ORDINANCE N0. ~ 2 AN ORDINANCE OF THE MAYOR AND COMMON COIINCIL OF THE CTTY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0. 280 (LAFC 1064). 3 4 WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, to annex to the 6 City of San Bernardino certain contiguous uninhabited territory hereinafter 7 described; and 8 WHEREAS, on the 3rd day of January, 1972, a resolution was adopted 9 by the aforesaid Common Council of the City of San Bernardino, California, 10 declaring that proceedings had been initiated by said Council, and proposing 11 the annexation, for the reasons therein stated, of the aforementioned 12 uninhabited territory to the City of San Bernardino, and that said resolution 13 provided that the proposed annexation should be generally known and identified 14 as Annexation District No. 280; and 15 WHEREAS, said resolution set forth therein that all the property 16 included in the aforesaid territory should be taxed equally with the other 17 property within the City to pay the bonded indebtedness and any and all general 18 indebtedness and liability of the City of San Bernardino contracted prior to 19 or existing or outstanding at the time of the aforesaid proposed annexation 20 of the aforesaid property as provided in the hereinbefore mentioned Government 21 Code; and 22 WHEREAS, said resolution did fix, determine and declare that a 23 hearing be held on the 22nd day of February, 1972, at the hour of 9:30 o'clock 24 A. M., in the Council Chambers located in the Garner Building, 392 Court Street, 25 San Bernardino, California, and the same was the day, hour and place designated 26 where any person owning real estate within such territory so proposed to be 27 annexed and having any objections to the proposed annexation, might object 28 before the Common Council and show cause why such territory should not be 29 annexed; furthermore, the said resolution provided that at any time not later 30 than the said hour set, as mentioned hereinbefore for the said hearing, any 31 owner of property within the said territory proposed to be annexed might file 32 written protest with the City of San Bernardino against such annexation; and i ~i 1 WHEREAS, there were written protests filed with the City Clerk 2 of the City of San Bernardino prior to 9:30 o'clock A. M., on February 22, 1972; 3 and thereafter, on theay of 1972, Resolution No. 4 was adopted by the Mayor and Common Counci declaring that a majority protest 5 has not been presented; and 6 WHEREAS, it appears to the Common Council of the City of San 7 Bernardino that the aforesaid annexation proceedings have been completed and 8 everything performed at this time in accordance with said Government Code, as 9 mentioned hereinbefore, and any and all other laws in any way connected with 10 the said annexation procedure having been complied with; and 11 WHEREAS, the Common Council of the City of San Bernardino desires to 12 approve at this time the annexation of the aforesaid territory. 13 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 14 BERNARDINO DO ORDAIN AS FOLLOWS: 15 SECTION ONE: That said territory harain described as Annexation 16 District No. 280 is hereby annexed and incorporated in and made a part of the 17 City of San Bernardino. 18 SECTION TWO: The territory herein referred to as being annexed to 19 the City of San Bernardino is particularly described as follows: to wit: 20 Lots 110, 136 and 137, Tract No. 1995 as per plat thereof recorded in Book 29 of Maps, Page 13, records of the County 21 Recorder of San Bernardino County, State of California and those portions of the adjoining streets described as follows: 22 Beginning at a point on the Present Corporate Limit Line of 23 the City of San Bernardino, said point being on the center line of Waterman Avenue, approximately 440 feet north of the 24 center line of Ennis Street and more particularly described as the intersection of the Easterly prolongation of the South 25 line of said Lot 137 and said City Limit Line; thence Westerly along said Easterly prolongation and said South line and the 26 South line of said Lot 110 and the Westerly prolongation thereof, a distance of 661.25 feet more or less to the center 27 line of Lincoln Avenue; thence North along said center line of Lincoln Avenue, a distance of 130 feet more or less to the 28 Westerly prolongation of the North line of said Lot 110; thence East along said Westerly prolongation and North line, a 29 distance of 320 feet more or less to the Northeast corner thereof; thence North along the West line of said Lot 136, a 30 distance of 130 feet to the Northwest corner of said Lot 136; thence East along the North line of said Lot 136 and the 31 Easterly prolongation thereof, a distance of 341.25 feet more or less to the center line of said Waterman Avenue, said point 32 being on the Corporate Limit Line of said City; thence South a 2 1 along said City Limit Line a distance of 260 feet more or less to the point of beginning. 2 (Containing approximately 3 acres) 3 SECTION THREE: That the above described property will be subject ¢ to taxation equally with the property within such municipal corporation to 5 pay its proportion of the following bonded indebtedness of the City of San 6 Bernardino, which said bonded indebtedness was outstanding or theretofore 7 authorized and is outstanding at the time of said annexation, to wit: $ A bonded indebtedness of $490,000.00 incurred for the acquisition 9 and construction of a public library, including additions to and enlargements 10 of the public library system of said City, the outstanding indebtedness 11 thereon being $210,000,00, bearing interest at the rates of 4-3/4%, 3-1/4%, 12 and 3-1/2% per annum; 13 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 14 and construction of additions to, relocations of and replacements of the fire 15 fighting system of said City, the outstanding indebtedness thereon being 16 $710,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2% 17 per annum. 1g SECTION FOUR: The property herein annexed is declared to be a part lg of Ward 3 and the boundaries of Ward 3 are hereby altered to include said 20 annexed territory, with zoning as shown on map titled Exhibit "A" and 21 described as follows: 22 GM - Commercial Manufacturing District Lots 136 and 137, Tract 1995 23 M-1 - Light Industrial District 2¢ Lot 110, Tract 1995 25 SEGxION FIVE: That the area included in the above annexation is 26 hereby detached from County Service Areas No. 28, 38 and 70, and Improvement 27 Zone "A" of County Service Area 70. 2$ I HEREBY CERTIFY that the foregoing ordinance was duly adopted by 2g the Mayor and Common Council of the City of San Bernardino at a 30 meeting thereof, held on the day of 31 1972, by a following vote, to-twit/: Q / 32 AYES: Councilmen (~/~6~.(t~Lz , /~~~~•-ct/, ~~-~o-~~- , - 3 - i I 1 u(a-t~-,~ ~~-u~-,~r~tJ 2 NOES: [iLr7t.L. 3 ABSENT: ~wc~-~ ~,.,A.>J ~°~-yL~ 4 5 City Cl,~rk g ~ ~n _t~- 1'he foregoing ordinance is hereby approved this ~ -.day of 9 '/~L~wi' A 1972. 10 11 / 12 . 13 aI~ y~q~the, ity of San Bernardino 14 Approved as to form: 15 16 './fyyr~~.c~ itG~y A~rney 17 18 19 20 21 22 23 24 25 26 27 28 29 30 I~ ~ ~ u w. , . i 31 32 _ q _
