 40" West, along said Bonadiman property, a distance of 586.42 feet to the most 7 Westerly corner thereof; thence North 39° 45' East, along the Northwesterly line of said Bonadiman property, a ~ 8 distance of 580 feet to an angle point thereon; thence North 63° 00' East along said Bonadiman property a distance 9 of 106 feet to the most Westerly corner of that certain parcel described in the document to E. J. (Containing approximately 197 acres) 9 SECTION TAREE: That the above described property will be subject 10 to taxation equally with the property within such municipal corporation to 11 pay its proportion of the following bonded indebtedness of the City of San 12 Bernardino, which said bonded indebtedness was outstanding or theretofore 13 authorized and is outstanding at the time of said annexation, to wiC: 14 A bonded indebtedness of $490,000.00 incurred for the acquisition 15 and construction of a public library, including additions to and enlargements 16 of the public library systems of said City, the outstanding indebtedness 17 thereon being $210,000.00, bearing interest at the rates of 4-3/4%, 3-1/4% 18 and 3-1/2% per annum; 19 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 20 and construction of additions to, relocations of and replacements of the fire 21 fighting system of said City, the outstanding indebtedness thereon being 22 $710,000.00, bearing interest at the rates of 4%, 3%, 2-3/41, 2.9% and 2-1/2% 23 per annum. 24 SECTION FODR: The property herein annexed is declared to be a part 25 of Ward 5 and the boundaries of Ward 5 are hereby altered to include said 26 annexed territory, with zoning as shown on map titled Exhibit "A" and 27 described as follows: 28 R-1-7200 Single Family Residential District 29 Those portions of Sections 26, 27, and 34, Township 2 North, 30 Range 5 West, San Bernardino Base and Meridian, if said Section lines were extended across the Rancho Muscupiabe 31 as per plat thereof recorded in Book 7 of Mapa, Page 23, records of the County Recorder of San Bernardino County, 32 State of California, and that portion of the Meyer & - 4 - II ill 1~,' Barclay Subdivision as per plat recorded in Book 2, Page 32, records of the County Recorder of said County ~ 2Ii lying within the boundaries of the proposed annexation and excepting that portion herein described for the 3 "0" Open District zoning. 4 "0" Open District 5 That portion of Section 27, Township 2 North, Range 5 West, San Bernardino Base and Meridian if said Section lines were 6 extended across the Rancho Muscupiabe as per plat thereof recorded in Book 7 of Maps, Page 23, records of the County 7 Recorder of San Bernardino County, State of California and described as follows: Beginning at a point, (said point 8 being the Point of Beginning), on the present corporate limit line of the city of San Bernardino, and the most 9 southerly corner of that certain parcel described in the Quitclaim Deed to Joseph C.
