2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT N0, 286 (LAFC 1214).

4 WHEREAS, heretofore, proceedings were initiated by the Common
5 Council of the City of San Bernardino, on its own motion, to annex to the
6 City of San Bernardino certain contiguous uninhabited territory hereinafter
7 described; and
8 WHEREAS, on the 20th day of November, 1972, a resolution was adopted
9 by the aforesaid Common Council of the City of San Bernardino, California,
10 declaring that proceedings had been initiated by said Council, and proposing

l 11 the annexation, for the reasons therein stated, of the aforementioned
12 uninhabited territory to the City of San Bernardino, and that said resolution
13 'provided that the. proposed annexation should be generally known and identified
14 as Annexation District No, 286; and
15 WHEREAS, said resolution set forth therein that all the property
16 included in the aforesaid territory should be taxed equally with the other
17 property within the City to pay the bonded indebtedness and any and all general
1$ indebtedness and liability of the City of San Bernardino contracted prior to
19 or existing or outstanding at the time of the aforesaid proposed annexation
20 of the aforesaid property as provided in the hereinbefore mentioned Government
21 Code; and

22 WHEREAS, said resolution did fix, determine and declare that a
23 hearing be held on the 15th day of January , 1973, at the hour of 9:30 o'clock
24 A, M., in the Council Chambers of the City Hall, 300 North "D" Street, San
25 Bernardino, California, and the same was the day, hour and place designated
26 where any person owning real estate within such territory so proposed to be
27 annexed and having any objections to the proposed annexation, might object
28 (before the Common Council and show cause why such territory should not be
29 iannexed; furthermore, the said resolution provided that at any time not later
30 than the said hour set, as mentioned hereinbefore for the said hearing, any
31 owner of property within the said territory proposed to be annexed might file
32 written protest with the City of San Bernardino against such annexation; and
1 WHEREAS, there were 'f"~ written protests filed with the City Clerk
2 of the City of San Bernardino prior to 9:30 o'clock A. M., on January 15, 1973;
3 and thereafter, on the /~~.day of ~ 1973, Resolution No.//
4 was adopted by the Mayor and Common Council decYaring that a majority protest
5 has not been presented; and
6 WHEREAS, it appears to the Common Council of the City of San
7 Bernardino that the aforesaid annexation proceedings have been completed and
8 everything performed at this time in accordance with said Government Code, as
9 mentioned hereinbefore, and any and all other laws in any way connected with
10 the said annexation procedure having been complied with; and
11 WHEREAS, the Common Council of the City of San Bernardino desires to
12 approve at this time the annexation of the aforesaid territory.
13 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
14 BERNARDINO DO ORDAIN AS FOLLOWS:
15 SECTION ONE: That said territory herein deshribed as Annexation
16 District No. 286 is hereby annexed and incorporated in and made a part of the
17 City of San Bernardino.
18 SECTION TWO: The territory herein referred to as being annexed to
19 the City of San Bernardino is particularly described as follows: to wit:
20 That portion of Lot 6, Block 13, ORANGE GROVE TRACT, as per
plat recorded in Book 11 of Maps, page 14, records of the
21 County Recorder of San Bernardino County, State of California
and those portions of the adjoining streets, described as
22 follows:
23 Beginning at a point on the Present Corporate Limits of the
City of San Bernardino, said point being the intersection of
24 the centerlines of Date Street and Del Rosa Avenue; thence
South along said centerline of Del Rosa Avenue, a distance of
25 214 feet more or less to the Easterly Prolongation of the
South line of that certain property described in the deed to
26 Gabriel Barnett et~ux recorded April 4, 1958, Document No. 100,
page 230 in Official Records of said County; thence west along
27 said Easterly prolongation and South line of said Barnett
property a distance of 291 feet more or less to the Southwest
28 corner thereof, said point being the Southeast corner of that
certain parcel described in the deed to Russell I. Newberg
29 et~ux by deed recorded August 22, 1958, Document No. 298 in
Book 4585, Page 341 Official Records of said County; thence
30 ~ North along the East line of said property and the Northerly
prolongation thereof a distance of 214 feet more or less to
31 said centerline of Date Street said centerline being also the
corporate limit line of said City; thence East along said
32 centerline and said City limit line, a distance of 291 feet

1 more or less to the Point of Beginning.
(Containing approximately 1.45 acres)

SECTION THREE: That the above described property will be subject
3
to taxation equally with the property within such municipal corporation to
4
pay its proportion of the following bonded indebtedness of the City of San
5
Bernardino, which said bonded indebtedness was outstanding or theretofore
6
authorized and is outstanding at the time of said annexation, to wit:
7
A bonded indebtedness of $490,000.00 incurred for the acquisition
8
and construction of a public library, including additions to and enlargements
9
of the public library system of said City, the outstanding indebtedness
10
thereon being $180,000.00, bearing interest at the rates of 4-3/4%, 3-1/4%,
11
and 3»1/2% per annum;
12
A bonded indebtedness of $1,116,000.00 incurred for the acquisg ion
13
and construction of additions to, relocations of and replacements of the fire
14
fighting system of said City, the outstanding indebtedness thereon being
15
$665,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2%
16
per annum.

SECTION FOUR: The property herein annexed is declared to be a part
18
of Ward 7 and the boundaries of Ward 7 are hereby altered to include said
19
annexed territory, with zoning to be in the C-3A Limited General Commercial
20
District.

SECTION FIVE: That the area included in the above annexation is
22
hereby detached from County Service Areas No. 38 and 70, Improvement Zone
23
"A" of County Service Area 70 and County Service Area SL-1.

I HEREBY CERTIFY that the foregoing ordinance was duly adopted by
25
the Mayor and Common Council of the City of San Bernardino at
26
