ADMINISTRATION AND ENFORCEMENT OF j 31 SAID ORDINANCE RELATING TO ANIMALS AND FOWLS BY THE. DEPARTMENT OF ANIMAL AND PARKING CONTROL. 4~ I THE MAYOR AND COMMON COUNCIL OF THE CITY. OF SAN BERNARDINO 5~ DO ORDAIN AS FOLLOWS: l 61; SECTION 1. Ordinance No. 821 Section 520 is hereby amended 7! to read as follows: 8;1 "Section 520. That no license to own or harbor a dog, as 9y` herein provided, shall be issued except upon an application in 10~ writing to authorized employees. of said City setting forth the 11 name and address of the owner or possessor of the dog and a 12 brief description of the dog." 13 SECTION 2. Ordinance No. 821 Section 521 is hereby amended 14 to read as follows: 15 "Section 521. Authorized employees of said City, upon the 16 receipt of such .application and the license fee aforesaid, shall 17 issue and deliver to such owner or possessor a license certifying 1g the payment of the license .fee, and setting forth the name and 1g address of the applicant and a brief description of the dog, j 20 and the number allotted to such dog, and upon receipt of the. I 21 requisite fees, shall deliver to the applicant a tag which shall 22 set forth the. date of the license, and the number allotted to 23 such dog, which tag shall at all times be affixed to the collar, 24 harness or other article worn by such dog; provided, however, 25 that no license for a doq shall be issued. unless the owner shall 26 have paid the license fee required therefor and shall have 27 exhibited to authorized employees of said City a certificate. of 28 the vaccination of the dog signed by a duly licensed veterinarian." 29 SECTION 3. Ordinance No. 82I Section 522 is hereby amended 30 to read as follows: 31 "Section 522. Every dog found running at large for which a 32 III! ll!i license shall not have been issued, or which shall not bear a 2~~1 tag as herein provided, shall be impounded by authorized employee 3; of said City for a period of seventy-two (72) hours, and in the I 4'~~ event the. owner or possessor of such dog shall. not, on or before 5I the. expiration of said period, call for and claim said dog, and 6 pay the license fee therefor, obtain a tag therefor, and pay 7 the sum required by the schedule set forth in Section 530 of 8 this ordinance, said dog shall be disposed of by authorized 9 employees of said City." 10 SECTION 4. Ordinance No. 821 Section 524 is hereby amended 11 to read as follows: 12 "Section 524. Authorized employees of said City, the County 13 Health Officer and all peace officers shall have the right to 14 enter upon any private property for the purpose of ascertaining 15 whether any dog or dogs are kept or harbored in violation of 16 the provisions hereof, or whether any dog is afflicted with rabie 17 or hydrophobia." lg SECTION 5. Ordinance No. 821 Section 525 is hereby amended 19 to read as follows: 20 "Section 525. The Mayor and Common Council may by order 21 require the muzzling and vaccination, or either, of any dogs 22 owned or harbored within the City, and may specify the period 23 of time during which such dog shall be so muzzled, and any dogs 24 running at large which shall not be vaccinated, or which shall 25 not be muzzled, pursuant to such order, shall be forthwith put 26 to death by authorized employees of said City." 27 SECTION 6. Ordinance No. 821 Section 527 is hereby amended 2g to read as follows: 2g "Section 527. No person owning or having charge, custody, 30 control, or possession of any vicious or dangerous dog or animal 31 shall permit it to run at large, or to run loose or unrestrained 32 in the City of San Bernardino. The fact that said dog or animal - 2 - i l,! has bitten any person shall be prima facie evidence that it is a ~I 2~I vicious or dangerous animal. I I 31 Each person who owns or has charge, custody, control, or I 4'~ possession of a vicious or dangerous dog or animal shall. cause it 5'~` at all times to be .leashed, tied securely to a stationary object, 6 or confined with a fenced or enclosed area, provided that notice 7 in writing to this effect has first been mailed to said person 8 by the. authorized employees. of said City. After such notice, any 9 person who violates and is convicted under. the provisions of this 10 Section shall be punished by a fine of not less than Fifty ($50.00) 11 dollars not more than Five Hundred ($.500.00) dollars or by im- 12 prisonment of not .less than one day nor more than six months or by 13 both such fine .and imprisonment." 14 SECTION 7. Ordinance No. 821 Section 528 is hereby amended 15 to read as follows.: 16 "Section 528.
