2, ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE
N0. 1554 ENTTTLED IN PART "AN ORDINANCE PROHIBITING THE DRINKING
3 OR CONSUMPTION OF ALCOHOLIC BEVERAGES UPON OR IN ANY PUBLIC
STREET REGULATING SUCH CONSUMPTION 7N CERTAIN MUNICIPAL
4 BUILDINGS OR STREETS UNDER SPECIFIED CIRCUMSTANCES; AND REPEAL-
ING SECTION FOUR THEREOF.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF 5AN BERNARDINO
6 DO ORDAIN AS FOLLOWS;
7 SECTION 1. The title of Ordinance No. 1554 is hereby
8 amended to read as follows:
g "Ordinance Prohibiting the Drinking or Consumption of
10 Alcoholic Beverages Upon or in any Public Street; A11ey, Highway,
11 or Other Public Place."
12 SECTION 2, Ordinance No. 1554 is hereby amended by adding
13 thereto Section Three to read as follows;
14 "SECTION THREE: The drinking or consumption, the offering,
15 giving, or furnishing or causing the offering, giving or furnish-
16 ~-ng, of alcoholic or intoxicating beverages may be expressly
17 permitted by written authorization from the City Administrator
lg in the Exhibit Hall and from the Mayor and Common Council in any
lg other municipally owned, leased or operated public building or
' 20 facility or in any city park or street, for special public events
i 21 or meetings; or for conferences or conventions when not otherwise i
22 expressly prohibited by other local ordinance, provided that such
23 authorization shall be requested in writing, and if granted, shall
24 be subject to conditions and all rules and regulations and
25 ordinances of the city and may be modified or simm~arily revoked
26 at any time by the Common Council, City Administrator or Chief
g7 of Police without cause or the right to notice or a hearing."
28 SECTION 3. Ordinance No, 1554 Section Four is hereby repeal
29 SECTION 4. This Ordinance is an emergency and urgency
30 measure necessary for the immediate preservation of the public
' 31 peace, health and safety and shall go into effect iamiediately
' 32 upon its adoption and approval. The facts constituting such

11 emergency are: j
2 In instances when the consumption of alcoholic beverages in
3~, public places is expressly permitted by law, there are inadequate
4 or no safeguards and conditions imposed upon such consumption
5i and inadequate procedures to immediately revoke such permission.
~ 6 Therefore, proper controls are needed to regulate the consumption
7 of alcoholic beverages in public buildings or streets during
g the large gatherings of persons scheduled for May, 1972,
9 I HEREBY CERTIFY that the foregoing Ordinance was duly
10 adopted by the Mayor and Common Council of the City of San Ber-
11 nardino at a _i~ meeting thereof held on the
12 dad of 1972; by the following vote,/to
