2 AN ORDINANCE OF THE CTTY OF SAN BERNARDINO AMENDING ORDI-
NANCE N0. 2121 ENTITLED IN PART "AN ORDINANCE . . PROVIDING
3 FOR THE KEEPING AND SALE OE UNGIA7MED PROPERTY . AND
PROVIDING FOR THE VESTING OF TITLE OF SUCH PROPERTY IN THE
4 OWNER OR FINDER.
5 THE MAYOR AND COMMON COUNCIL OF THE CTTY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS;

SECTION 1. Ordinance No. 2121 Section One is hereby
7
amended to read as follows;

"Section One. California Civil Code, Section 2080, 2080.1,
9
and 2080.2 are hereby adopted by reference and made effective
10
and operative in the City of San Bernardino. That any and all
11
unclaimed property now or hereinafter coming into the posses-
12
sion of the Police Department shall be inventoried at least
13
every three (3) months by the Chief of Police and a full and
1 14
complete list thereof shall be transmitted to the City Admin-
15
istrator.

Any and all unclaimed property found by City employees
17
during the course of their employment shall be delivered to
18
the Police Department and shall be disposed of in accordance
19
with this ord finance."

SECTION 2. Ordinance No. 2121, Section Two is hereby
21
amended to read as follows;
22
"Section Two. That the City Administrator, upon receipt
23 of said list of unclaimed property shall determine therefrom
24
the unclaimed bicycles that have been held by the Police De-
25
partment for a period of at least three (3) months and all

other unclaimed property that has been held at least four (4)
27
months, whereupon said City Administrator shall cause said
28
unclaimed property so held to be sold at public auction.

(a) That notice of such sale, describing the property
30
in sufficient detail for its identification, shall be prepared
31
by the City Administrator, and said notice signed by the Chief
32
of Police, which said notice of said sale shall be given at
it
1 least five (5) days before the time fixed therefor by publica-
2 tion once in a newspaper a~ general circulation published in
3 the City of San Bernardino.
4 (b) If after five (5) days following the publication of
5 the notice no owner appears and proves his ownership of the
6 property and the person who found or saved the property pays
7 the cost of the publication, the title shall vest in the
g person who found or saved the property, unless the property

g was found in the course of employment by an employee of the
lp City of San Bernardino in which case the property shall be
11~~' sold at public auction or, transferred for the use of any
12 department of the City of San Bernardino. Tit 1e to the
13 property shall not vest in the person who found or saved the
14 property unless the cost of publication is first paid to the
15 Treasurer of the City of San Bernardino prior to the sale at
16 public auction.
lry (c) That no city officer or employee shall directly or
lg indirectly submit a bid for the purchase of said unclaimed
lg property at said sale if he has authorized, conducted or ad-
20 ministered, or participated in the preparation or conduct of
21 said sale in his official capacity.
22 (d) That said property so offered for sale shall be sold
23 to the highest bidder for cash,"

24 I HEREBY CERTIFY that the foregoing ordinance was duly
25 adopted by the Mayor and Common Council/of the City of San
26 Bernardino at meeting thereof, held on
