HomeMy WebLinkAbout3345 1 ORDINANCE NO 2 ORDINANCE OF THE CITY OF SAN BERNARDINOAMENDING ORDINANCE N0. 2370 ENTITLED IN PART "AN ORDINANCE CREATING A BOARD OF 3 POLICE COMMISSIONERS AUTHORIZING SAID BOARD TO MAKE RECOMMENDATIONS TO THE CITY COUNCIL; AND EMPOWERING THE BOARD 4 TO CONDUCT HEARINGS RELATING TO COMPLAINTS AGAINST MEMBERS OF THE POLICE DEPARTMENT UPON THE REQUEST OF THE CHIEF OR COUNCIL. 5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 6 DO ORDAIN AS FOLLOWS: 7 SECTION 1. Ordinance No. 2370 Section Four is hereby g amended to read as follows: 9 "SECTION FOUR: POWERS. The Board shall have power: 10 (a) To prescribe such rules and regulations as it deems 11 necessary or expedient for the administration of its duties, 12 subject to approval by the Council, and to adopt as a part 13 of said rules the present Rules and Regulations of the Police De artment which ma be amended from time to time• 14 P s Y 15 (b) To investigate and to examine or inquire into the 16 affairs or operation of any division or section of the I 17 Police Department and to make such recommendations to the lg Chief or Council as may seem desirable; 19 (c) To keep informed as to the latest practices in the 20 field of law enforcement and to recommend to the Chief or 21 Council such practices as may appear to be beneficial to 22 the Police Department and to the public; 23 (d) To assist the Chief, upon his request, in matters 24 pertaining to appointments and promotions in the Police 25 Department; 26 (e) Upon request of the Chief or Council, to review 27 and to hear, and to summarily recommend to 28 . . . . 1 the Chief or Council appropriate action concerning, all 2 complaints of misconduct, inefficiency, violation of rules 3 or other charges against any officer, member, or employee 4 of the Police Department, except the Chief thereof, and to 9 recommend in writing to the Chief or Council such action 6 thereon as shall be most conducive to the maintenance, 7 discipline and efficiency of such Department, subject to g the Civil Service provisions of the Charter; provided that 9 all investigations or hearings shall be conducted in a fair 10 and impartial manner, that any recommended action shall not 11 be based solely upon hearsay evidence and that the Board 12 may require any and all complaints to be verified under 13 penalty of perjury; and 14 (f) To appear before and address the Council at any 15 meeting," 16 I HEREBY CERTIFY that the foregoing ordinance was duly 9 17 adopted by the Mayor and Common Council of the City of San Ber- 18 nardino at a meeting thereof, held on 19 the day of ~ , 1973, by the following 20 vote, to wit: 21 AYES : C ounc ilmen ~ d rn-.-T ~ ~ s ~ . f,-rn.~c T 22 ~ ~ NAYS : 23 1 24 ABSENT: ~-~r~x-~ c-~v~~~ ~~7-rzrnC-t-~'L > 25 ~ u~ ~lU. ~f£~z 26 City Cler 27 o o . 28 -2- 1 The foregoing ordinance is hereby approved this 2 day of ~,(yzc Q' , 1973. a or o~~ e i y o an Bernar ino 5 ~ 6 , Approved as to form: 7 ? g City A orney ~P) 10 11 12 13 14 15 16 17 I8 19 20 21 22 23 24 25 - 28 -3-
