N0. 2842 INTITLE D IN PART "AN ORDINANCE . . REGULATING THE `
3I EXCLUSIVE USE OF PUBLIC PARKS; AUTHORIZING THE SUMMARY REVOCA-
TION OF PERMITS THEREFOR AND PERMITTING SALES AND ADMISSION
4,` CHARGES UNDER CERTAIN CIRCUMSTANCES.
5j THE MEIYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1. Ordinance No. 2842 Section Three is hereby

amended to read as follows:

"Section Three: The permit shall specify what portion of
9
thepublic park shall be utilized, the date and time that it
10
may be utilized and any conditions or requirements imposed upon
11
such use. Such permit shall be subject to modification at any
j 12
time and may be summarily revoked without cause or rights to a
13
hearing or notice by the City Administrator or Chief of Police
14
u on his findin that a violation or anticipated violation of

any condition of use or of any rule, regulation or ordinance
16
of the city has occurred or will occur.

SECTION 2. Ordinance No. 2842 Section Six is hereby amended
18
to read as follows;
19
"Section Six: Except when expressly authorized in the
20
permit, no admission charge, donation, or other remuneration
I 21
shall be imposed or received by the permittee or its agents
22
fm m the public in or upon the public parks of said city; and
23
no solicitations, whether for membership, charity or any other
24
purpose shall be sought, requested or received by said permittee
25
or its agents when in or about the public parks of said city.

SECTION 3. This Ordinance is an emergency and urgency
27
measure necessary for the immediate preservation of the public
28
peace, health and safety and shall go into effect immediately
29
upon its adoption and approval. The facts constituting such
30
emergency are:

More permits are being issued for large gatherings of persons
32
1 in the public parks during the present clement weather and
2I there are no provisions to amend conditions for exclusive use
3 or to summarily revoke such permits for violations of the
4 conditions, rules or laws. Property owners adjoining the parks
5 have been disturbed and harassed; persons using the parks are
6 endangered and damage to the parks and facilities has occurred.
7 Therefore, immediate controls are necessaryo
8 I HEREBY CERTIFY that the foregoing Ordinance was duly
9 adopted by the Mayor and Common Council of the City of San Ber-
10 nardino at a meeting thereof held on the
11 ,day of lti , 1972, by the following
