HomeMy WebLinkAbout3395 1 ORDINANCE NO.~~ ! 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE NO. 2022 ENTITLED IN PART "AN ORDINANCE DEFINING NUISANCES. . ."; 3 AND PROVIDING THAT APPROPRIATE NOTICES MAY BE MAILED AS AN ALTERNATIVE TO POSTING SAID NOTICE BY THE FIRE DEPARTMENT. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 5 DO ORDAIN AS FOLLOWS: 6 SECTION 1. Ordinance No. 2022 Section Five is hereby 7 amended to read as follows: 8 "Section Five: After the passage of said resolution the 10 front of the property on which, or in front of which said 9 Chief Engineer shall cause to be conspicuously posted on or in 11 nuisance exists, 'NOTICE TO CLEAN PREMISES'. Said title shall be 12 in words not less than one inch in height, and the contents of 13 said notice shall be in substantially the following form: 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 'NOTICE IS HEREBY GIVEN that on th~ day of , 19____, the Council of the City of San Bernardino passed a resolution declaring that weeds, dry grass, dead trees, tin cans, abandoned asphalt or concrete, rubbish, refuse, or waste materials of any kind, were upon or in front of property in the City of San Bernardino, and more particularly described in said resolution, and that the same constitutes a public nuisance which must be abated by the removal of said nuisance; othen.ise, it will be removed and the nuisances will be abated by the municipal authorities, in which case the cost of such removal shall be assessed upon the lots and lands from which or in front of which said nuisance is removed, and such costs will constitute a lien upon such lots or land until paid. Reference is hereby made to Resolution No. for further particulars. All property owners having any objections to the proposed - 1 removal of said nuisance and the abatement of said nuisance may 2 make and file written protests at any time not later than the 3 hour set for hearing, to be held on the day of , 4 19 , at P.M., in the Council Chambers in the City Hall, 5 San Bernardino, California, at which time and place their 6 objections will be heard and given due consideration. 7 Dated: , 19 8 As an alternative to posting the notice in the manner and 9 form required in this section, such notice may be mailed to the 10 property owners as their names and addresses appear from the last 11 equalized assessment roll of the County of San Bernardino, or as 12 they may be known to the Chief Engineer." 13 SECTION 2. It is hereby found and declared that this is 14 an ordinance for the immediate preservation of the public peace, 15 health, safety and welfare of said City and the inhabitants 16 thereof, and that this is an emergency measure due to the expected 17 stringent federally imposed restrictions in an effort to conserve 18 fuel, and in response to the request to take every feasible action 19 to eliminate all non-essential use of motor vehicles during the 20 energy crisis, the passage of this ordinance is an emergency 21 matter. 22 SECTION 3.
