HomeMy WebLinkAbout3261 II II 1 ORDINANCE N0. 2 AN ORDINANCE OF THE CTTY OF SAN BERNARDINO AMENDING ORDINANC N0. 3248, KNOWN AS THE "UNIFORM BUILDING ORDINANCE;" PROVIDING 3 FOR AN INCREASE IN PERMIT FEES; AND MODIFYING THE EXCAVATION AND GRADING CHAPTER. 4 THE MAYOR AND COMMON COUNCIL OF THE CTTY OF SAN BERNARDINO 5 DO ORDAIN AS FOLLOWS: 6 SECTION 1. Ordinance No. 3248, Section Three, which amends 7 certain sections and provisions of the UNIFORM BUILDING CODE, 8 VOLUME I (1970 Edition), is hereby amended by adding thereto 9 amendments to certain sections or subsections of said Code to 10 read as follows: 11 "Sec. 303. (a) Buildin Permit Fees. A fee for each building permit s a e pa"~3 to the Build- 12 ing Official as set forth in Table 3-A. 13 The determination of value or valuation under any of the provisions of this Code shall be made by 14 the Building Official. The valuation to be used in computing the permit fees and plan-check fees 16 shall be the total value of all construction work for which the permit is issued; as well as all 16 finish work, painting, roofing, electrical, plumb- ing, heating, air conditioning, elevators, fire- 17 extinguishing systems and any other permanent equipment. 18 TABLE N0. 3-A BUILDING PERMIT FEES 19 TOTAL VALUATION FEE 20 $1.00 to $500.00 $7.50 21 $500.01 to $2,000.00 7.50 for the first $500.00 plus 22 1.50 for each additional $100.00 or fraction thereof, to and in- 23 cluding $2,000.00 24 $2,000.01 to $25,000.00 30.00 for the first $2,000.00 plus ,4.50 for each additional thousand 25 or fraction thereof, to and in- cluding $25,000.00 26 $25,000.01 to $50,000.00 $133.50 for the first $25,000.00 27 plus $3.75 for each additional thousand or fraction thereof, to 28 and including $50,000.00 29 $50,000.01 to $227.25 for the first $50,000.00 $100,000.00 plus $2.25 for each additional 30 thousand or fraction thereof, to and including $100,000.00 31 $100,000.01 and up $339.75 for the first $100,000.00 32 plus $1.50 for each additional thousand or fraction thereof. ~i 1 Where work for which a permit is required by this Code is started prior to obtaining said permit, the 2 fees above specified shall be doubled; but the pay- ment of such double fee shall not relieve any per- 3 sons from fully complying with the requirements of this Code in the execution of the work nor from any 4 other penalties prescribed herein. 5 An additional fee of $7.50 shall be paid to the Building Official for each inspection that is made g after two previous inspections have been made of either the foundation, frame, lath, or final con- ? struction; and such fee shall not be in lieu of any other requirement, fee or penalty provided g for herein. g Pursuant to the provisions of Chapter 8, Division 2 of the Public Resources Code, an amount equal to 10 .007 percent of the estimated construction cost shall be added to the cost of the permit for con- 11 struction with an estimated valuation exceeding $1,000.00" 12 "Sec. 7006. (c) Plans and S ecifications. Each 13 application for a gra ing permit s a e accom- panied by two sets of plans and specifications 14 and supporting data consisting of a soil engineer- ing report, and, when required by the City Engineer, 15 an engineering geology report. Except as waived by the City Engineer for small and unimportant 16 work, the plans and specifications shall be pre- pared and signed by a civil engineer licensed by 17 the State of California." lg "Sec. 7012. (d) Dis osal. All drainage facili- ties shall be design carry waters to the 1g nearest practicable drainage way approved by the City Engineer and/or other appropriate jurisdic- 20 tion as a safe place to deposit such waters. If drainage facilities discharge onto natural ground, 21 riprap may be required. 22 At least two percent gradient toward approved ~ drainage facilities from building pads will be 23 required unless waived by the City Engineer for nonhilly terrain. Lot grades shall be a minimum 24 of 2 percent for hillside areas." 25 "Sec. 7013. (a) Slo es. The face of all cut and fill slopes shall e p anted and maintained with 2g a ground cover approved by the City Engineer to protect the slopes against erosion as soon as 27 practical and prior to the final approval of the grading. Where cut slopes are not subject to 2g erosion due to their rocky character, this re- quirement may be waived by the City Engineer. An 29 irrigation system or watering fac ilities may be required by the City Engineer." 30 "Sec. 7014. ~c) En ineered Gradi Re uirements. 31 For engineere gra ing it s a e t e responsi- bility of the civil engineer who prepares the 32 approved grading plan to incorporate all recommend- - 2 - i i ~ 11~' ations from the soil engineering and engineering geology reports into the grading plan. He shall 21j also be responsible for the professional inspec- ' tion and certification of the grading within his 31~I area of technical specialty. This responsibility I. shall include, but need not be limited to, in- 4;ii spection and certification as to the establish- ment of line, grade and drainage of the develop- Slli went area. The civil engineer shall act as the coordinating agent 5ui the event the need arises 6',' for liaison between the other professionals, the contractor and the City Engineer. The civil 7 engineer shall also be responsible for the pre- paration of revised plans and the submission of 8 as-graded grading plans upon completion of the work. 9 Soil engineering and engineering geology reports 10 shall be required as specified in Section 7006. During grading all necessary reports, compaction 11 data and soil engineering and engineering geology recommendations shall be submitted to the civil 12i~ engineer and the City Engineer by the soil en- gineer and the engineering geologist. Such re- 13~ ports shall be submitted weekly while the work it is in progress. Compaction reports shall include 14'i' the date, time and place of testing. 15 The soil engineer`s area of responsibility shall include, but need not be limited to, the profes- 16 sional inspection and certification concerning the preparation of ground to receive fills, test- 17 Ong for required compaction, stability of all ' finish slopes and testing for required compaction, 18 stability of all finish slopes and the design of ~ buttress fills, where required, incorporating 1911 data supplied by the engineering geologist. 20 The engineering geologistis area of responsibility shall include, but need not be limited to, profes- 21 sional inspection and certification of the adequacy of natural ground for receiving fills and the 22 stability of cut slopes with respect to geological matters, and the need for subdrains or other ground 23 water drainage devices. He shall report his find- ings to the soil engineer and the civil engineer 24 for engineering analysis." 25 "Sec. 7014. (d) Re ular Gradi Re uirements. The City Engineer s a inspect t e wor an re- 26 quire adequate inspection and compaction control by a soils testing agency. The soils testing 27 agency shall be approved by the City Engineer. 28 The testing agency`s responsibility shall include, but need not be limited to, certification concern- 29 ing the inspection of cleared areas and benches 30 to receive fill, and the compaction of fills. 31 When the City Engineer has cause to believe that geologic factors ma.y be involved the grading operation will be required to conform to °engineered 32 grading` requirements." - 3 - 1 "Sec, 7015, (a) 2. A soil grading report pre- pared by the soil engineer, including locations 2 and elevations of field density tests, summaries of field and laboratory tests, and other substantiat- 3 ing data and comments on any changes made during grading and their effect on the recommendations 4 made in the soil engineering investigation report. He shall provide certification that the grading 5 operations have met the requirements of this ordi- nance." 6 "Sec, 7015, (b) Notification of Com letion, The 7 permittee or his agent smell no~i y t e ity Engineer when the grading operation is ready for final i.n- g spection, Final approval shall not be given until all work including installation of all drainage 9 facilities and their protective devices and all erosion control measures nave been completed in 10 accordance with the final approved grading plan and the required reports have been submitted, All 11 erosion control planting, devices, and work on ~ hillside lots shall be completed prior to issuance 12 of a building permit." 13 SECTION 2. Ordinance i~io, 3248, Section Five, which adds 14 certain sections, subsections, and paragraphs to said UNIFORM 15 BUILDING CODE, is hereby amended by adding Section 7000 to said 16 Code to read as follows: 17 "Sec. 7000, The words 'Building Official' as hereinafter used shall mean City Engineer of the City of San Bernardino.
