2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CTTY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0. 284 (LAFC 1098}.

4 WHEREAS, heretofore, proceedings were initiated by the Common
5 Council of the City of San Bernardino, on its own motion, to annex to the
6 City of San Bernardino certain contiguous uninhabited territory hereinafter
7 described; and
8 WHEREAS, on the 15th day of May, 1972, a resolution was adopted
9 by the aforesaid Common Council of the City of San Bernardino, California,
10 declaring that proceedings had been initiated by said Council, and proposing
11 the annexation, for the reasons therein stated, of the aforementioned
12 uninhabited territory to the City of San Bernardino, and that said resolution
13 provided that the proposed annexation should be generally known and identified
14 as Annexation District No. 284; and
15 WHEREAS, said resolution set forth therein that all the property
16 included in the aforesaid territory should be taxed equally with the other
17 property within the City to pay the bonded indebtedness and any and all general

18 indebtedness and liability of the City of San Bernardino contracted prior to
19 or existing or outstanding at the time of the aforesaid proposed annexation
20 of the aforesaid property as provided in the hereinbefore mentioned Government
21 Code; and
22 WHEREAS, said resolution did fax, determine and declare that a
23 hearing be held on the 3rd day of July, 1972, at the hour of 9:30 olclock
24 A. M., in the Council Chambers located in the Garner Building, 392 Court Street,
25 San Bernardino, California, and the same was the day, hour and place designated
26 where any person owning real estate within such territory so proposed to be
27 annexed and having any objections to the proposed annexation, might object
28 before the Common Council and show cause why such territory should not be
29 annexed; furthermore, the said resolution provided that at any time not later
30 than the said hour set, as mentioned hereinbefore for the said hearing, any
31 owner of property within the said territory proposed to be annexed might file
32 written protest with the City of San Bernardino against such annexation; and
1 WHEREAS, there were ~~written protests filed with the City Clerk
Q ~ of the City of San Bernardino prior to 9:30 o'clock A. M., on July 3, 1972;
3 and thereafter, on the day of 1972, Resolution No.
¢ was adopted by the Mayor and Common ounc' declaring that a majority protest
5 has not been presented; and
6 WHEREAS, it appears to the Co®on Council of the City of San
7 Bernardino that the aforesaid annexation proceedings have been completed and
$ everything performed at this time in accordance with said Government Code, as
g mentioned hereinbefore, and any and all other Laws in any way connected with
],0 the said annexation procedure having been complied with; and
11 WHEREAS, the Coimnon Council of the City of San Bernardino desires to
12 approve at this time the annexation of the aforesaid territory.
13 NOW, THEREFORE, TAE MAYOR AND COMMON COIINCIL OF THE CITY OF SAN
14 BERNARDINO DO ORDA]N AS FOLLOWS:
15 SECTION ONE: That said territory herein described as Annexation
16 District No. 284 is hereby annexed and incorporated in and made a part of the
17 City of San Bernardino.
lg SECTION TWO: The territory herein referred to as being annexed to
lg the City of San Bernardino is particularly described as follows: to wit:
20 That portion of Tract No, 5111 as per plat thereof recorded
in Book 89 of Mapa, pages 47 and 48, records of the County
21 Recorder of San Bernardino County, State of California and
that portion of Tract No, 7717"as per plat thereof recorded
22 in Book 111, pages 62 and 63, records of the County Recorder
of said County and that portion of the Southeast one quarter
23 of Section 32, Township One North, Range Three West, SAN
BERNARDINO BASE AND MERIDIAN and those portions of the
24 adjoining street described as follows:
25 Beginning at a point on the Present Corporate Limits of the
Gity of San Bernardino, said point being the intersection of
2B the center lines of Clifton Avenue and Orange Street; thence
leaving said City Limit Line, East along said center line of
27 Clifton Avenue, a distance of 240 feet more or less to its
intersection with the Northwesterly prolongation of the
28 Northeasterly line of Lot 36 of said Tract 5111; thence
Southeasterly along said Northwesterly prolongation and
29 said Northeasterly line, a distance of 155 feet more or less
to the Northeast corner of said Lot 36; thence South along
30 the East line of said Lot 36, a distance of 117.64 feet to the
Southeast corner thereof, said point being also on the North
31 line of Parcel No. 1 as described in the dead to Douglass
Campbell Frank et~ux recorded July 7, 1950, Document No. 125
32 in Book 2601, page 356, Official Records of said County; thence

li East along said North line of Frank's property, a distance
of 940 feet more or less to the center line of Palm Avenue;
2i thence South along said center line of Palm Avenue, a
j distance of 625 feet more or less to the Easterly prolongation
3 of the North line of that certain parcel described in the
deed to Eugene N. Nocchi et ux recorded October 7, 1964;
4 Document No. 149 in Book 6246, Page 832 Official Records of
said County; thence Weat along said Easterly prolongation
5 and said North line, a distance of 180 feet more or less to
the East line of that certain parcel described as Parcel
6 No. 1 in the deed to The Southern California District of the
Lutheran Church - Missouri Synod, a corporation recorded
7 January 26, 1962; Document No. 124 in Book 5636, Page 757,
Official Records of said County; thence South along said
8 last mentioned East line a distance of 75 feet more or less
to the Southeast corner of said Church property, said point
9 being on a line that is 1400 feet South of the North line of
said Southeast one-quarter of said Section 32; thence West
10 along said last mentioned line a distance of 231.41 feet more
or less to the Northeast corner of that certain parcel
11 described in the deed to Highland School District of San
Bernardino County, a body politic recorded June 8, 1962;
12 Document No. 235 in Book 5713, Page 51 of Official Records
of said County; thence South along the East line of said
13 School property and continuing South along the East line of
that certain parcel described in the deed to said School
14 recorded June 8, 1962; Document No. 237 in Book 5713, page
55, Official Records of said County, a distance of 466.66
15 feet more or less to the Southeast corner of said last
mentioned parcel; thence West along the South line of said
16 last mentioned parcel, a distance of 690 feet more or less
to the center line of Cole Avenue; thence North along said
17 center line of Cole Avenue, a distance of 520 feet more or
less to the center line of Fourteenth Street; thence West
18 along said center line of Fourteenth Street, a distance of
17.00 feet more or less to the intersection with the
19 Southerly prolongation of the East line of Tract 5110 as
per plat thereof recorded in Book 62 of Maps, pages 12 and
20 13, records of said County; thence North along said Southerly
prolongation and said East line and continuing North along
21 the East line of said Tract 5111, a distance of 520 feet more
or less to the center line of Fisher Street; thence West
22 along the canter line of said Fisher Street, a distance of
250 feet more or less to the center line of Orange Street;
23 thence North along said center line of Orange Street and
along said City Limit Line, a distance of 300 feat more or
24 less to the Point of Beginning.

SECTION THREE: That the above described property will be subject
26
to taxation equally with the property within such municipal corporation to
27
pay its proportion of the following bonded indebtedness of the City of San
28
Bernardino, which said bonded indebtedness was outstanding or theretofore
29
authorized and is outstanding at the time of said annexation, to wit:

A bonded indebtedness of $490,000.00 incurred for the acquisition
31
and construction of a public library, including additions to and enlargements

of the public library system of said City, the outstanding indebtedness
2 thereon being $210,000.00, bearing interest at the rates of /+~3/4%, 3-1/4%, i
3 and 3.•1/2% per annum;
¢ A bonded indebtedness of $1,116,000.00 incurred for the acquisition
5 and construction of additions to, relocations of and replacements of the fire
fighting system of said City, the outstanding indebtedness thereon being
7 $655,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2%
$ per annum.
g SECTION FOIIR; The property herein annexed is declared to be a part
10 of Ward 4 and the boundaries of Ward 4 are hereby altered to include said
11 annexed Cerritory, with zoning to be in the R.-1-7200 Single Family
12 Residential District.
13 SECTION FIVE; That the area included in the above annexation is
14 hereby detached from County Service Areas No. 38 and 70, Improvement Zone
15 "A" of County Service Area 70 and County Service Area SL-1.
16 I HEREBY CERTIFY that the foregoing ordinance was duly adopted by
17 the Mayor and Common Council of the City of San Bernardino at a
