""J-r'" - -- - ORDINANCE NO. 2 AN ORDINANCE OF THE MAYOR AND COMMJN COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 291 (LAFC 1329). 3 4 WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, t;l) lInnex to the 6 City of San Bernardino certain contiguous uninhabited territory hereinafter 7 described; and 8 WHEREAS, on the 16th day of April, 1973, a resolution was adopted 9 by the aforesaid Common Council of the City of San Bernardino, California, declaring that proceedings had been initiated by said Council, and proposing the annexation, for the reasons therein stated, of the aforementioned uninhabited territory to the City of San Bernardino, and that said resolution provided that the proposed annexation should be generally known and identified as Annexation District No. 291; and WHEREAS, said resolution set forth therein that all the property included in the aforesaid territory should be taxed equally with the other property within the City to pay the bonded indebtedness and any and all genera indebtedness and liability of the City of San Bernardino contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation of the aforesaid property as provided in the hereinbefore mentioned Government Code; and WHEREAS, said resolution did fix, determine and declare that a hearing be held on the 4th day of June, 1973, at the hour of 9:30 oJclock A. M., in the Council Chambers of the City Hall, 300 North ''D'' Street, San Bernardino, California, and the same was the day, hour and place designated where any person owning real estate within such territgry so proposed to be annexed and having any objections to the proposed annexation, might object before the Common Council and show cause why such territory should not be 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 annexed; furthermore, the said resolution provided that at any time not later 2 than the said hour set, as mentioned hereinbefore for the said hearing, any 3 owner of property within the said territory proposed to be annexed might file 4 written protest with the City of San Bernardino against such annexation; and 5 WHEREAS, there were)1.Cwritten protests filed with the City Clerk 6 of the City of San Bernardino prior to 9:30 oIclock A. M., on June 4, 1973; and thereafter on the -'kl day Of-)L!/~2. ~ 1973, Resolution No. II?'/ q was adopted by the Mayor and Common Council declaring that a majority protest 7 8 9 has not been presented; and WHEREAS, it appears to the Common Council of the City of San Bernardino that the aforesaid annexation proceedings have been completed and everything performed at this time in accordance with said Government Code, as mentioned hereinbefore, and any and all other laws in any way connected with the said annexation procedure having been complied with; and WHEREAS, the Common Council of the City of San Bernardino desires to approve at this time the annexation of the aforesaid territory. NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLWWS: SECTION ONE: That said territory herein described as Annexation District No. 291 is hereby annexed and incorporated in and made a part of the City of San Bernardino. SECTION TWO: The territory herein referred to as being annexed to the City of San Bernardino is particularly described as follows: to wit: Those portions of Lots I and 2, Block 3 of the Map of West Highlands as per plat thereof recorded in Book 5 of Maps, Page 77, records of the County Recorder of San Bernardino County, State of California; those portions of Lots 2 and 7, SHAY'S SUBDIVISION as per plat thereof recorded in Book 8 of Maps, Page 44, Records of said County Recorder, and those portions of adjoining streets described as follows: Beginning at a point on the Present Corporate Limits of the - 2 - .. 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 City of San Bernardino, said point being the intersection of the centerline of Highland Avenue and the Northerly prolongation of the East Line of said Lot 2, Block 3, Map of West Highlands; thence West along said centerline and said City Limit Line, a distance of 114 feet more or less to the Northwest corner of the property described in the deed to Charles Alfred Henley, et a1., recorded January 7, 1964, Document No. 290 in Book 6061, Page 93, Official Records of said County; thence South along the west line of said Henley Property, a distance of 518 feet more or less to the Southwest corner thereof; thence West and parallel with the North line of said Lots 1 and 2, Block 3, Map of West Highlands and the westerly prolongation there- of, a distance of 757 feet more or less to the centerline of Sterling Avenue; thence South along said centerline of Sterling Avenue, a distance of 863 feet more or less to the intersection of the westerly prolongation of the South line of that certain property conveyed in the deed to Hyland Gardens Apartments, a Limited Partnership Recorded March 5, 1965, Document No. 434 in Book 6344, Page 31, Official Records of said County; thence East along said Westerly prolongation and said South line of Hyland Gardens property, a distance of 1181.51 feet more or less to the Southeast corner thereof; thence North along the East line of said Hyland Gardens property, a distance of 383 feet more or less to the Northeast corner thereof, said Northeast corner being on the corporate limit line of said City; thence West along said City Limit Line, a distance of 310 feet more or less to an angle point therein; thence North along said City Limit line a distance of 998.55 feet more or less to the Point of Beginning. (Containing approximately 22.5 acres) SECTION THREE: That the above described property will be subject to taxation equally with the property within such municipal corporation to pay its proportion of the following bonded indebtedness of the City of San Bernardino, which said bonded indebtedness was outstanding or theretofore authorized and is outstanding at the time of said annexation, to wit: A bonded indebtedness of $490,000.00 incurred for the acquisition and construction of a public library, including additions to and enlargements of the public library system of said City, the outstanding indebtedness thereon being $180,000.00, bearing interest at the rates of 4-3/4%, 3-1/4%, and 3-1/2% per annum; A bonded indebtedness of $1,116,000.00 incurred for the acquisition and construction of additions to, relocations of and replacements of the fire - 3 - 1 fighting system of said City, the outstanding indebtedness thereon being 2 $655,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2% 3 per annum. , of Ward 7 and the boundaries of Ward 7 are hereby altered to include said SECTION FOUR: The property herein annexed is declared to be a part 4 6 annexed territory, with zoning classifications as follows: 20 21 22 23 24 25 26 27 28 7 8 9 10 11 12 13 14 15 16 17 18 19 R-3-2000 A portion of as follows: Multiple Family Residential Lots 2 and 7 Shay's Subdivision described Beginning on the northwest corner of Lot 7 Shay's Subdivision recorded in Map Book 8, page 44, Records of San Bernardino County; thence south 383 feet, more or less, to the southwest corner of Lot 7; thence east 1151.51 feet more or less to the west line of Lot 4, Tract No. 6969 extended south; thence north 383 feet to the north line of Shay's Subdivision, thence west 1181.51 feet, more or less, to point of beginning. Excluding any portion of strip known as Walnut Street vacated. Limited General Commercial District Lots 1 and 2, Block 3 West Highland's follows: C-3A Portions of described as Tract Beginning at the northwest corner of Lot 3; thence west 114 feet, more or less; thence south 518 feet, more or less; thence west 757 feet, more or less; thence south along the west line of Sterling Avenue 480 feet, more or less; thence east to west line Lot 3 extended south; thence north along the west line of Lot 3 to point of beginning. Including strip known as Walnut Street vacated.
