ORDINANCE NO. 821; AND PROVIDING FOR EXCEPTIONS TO THE. TRESPASS
3 PROHIBITION RELATING TO VEHICLE PARKING FACILITIES, SHOPPING
CENTER PROPERTY AND OTHER PROPERTY OPEN TO THE PUBLIC.

j THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5' DO ORDAIN AS FOLLOWS:
6. SECTION 1. Ordinance No. 821 Section 703 is hereby amended
7 to read as follows:
8 "Section 703: (a) Any person, other than a public officer
9 or employee acting within the course and scope of his employment,
l0l who enters or remains upon any motor vehicle parking lot, motor
11~ vehicle parking structure or facility, 'Drive-In' property,
i
12 shopping center property or any other place or property open to
13 the public, without the implied or express consent of the owner,
14 his agent or person in lawful possession thereof, or with the
15 knowledge that such consent has been withdrawn, is guilty of a
1 16 misdemeanor.
17 (b) Exceptions. This section shall not apply in any of
I8 the following instances: (1) where its application is
19 directly related to an act prohibited by the Unruh Civil
20 Rights Act or other law relating to prohibited discrimination
' 21 against any person on account of sex, color, race, religion,
22 creed, ancestry or national origin; (2) where its application
23 involves or is directly related to an act prohibited by Section
24 365 of the Penal Code or other law relating to the duties of
25 innkeepers or common carriers; or (3) where the property
26 described in subsection (a) hereof is owned, leased or operated
27 by the City of San Bernardino or any other public entity and is
28 open to the public and the application of this section
29 would result in an interference with or inhibition of the
30 exercise of a constitutionally protected right of freedom
31 of speech, provided the exercise of such right does not
32 involve prohibited conduct, including but not limited to con-

11 duct prohibited by Section 647 (2) or Section 415 of the Penal

21 Code or any law or ordinance relating to the obstruction of any
3'~, street, sidewalk or other public place or place open to the
41, public."
