2 ~ ORDINANCE OF THE CTTY OF SAN BERNARDINO AMENDING ORDI-
NANCE N0. 2291 INTITLED IN PART, "AN ORDINANCE DECLARING
3 BUILDINGS WHICH ARE STRUCTURALLY UNSAFE OR HAZARDOUS TO THE PUB-
LIC SAFETY, HEALTH OR WELFARE TO BE PUBLIC NUISANCES
4 AND SETTING FORTH THE PRESENT LOCATION OF THE COUNCIL CHAMBERS
FOR NOTICE AND POSTING PURPOSES,
5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNAR-
6 DINO DO ORDAIN AS FOLLOWS:
7 SECTION 1, Ordinance No. 2291 Section Three is hereby
g amended to read as follows:
9 "Section Three: If the owner of the building or structur
10 does not comply with said notice by commencing the required work
11 within the time allowed or make such other arrangements as may
12 be satisfactory to the Building Official, the Building Official
13 shall thereupon serve personally or by certified mail as pro-
14 vided above a notice substantially in the following form upon
15 the owner and a copy to any lien, mortgage or trust deed holder
16 or lessee as may appear from a title search obtained from a title
17 company; and the cost of said title search shall be charged to
18 the owner in the same manner and using the same procedure as all .
19 other costs incurred by the City which are to be charged to the
20 owner as set forth in Section Seven of this ordinance.

nance No. 2291.

SECTION 2. Ordinance No. 2291 Section Six is hereby
6
amended to read as follows:

"Section Six: In the event the nuisance is not abated
8
by the owner within the time prescribed, the Street Superin-
9
tendent is authorized to raze, demolish, and remove the building
10
i or to designate an independent contractor to raze, demolish, and
11
remove such building. The Street Superintendent shall keep an
12
itemized statement of the expenses involved in the razing, de-
13
molishing and removing of such building and relevant administra-
14
five, incidental and overhead expenses of the City including but
15
not limited to the costs of inspections of the property, a pre-
16
~I' liminary title search of the property and items of expense require
17
to prepare the matter for hearing, whether or not such hearing is
18
held. The Street Superintendent shall submit this itemized state-
19
ment to the City Clerk, who shall set a date for hearing on the
20
statement by the Council and shall mail a copy of the statement to
21
the person owning the land, and to any mortgagee or lien holder,
22
along with a notice of the time and place the statement shall be
23
submitted to the Common Council. The City Clerk shall post a
24
copy of the statement on or near the door of the Council Chambers,
25
City Hall, San Bernardino, at least five (5) days prior to such
26
submission.

If the order of the Board to reconstruct, repair, raze,
28
or demolish has not been complied with within the time set by
29
the Board, the materials of any such building or structure may be
30
sold after notice in any manner which the Street Superintendent
31
may determine to be reasonable; provided that any such sale shall
32
1 be fade upon condition that the wreckage and debris shall be
2 removed and the lot cleaned. Any monies or proceeds from the
3 sale of such building or structure and its materials shall first
4 be used to reduce the costs incurred by the City, including but
5 not limited to the costs of demolition, cleaning the site,
6 searching the title, and inspections and thereafter any surplus
7 monies shall be distributed to the parties lawfully entitled
8 thereto.

10 adopted by the Mayor and Common Council of the City of San
