2 ORDINANCE OF THE CITY OF SAN BERN INO AMENDING ORDINANCE
NO. 821 AND PROVIDING FOR THE REGULATION OF WILD, EXOTIC OR NON-
3 DOMESTIC ANIMALS HELD IN CAPTIVITY.
4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
~ DO ORDAIN AS FOLLOWS:

6 SECTION 1. Section 505 is hereby added to Ordinance No. 82
7 to read as follows:
8 "Section 505. Non-Domestic Animals in Captivity. No
9 person, shall have, keep, maintain, breed, sell, trade or let for
10 hire any wild, exotic, dangerous or non-domestic animal without
11 first applying to and receiving special authorization from the
12 Animal and Parking Control Officer of the City of San Bernardino.
13 The keeping or maintenance of such animals shall also conform to
14 the applicable provisions of the. City's zoning ordinance, as well
15 as to any applicable laws promulgated by the State of California
16 and the Federal Government.
17 The Animal and Parking Control Officer may authorize the
18 keeping or maintaining of any wild, exotic, dangerous or non-
19 domestic animal when, in his sound discretion, such animal may be
20 kept or maintained without endangering the safety o£ any person,
21 property or other animal, nor create a nuisance, provided, however,
22 that the Animal and Parking Control Officer may require any .such
23 animal to be properly caged, tethered, or restrained, and that he
24 may create such additional requirements as may be necessary and
25 proper to ensure the protection of life and property. Any person
26 owning or keeping a privately owned wild, exotic, dangerous or
27 non-domestic animal, including but not limited to, birds (pred-
28 ators and scavengers), primates, cats (other than house cats),
29 reptiles, aquatic animals (carnivore), and varmints, shall pay an
30 annual license fee of five dollars ($5.00), payable in advance at
31 the time of filing an application. Any person owning or keeping
32 multiple animals of the same species shall pay a single fee except
1 that more than three of said animals of the same species shall be
2 deemed to be a menagerie and shall be licensed under Section 507
3 of this ordinance.
4 Any license issued under this section shall expire at the
5 end of the fiscal year in which said license is issued. The pro-
g cedure for the renewal of such license is subject to the same
7 conditions as are applicable to the original license. The Animal
g and Parking Control Officer may revoke his special authorization
g and any license issued pursuant to this section, whenever he shall
10 determine that any licensee has failed to meet the conditions pre-
11 scribed in this ordinance. Such revocation shall be effective
12 until the licensee has complied with the provisions of this
13 ordinance, to the satisfaction of the Animal and Parking Control
14 Officer whereupon said officer shall issue a Notice of Compliance
15 and the license shall be deemed reinstated }for the remainder of
16 the original term for which it was issued.
17 The Animal and Parking Control Officer is privileged to
lg make reasonable entry upon any premises to enforce the provisions
lg of this ordinance.
20 The special authorization of the Animal and Parking Control
21 Officer together with any license issued pursuant to this section
22 shall not be transferable."
23 SECTION 2. Section 506. is hereby added to Ordinance
24 No. 821 to read as follows:
25 "Section 506. Vaccination Against Disease. Any person,
26 firm, corporation or other business enterprise seeking special
27 authorization from the Animal and Parking Control Officer pursuant
28 to the provision of Section 505, shall cause such wild, exotic,
29 dangerous or non-domestic animal to be vaccinated against any
30 disease peculiar to its species by a veterinarian duly licensed
31 by the State of California.
32 Upon vaccinating any animal pursuant to this section, the

1 veterinarian shall issue a certificate of vaccination, setting
2 forth the date of vaccination, the vaccine(s) used, the dosage(s),
3 the expiration date, and any other information which he deems
4 relevant. The. certificate of vaccination as prescribed by this
5 section shall be a condition precedent to receiving special
6 authorization as provided in Section 505.
7 Any person, firm, corporation or other business enterprise
8 who fails to comply with the provisions of this ordinance, or who
9 fails to have in his or its possession a current and valid cer-
10 tificate of vaccination, shall be guilty of a misdemeanor."
11 SECTION 3. Section 507 is hereby added to Ordinance No. 821
12 to read as follows:
13 "Section 507. General Regulations Relating to Animals.
14 Every person, firm, corporation or other business enterprise with-
15 in the City of San Bernardino who owns, conducts, manages, or
16 operates any animal establishment for which special authorization
17 and a license is required by this ordinance shall comply with each
18 of the following conditions:
19 (a) In lieu of the fee set forth in section 505 of this
20 ordinance the following fee schedule is established for the above:)

27 (b) Housing facilities for animals shall be structurally
28 sound and shall be maintained in good repair to protect animals
29 from injury and restrict entrance of other animals.
30 (c) All animals and all animal buildings or enclosures
31 shall be maintained in a clean and sanitary condition.
32 (d) All animals shall be .supplied with sufficient good

1 wholesome food and water as often as the feeding habits of the
2 respective animals require.
3 (e) Animal buildings and enclosures shall be so constructe
4 and maintained as to prevent the. escape of animals.
5'~ (f) All reasonable precautions shall be taken to protect

g~ the public from the animals and animals from the public.
7 (g) Every building or enclosure wherein animals are main-
g tained shall be properly ventilated to prevent drafts and to re-
9 move odors. Heating and cooling shall be provided as required
10 according to physical needs of the animals.
11 (h) All animal rooms, cages, and runs shall be of suffi-
12 cient size to provide adequate. and proper housing for animals
13i kept therein.
14 All animal runs shall be of approved construction and
15 shall be provided with adequate. waste and manure disposal and for
16 drainage into an approved sewer or individual sewer disposal in-
17 stallation.
lgi (j) All animals shall be taken to a licensed veterinarian
19 for examination and treatment if so ordered by the Animal and
20 Parking Control Officer.
21 (k) Every precaution shall be taken to avoid the produc-
22 tion of nuisances and any hazard to the public health as a result
23~ of the presence of these wild, dangerous and/or exotic animals. 1
24 (1) Every violation of applicable regulation shall be ~
25 corrected within a reasonable time to be specified by the Animal
26 and Parking Control Officer.
27 (m) Failure of the applicant for said license to comply ~
2g with any of the foregoing conditions shall be deemed just cause
29 for the denial of any license, whether original or renewal."
30 SECTION 4. This ordinance shall become effective on the
31 1st day of July, 1973.
