PROVIDING FOR THE 3 PURCHASE AND SALE OF SUPPLIES, SERVICES AND EQUIPMENT"; AND PERMIT TING THE SALE OF SURPLUS PROPERTY TO BE RESTRICTED TO TAX EXEMPT 4 ORGANIZATIONS. 5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 6 7 8 9 SECTION 1. Ordinance No. 2588 Section Ten is hereby amended to read as follows: "Section Ten: Surplus supplies and equipment. (a) All 10 using agencies and departments shall submit to the Purchasing 11 Agent, at such times and in such form as he shall prescribe, re- 12 ports showing all supplies and equipment which are no longer used 13 or which may have become obsolete or worn out. The Purchasing 14 Agent shall have authority to sell all supplies and equipment whic 15 16 17 cannot be used by any agency or department, or which have become unsuitable for City use, or to exchange the same for, or trade-in the same on, new supplies and equipment. Such sales shall be made 18 to the highest and best bidder pursuant to Sections Seven or Eight 19 20 21 whichever is applicable, or shall be sold at public auction as hereinafter set forth. The Purchasing Agent, when directed by the Mayor and Common Council, shall restrict the sale of said surplus 22 23 supplies and equipment of a value in an amount of $2,000.00 or 24 less to local non profit tax exempt corporations, associations or organizations pursuant to section Eight hereof, or shall negotiate and consummate a sale to a governmental agency, including any 25 26 domestic or foreign sister city. 27 (b) Public auction. A notice describing the property in sufficient detail for its identification, shall be prepared by the 28 -1- ..--- I......... 1 City Administrator and shall be given at least five (5) days be- 2 fore the time fixed therefor by publication once in a newspaper of . general circulation published in the City of San Bernardino. (c) That city officers shall not be purchasers at any such 3 4 5 public auction authorized, conducted or administered by them in 6 their official capacity; nor shall any city officer or employee 7 directly or indirectly submit a bid at said auction if he has par- 8 ticipated in the preparation or conduct of said auction in his 9 official capacity. 10 (d) That said property so offered for sale shall be sold 11 to the highest bidder for cash, provided that the City Administra- 12 tor may, at his discretion, fix a minimum sale price and may re- 13 fuse to sell unless said minimum price is offered, and may further 14 refuse to sell unless a deposit of security is immediately made. 15 16 (e) That any property sold at said public auction shall be 17 delivered to the purchaser upon payment of the purchase price.
