2 AN ORDINANCE OF THE MAYOR AND COMMON CODNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0. 281 (LAFC 1065).

4i WHEREAS, heretofore, proceedings were initiated by the Common
5 Council of the City of San Bernardino, on its own motion, to annex to the
' g City of San Bernardino certain contiguous uninhahited territory hereinafter
7 described; and
g WHEREAS, on the 3rd day of January, 1972, a resolution was adopted
g by the aforesaid Common Council of the City of San Bernardino, California,
10 declaring that proceedings had been initiated by said Council, and proposing
11 the annexation, for the reasons therein stated, of the aforementioned
],2 uninhabited territory to the City of San Bernardino, and that said resolution
13 provided that the proposed annexation should be generally known and identified
14 as Annexation District No. 281; and
15 WHEREAS, said resolution set forth therein that all the property
16 included in the aforesaid territory should be taxed equally with the other
17 property within the City to pay the bonded indebtedness and any and all general
],g indebtedness and liability of the City of San Bernardino contracted prior to
],g or existing or outstanding at the time of the aforesaid proposed annexation
2p of the aforesaid property as provided in the hereinbefore mentioned Government
21 Code; and
Q2 WHEREAS, said resolution did fix, determine and declare that a
23 hearing be held on the 22nd day of February, 1972, at the hour of 9:30 o'clock
24 A. M„ in the Council Chambers located in the Garner Building, 392 Court Street
25 San Bernardino, California, and the same was the day, hour and place designated
26 where any person owning real estate within such territory so proposed to be
27 annexed and having any objections to the proposed annexation, might object
2g before the Common Council and show cause why such territory should not be
29 annexed; furthermore, the said resolution provided that at any time not later
30 than the said hour set, as mentioned hereinbefore for the said hearing, any
31 owner of property within the said territory proposed to be annexed might file
32 written protest with the City of San Bernardino against such annexation; and

1 WHEREAS, there were ~b written protests filed with the City Clerk
2 of the City of San Bernardino prior to 9:30 o'clock A. M., on February 22, 1972;
3 and thereafter on the '~i~da of ~

4 was adopted by the Mayor and Common Council eclaring that a majority protest
5 has not been presented; and
6 WHEREAS, it appears to the Common Council of the City of San
7 Bernardino that the aforesaid annexation proceedings have been completed and
8 everything performed at this time in accordance with said Government Code, as
9 mentioned hereinbefore, and any and all other laws in any way connected with
10 the said annexation procedure having been complied with; and
11 WHEREAS, the Common Council of the City of San Bernardino desires to
12 approve at this time the annexation of the aforesaid territory.
13 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
14 BERNARDINO DO ORDAIN AS FOLLOWS:
15 SECTION ONE: That said territory herein described as Annexation
16 District No. 281 is hereby annexed and incorporated in and made a part of the
17 City of San Bernardino.
18 SECTION TWO: The territory herein referred to as being annexed to
19 the City of San Bernardino is particularly described as follows: to wit:
20 That portion of the Northwest one-quarter of Section 22,
Township 1 North, Range 4 West, San Bernardino Base and
21 Meridian (unsurveyed) in Rancho Muscupiabe as per plat
recorded in Book 7 of Maps, page 23, records of the County
22 Recorder of San Bernardino County, State of California, if
said section lines were extended across said Rancho and
23 that portion of Tract No. 2436 as per plat thereof recorded
in Book 34 of Maps, Page 91, records of said County and
24 that portion of Arrowhead Suburban Farms Tract "D" as per
plat thereof recorded in Book 23 of Maps, Page 35, records
25 of said County, and those portions of the adjoining streets,
described as a whole as follows:

Beginning at the intersection of the center line of Arrow-
27 head Avenue, 50.00 feet wide as said ntreet is delineated
on said Tract 2436 and the Present Corporate Limit Line of
28 the City of San Bernardino, said point being Easterly along
said center line of Arrowhead Avenue, a distance of 590 feet,
29 more or less from the East line of "D" Street; thence
following said City Limit Line the following courses and
30 distances; thence West along the Easterly prolongation of
the South line of Lot 25 and the South lines of Lots 25, 24,
31 23, 22 and 21, of said Tract 2436, a distance of 420 feet
more or less to the Southeast corner of Lot 20 of said Tract
32 2436; thence North along the East line of said Lot 20, a

point being on the South line of said Arrowhead Avenue;

29 SECTION THREE: That the above described property will be subject
30 to taxation equally with the property within such municipal corporation to
31 pay its proportion of the following bonded indebtedness of the City of San
32 Bernardino, which said bonded indebtedness was outstanding or theretofore

1 authorized and is outstanding at the time of said annexation, to wit:
2 A bonded indebtedness of $490,000.00 incurred for the acquisition
3 and construction of a public library, including additions to and enlargements
4 of the public library system of said City, the outstanding indebtedness
5 thereon being $210,000.00, bearing interest at the rates of 4-3/4%, 3-1/4%,
6 and 3-1/2% per annum;
7 A bonded indebtedness of $1,116,000.00 incurred for the acquisition
$ and construction of additions to, relocations of and replacements of the fire
9 fighting system of said City, the outstanding indebtedness thereon being
10 $710,000.00, bearing interest at the rates of 47,, 3%, 2-3/4%, 2.9% and 2-1/2%
11 per annum.
12 SECTION FOUR: The property herein annexed is declared to be a part
13 of Wards 4 and 7 and the boundaries of Wards 4 and 7 are hereby altered to
14 include said annexed territory, with zoning as shown on map titled Exhibit "A"
15 and described as follows:
16 Ward 4: All that portion of the annexation lying northerly
of the center line of Arrowhead Avenue.

Ward 7: All that portion of the annexation
1g southerly of the center line of Arrowhead Avenue.
19 R-1-7200 Single Family Residential District:
That portion of the northwest one-quarter of Section 22,
20 Township 1 North, Range 4 West, San Bernardino Base and
Meridian (unsurveyed) in Rancho Muscupiabe as per plat
21 recorded in Book 7 of maps, page 23, records of the County
Recorder of San Bernardino County, State of California, if
22 said Section lines were extended across the Rancho and that
portion of Tract No. 2436 as per plat thereof recorded in
23 Book 34 of maps, page 91, records of said County lying
within the boundaries of the proposed annexation.

R-3-3000 Multiple Family Residential District:
25 That portion of Lot 5, Arrowhead Suburban Farms, Tract D,
lying within the annexation.

SECTION FIVE: That the area included in the above annexation is

hereby detached from County Service Areas No. 38 and 70, Improvement Zone
28
"A" of County Service Area 70 and County Service Area S7r 1.

I HEREBY CERTIFY that the foregoing ordinance was duly adopted by

the Mayor and Common Council of the City of San Bernardino at a
31
