'_ U~ r~ 2 ORDINANCE OF THE CITY OF SAN BERNARDINO APPROVING AND ADOPTING THE REDEVELOPMENT PLAN FOR CENTRAL CITY NORTH. 3 4 WHEREAS, the Redevelopment Agency of the City of San 5 Bernardino, California, (hereinafter referred to as the "Agency"), 6 has formulated, prepared and duly adopted a Redevelopment Plan for the Central City North Project; and 7 8 WHEREAS, the Planning Commission of the City of San 9 Bernardino has submitted its report and recommendation, recommend- 10 ing approval of said Redevelopment Plan; and 11 12 WHEREAS, the Agency has adopted rules for owner participa- 13 tion and rules for reasonable preference for persons in business in the Project Area; and 14 WHEREAS, the Agency has submitted to the Common Council of the City of San Bernardino said Redevelopment Plan, accompanied by 15 16 the Report of the Agency, as required by Section 33352 of the California Health and Safety Code; and 17 18 WHEREAS, this Common council considered and prescribed 19 certain covenants, conditions and restrictions for said Redevelop- 20 ment Plan, as set forth in Addenda to said Plan, pursuant to 21 section 33338 of the California Health and Safety Code; and 22 WHEREAS, all action required by law has been taken by all 23 appropriate public agencies; and WHEREAS, after due notice, public hearings have been held 24 25 by the Agency and this Common Council; and WHEREAS, at said public hearings the Agency and the Common 26 27 Council did consider all matters required by law; 28 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY I 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 OF SAN BERNARDINO no ORDAIN AS FOLLOWS: 2 SECTION 1. The legal description of the boundaries of the Project Area covered by the Central City North Project, Redevelop ment Plan is as follows: 3 4 5 Those portions of Blocks 19, 20, 25, 26, 27, 28, 29,30,35,36,37,38,39,40,41,42,43,44,45, 46, 51, 52, 53, 54 and 55 of the City of San Bernardino, County of San Bernardino, State of California, as per map recorded in Book 7 of Maps, Pagel; and Norton and Hay Subdivision as per map recorded in Book 16 of Maps, Page 7; and Sub of Block 55, City of San Bernardino; as per map recorded in Book 3 of Maps, Page 30; and Porter's Subdivision as per map recorded in Book 2 of Maps, Page 26; and J. S. Bright Subdivision as per map recorded in Book 4 of Maps, Page 4; and Bennetts Subdivision as per Map recorded in Book 3 of Maps, Page 15; and Ward and Courtney Subdivision as per map recorded in Book 3 of Maps, Page 25; and Kingman - Hampson Subdivision as per map recorded in Book 30f Maps, Page 81, records of said County described as follows: 6 7 8 9 Beginning at the intersection of the easterly prolongation of the north line of Court Street, 82.50 feet wide and the east line of Arrowhead Avenue 82.50 feet wide; thence west along said easterly prolongation and the north line of said Court Street to the east line of "n" Street, 82.50 feet wide; thence westerly in a straight line to the northwest corner of "n" Street and Court Street, 56.16 feet wide; thence west along the north line of Court Street to the east line of "E" Street 82.50 feet wide; thence north along the east line of said "E" Street to the northeast corner of said "E" street and Fourth Street, 82.50 feet wide; thence west along the north line of said Fourth Street to the west line of "H" Street; thence north along the west line of said "H" Street a distance of 48.00 feet to the Right of Way line of state Route VIII - 43 (Freeway U.S. 395); thence along said Right-of-Way line the following courses and distances; thence south 89034'17" west a distance of 251.15 feet; thence northerly along the arc of a curve concave northeasterly with a radius of 150.00 feet a distance of 83.37 feet; thence north 17015'04" west a distance of 170.43 feet to the south line of Kingman Street; thence north 07028'03" west a distance of 40.30 feet to the north line of said Kingman Street; thence north 0027'47" west a distance of 130.00 feet; thence northerly in a direct line to a point on the north line of Lot 41 of the Ward and Courtney Subdivision as per plat recorded in Book 3 of Maps, page 25, records of the County 2 10 11 12 13 14 1 Recorder of said County, said point being 370.00 feiet west of the east line of said "R" Street; thence north 0027'54" west a distance of 143.71 feet to the south line of Spruce Street, 50.00 feet wide; thence north 05043'35" east a distance of 173.52 feet to thei beginning of a tangent curve concave southeasterly and having a radius of 160.00 fee.t;. thence north- easterly along said curve thru a central angle of 79024'47" a distance of 221. 77 feet; thence north 85008'02" east a distance of 99.66 feet to the south line of Sixth Street 82.50 feet wide; thence east along the south line of said Sixth Street to the west line of said "R" Street; thence leaving said Right-of-Way line of Freeway U.S. 395 north along the west line of said "R" Street to the north line of said Sixth Street; thence west along the north line of said Sixth Street to the easterly Right-of- Way line of said U.S. 395; thence north along said easterly Right-of-Way line of U. The purposes and intent of the Common Council 15 with respect to the Project Area are to: 16 (a) Eliminate the conditions of blight existing in the 17 Project Area; 18 (b) Insure, as far as possible, thatthei causes of the 19 blighting conditions will be either eliminated or protected 20 against; 21 (c) Provide participation for owners and a reasonable 22 preference for persons engaged in business in the Project Area; 23 (d) Encourage and insure thei rehabilitation, rebuilding 24 and development of the Project Area; 25 (e) Encourage and foster the economic revitalization of 26 the Project Area; 27 (f) Relocate the owners and occupants of the Project 28 Area as needed; 3 1 (g) Redevelop and rebuild the public facilities in the 2 Project Area to provide safe and more efficient service for the 3 people in the area and the general public as a whole; and 4 (h) To provide for: 5 (1) Removal of structurally substandard buildings, 6 to permit the return of the Project Area land to economic use and 7 new construction. 8 (2) The elimination of environmental deficiencies, 9 including among others, small and irregular lot subdivision, in- 10 adequate street layout, overcrowding of the land, and unsightly II overhead utility lines. 12 (3) Removal of impediments to land disposition and 13 development through acquisition and/or assembly of land into 14 reasonably sized and shaped parcels served by an improved street 15 system and improved public utilities. 16 (4) Achievement of an environment reflecting a high 17 level of concern for architectural and urban design principles, 18 developed through encouragement, guidance, appropriate controls 19 and professional assistance to owner participants and redevelopers 20 (5) The provision of a number of housing units of low 21 or moderate cost on land to be disposed of for residential pur- 22 poses. 23 SECTION 3. The Redevelopment Plan, together with said 24 Addenda, for the Central City North Project hereby is incorporated 25 herein by reference and made a part hereof as fully as if it were 26 set out at length herein. 27 SECTION 4. Said Redevelopment Plan for the Central City 28 North Project hereby is approved and adopted and designated as 4 I 2 3 4 5 6 7 8 9 10 II 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 the Official Redevelopment Plan for the Central City North projec SECTION 5. The Common Council hereby finds and determines that: (a) The project Area isa blighted area, the redevelop- ment of which is necessary to effectuate the public purposes declared in the Community Redevelopment Law of the State of California; (b) Said Redevelopment Plan for the Central City North Project will redevelop the Project Area in conformity with the Community Redevelopment Law of the State of California and in the interests of the public peace, health, safety and welfare; (c) The adoption of carrying out of said Redevelopment Plan for the Central City North Project is economically sound and feasible; (d) Said Redevelopment Plan for the Central City North project conforms to the adopted General (Master) Plan of the City of San Bernardino; (e) The carrying out of said Redevelopment Plan for the Central City North Project will promote the public peace, health, safety and welfare of the City of San Bernardino, and will effectuate the purposes and policies of the Community Redevelop- ment Law of the State of California; (f) The condemnation of real property, as provided for in the Redevelopment Plan for the Project Area, is necessary to the execution of that Plan and adequate provisions have been made for payment for property to be acquired as provided by law; (g) The Agency has a feasible method and plan for the relocation of families and persons to be temporarily or per- 5 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 manently displaced from housing facilities in the Project Area; (h) There are or are being provided in the Project Area, or in other areas not generally less desirable in regard to public utilities and public and commercial facilities and at rents or prices within the financial means of the families and persons displaced from the Project Area, decent, safe, and sanitary dwellings equal in number to the number of and available to such displaced families and persons and reasonably accessible to their places of employment; (i) In order to implement and facilitate the effectuation of said Redevelopment Plan hereby approved and adopted, it is found and determined that certain official action must be taken by this Common Council with reference, among other things, .to changes in zoning, the opening, closing, abandoning, widening or changing the grade of streets, and other modification of street layouts and other public action, and accordingly, this Common Council hereby: (1) Pledges its cooperation in helping to carry out such Redevelopment Plan; (2) Requests the various officials, departments, boards and agencies of the City of San Bernardino having adminis- trative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner consistent with said Redevelopment Plan; and (3) Stands ready to consider and take appropriate action upon proposals and measures designed to effectuate said Redevelopment Plan. SECTION 6. This Common Council is satisfied permanent 6 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 housing facilities will be available within three years from the time occupants of the Project Area are displaced, and that pending the development of such facilities there will be available to such displaced occupants adequate temporary housing facilities at rents comparable to those in the City of San Bernardino at the time of their displacement. SECTION 7. All written and oral objections to said Redevelopment Plan hereby are overruled. SECTION 8. The City Clerk hereby is directed to send a certified copy of this Ordinance to the Agency', and the Agency hereby is vested with the responsibility for carrying out the Redevelopment Plan for the Central City North Project. SECTION 9. The City Clerk hereby is directed to record wi the County Recorder of San Bernardino County, California, a description of the land within the Project Area, and a statement that proceedings for the redevelopment of the Project Area have been instituted under the California Community Redevelopment Law. The Agency hereby is directed to effectuate recordation of a copy of said Redevelopment Plan in compliance with the provisions of Section 27295 of the Government Code to the extent applicable. SECTION 10. The Building Department of the City of San Bernardino hereby is directed for a period of two years after the effective date of this Ordinance to advise all applicants for building permits that the site for which a building permit is sought for the construction of buildings or for other improvements is within a redevelopment project area. SECTION 11. The City Clerk is directed to transmit a copy of this Ordinance and a map indicating the boundaries of the 7 1 Project Area to the Auditor and Tax Assessor of San Bernardino 2 County; to the officer or officers performing the function of 3 auditors or assessors for taxing agencies levying taxes through 4 the County of San Bernardino; to the governing body of each of 5 the taxing agencies which levies taxes upon any property in the 6 Project Area; and to the State Board of Equalization of Californi 7 SECTION 12. The City Clerk shall certify to the adoption 8 of this Ordinance, shall cause the same to be published for 9 three consecutive days in the Evening Telegram, a daily newspaper 10 published in the City of San Bernardino, California, and the same 11 shall go into effect and be in full force and operation from and 12 after thirty (30) days after its final passage and adoption. 13 I HEREBY CERTIFY that the foregoing Ordinance was duly 14 adopted by the Mayor and Common Council of the City of San 15 16 17 18 19 20 21 22 23 24 25 26 27 28 on the tn/Iv >1 > > .~. , ..
