V%;1 - c....- / AN ORDINANCE OF THE MAYOR AND CC>>MlN COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF :DISTRICT NO. 293 (LAFC 1381). WHEREAS, heretofore, proceedings were initiated by the Common Council of the City of San Bernardino, on its own motion, to annex to the Oity of San Bernardino certain contiguous uninhabited territ~ry hereinafter described; and WHEREAS, on the 15th day of October, 1973, a resolution was adopted by the aforesaid Common Council of the City of San Bernardino, California, declaring that proceedings had been initiated by said Council, and proposing the annexation, for the reasons therein stated, of the aforementioned uninhabited territory to the City of San Bernardino, and that said resolution provided that the proposed annexation should be generally known and identified as Annexation District No. 293; and WHEREAS, said resolution set forth therein that all the property included in the aforesaid territory should be taxed equally with the other property within the City to pay the bonded indebtedness and any and all general indebtedness and liability of the City of San Bernardino contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation of the aforesaid property as provided in the hereinbefore mentioned Government Code; and WHEREAS, said resolution did fix, determine and declare that a hearing be held on the 3rd day of December, 1973, at the hour of 9:30 o'clock A. M., in the Council Chambers of the City Hall, 300 North "D" Street, San Bernardino, California, and the same was the day, hour and place designated where any person owning real estate within such territory so proposed to be annexed and having any objections to the proposed annexation, might object before the Common Council and show cause why such territory should not be 22 1 annexed; furthermore, the said resolution provided that at any time not later 2 than the said hour set, as mentioned hereinbefore for the said hearing, any 3 owner of property within the said territory proposed to be annexed might file 4 written protest with the City of San Bernardino against such annexation; and 5 WHEREAS, a quorum of the Common Council was not present on the 3rd 6 day of December, 1973, said protest hearing was continued to December 10, 1973; 7 WHEREAS, there were ~written protests filed with the City Clerk 8 of the City of San Bernardino prior to 9:30 o'clock A. M. on December 10, 1973; theL!!alday of 41;onlL 7/1973, Resolution No. /i/c:L./ " Mayor and Common Council declaring that a majority protest 9 and thereafter, on 10 was adopted by the 11 has not been presented; and 12 WHEREAS, it appears to the Common Council of the City of San 13 Bernardino that the aforesaid annexation proceedings have been completed and 14 everything performed at this time in accordance with said Government Code, as 15 mentioned hereinbefore, and any and all other laws in any way connected with 16 the said annexation procedure having been complied with; and 17 WHEREAS, the Common Council of the City of San Bernardino desires to 18 approve at this time the annexation of the aforesaid territory. 19 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 20 21 SECTION ONE: That said territory herein described as Annexation District No. 293 is hereby annexed and incorporated in and made a part of the 23 City of San Bernardino. 24 SECTION TWO: The territory herein referred to as being annexed to 25 the City of San Bernardino is particularly described as follows: to wit: Those portions of Lots 1, 2, 3, 19 and 20, Block 50, Rancho San Bernardino, as per plat thereof recorded in Book 7 of Maps, Page 2, records of the County Recorder of San Bernardino County, State of California, and those portions of the adjoining streets described as follows: 26 27 28 - 2 - 1 Beginning at a point on the Present Corporate Limits of the City of San Bernardino, said point being the intersection of the centerlines on East Fifth Street and Sterling Avenue; thence leaving said City Limit Line, North along said center line of Sterling Avenue, a distance of 441.05 feet, more or less, to the intersection of the Easterly prolongation of the North line of that certain property as described in the deed to the United States of America, recorded as Document No. 26, June 16, 1950 in Book 2591, Page 449 Official Records of said County; thence west along said Easterly prolongation and the North line of said United States property, a distance of 249.95 feet more or less to the Northwest corner thereof; thence South along the West line of said United States property a distance of 208.70 feet, more or less, to the Southwest corner thereof, said point also being a point on the North line of that certain property as described in the deed to the United States of America, recorded as Document No. 29, June 16, 1950 in Book 2591, Page 455, Official Records of said County; thence West along said last mentioned North line of said United States property, a distance of 419.41 feet, more or less, to the Northwest corner thereof, said point also being a point on the East line of that certain property as described in the deed to James P. Powers and Anna Lorraine Powers, husband and wife, recorded as Document No. 42, April 22, 1971 in Book 7651, Page 873 Official Records of said County; thence South along said East line of Powers property and its Southerly prolongation, a distance of 232;35 feet, more or less, to the centerline of said East Fifth Street; thence West along the centerline of said East Fifth Street, a distance of 650 feet more or less to the intersection of the Northerly prolongation of the East line of Tract No. 3082 as per plat thereof recorded in Book 42 of Maps, Page 36, Records of said County; thence South along said Northerly prolongation and the East line of said Tract No. 3082 and continuing South along the East line of Tract No. 3008 as per plat thereof recorded in Book 40 of Maps, Page 93, records of said County and its Southerly prolongation, a distance of 1240 feet more or less to the South line of Third Street, and being also said City Limit Line, thence Northeasterly and Easterly along said City Limit Line and said South line of Third Street, a distance of 1510 feet more or less to an angle point in said City Limit Line, said point also being the intersection of the centerline of Sterling Avenue and the South line of said Third Street; thence North along said City Limit Line and said centerline of Sterling Avenue, a distance of 600 feet more or less to the Point of Beginning. (Containing approximately 33.12 acres) 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 SECTION THREE: That the above described property will be subject 26 to taxation equally with the property within such municipal corporation to 27 pay its proportion of the following bonded indebtedness of the City of San 28 Bernardino, which said bonded indebtedness was outstanding or theretofore - 3 - 1 authorized and is outstanding at the time of said annexation, to wit: 2 A bonded indebtedness of $490,000.00 incurred for the acquisition 3 and construction of a public library, including additions to and enlargements 4 of the public library system of said City, the outstanding indebtedness 5 thereon being $150,000.00, bearing interest at the rates of 4-3/4%, 3-1/4%, 6 and 3- 1/2% per annum; 7 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 8 and construction of additions to, relocations of and replacements of the fire 10 $600,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2% 9 fighting system of said City, the outstanding indebtedness thereon being 11 per annum. 12 SECTION FOUR: The property herein annexed is declared to be a part 13 of Ward 3 and the boundaries of Ward 3 are hereby altered to include said 1~ annexed territory, with zoning classifications as shown on Map titled Exhibit 15 "A" and described as follows: 16 "0" Open District: 17 The following described property lying in Lots 2 and 3, Block 50, Rancho San Bernardino: 18 19 20 21 22 23 24 25 26 27 28 Beginning at a point 535' more or less South of Fifth Street and 255' more or less West of the East line of said Lot 3; thence Southeasterly 780 a distance of 250' more or less; thence Southeasterly 840 a distance of 118' more or less; thence Southeasterly 890 a distance of 95' more or less; thence Southeasterly 530 a distance of 15' more or less; thence East a distance of 195' more or less; thence South 82.62'; thence West a distance of 645' more or less; thence North 163' more or less to the Point of Beginning. M-l Light Industrial District: The following described property lying in Lots 2, 19 and 20, Block 50, Rancho San Bernardino: Parcell: Beginning at a point in Lot 20, said point being the Northwest corner of East Fifth Street and Sterling Avenue; thence West 623' more or less; thence North 192.35' more or less; thence - 4 - t I I " i: 11 12 13 14 15 16 I 17 20 21 22 23 24 25 26 27 28 1 East 419.41' more or less; thence North 208.79' more or less; thence East 204.95' more or less; thence South 401.05' more or less to the point of beginning. 2 3 Parcel 2: 4 Beginning at a point in the South line of East Fifth Street, said point being the Northeast corner of Lot 1, Tract 3082, thence East, South and Southwesterly along the South line of Fifth Street, the West line of Sterling Avenue and the North line of East 3rd Street to a point in the North line of East Third Street, said point being the Southeast corner of Lot 137, Tract 3008; thence North 395' more or less; thence East 650' more or less; thence North 82.62'; thence West 195' more or less; thence NorthweaCerly 530 a distance of 15' more or less; thence Northwesterly 890 a distance of 95' more or less; thence Northwesterly 840 a distance of 118' more or less; thence Northwesterly 780 a distance of 250' more or less; thence North a distance of 540' more or less to the Point of Beginning. 5 6 7 8 9 10 SECTION FIVE: That the area included in the above annexation is hereby detached from County Service Areas No. 38 and 70, Improvement Zone "A" of County Service Area InO, and County Service Area SL-l.
