HomeMy WebLinkAbout3399 11 21 22 23 1 ORDINANCE NO. -)-=7 """' , 2 AN ORDINANCE OF THE MAYOR AND COMMON CO CIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEltATION OF DISTRICT NO. 296 (LAFC 1410). 3 4 WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, to annex to the 6 City of San Bernardino certain contiguous uninhabited territory hereinafter 7 described; and 8 WHEREAS, on the 10th day of December, 1973, a resolution was adopted 9 by the aforesaid Common Council of the City of San Bernardino, California, 10 declaring that proceedings had been initiated by said Council, and proposing the annexation, for the reasons therein stated, of the aforementioned 12 uninhabited territory to the City of San Bernardino, and that said resolution 13 provided that the proposed annexation should be generally known and identified 14 as Annexation District No. 296; and 15 WHEREAS, said resolution set forth therein that all the property 16 included in the aforesaid territory should be taxed equally with the other 17 property within the City to pay the bonded indebtedness and any and all general 18 indebtedness and liability of the City of San Bernardino contracted prior to 19 or existing or outstanding at the time of the aforesaid proposed annexation 20 of the aforesaid property as provided in the hereinbefore mentioned Government Code; and WHEREAS, said resolution did fix, determine and declare that a hearing be held on the 21st day of January, 1974, at the hour of 9:30 o'clock 24 A. M., in the Council Chambers of the City Hall, 300 North "D" Street, San 25 Bernardino, California, and the same was the day, hour and place designated 26 where any person owning real estate within such territory so proposed to be 27 annexed and having any objections to the proposed annexation, might object 28 before the Common Council and show cause why such territory should not be ~ 1 annexed; furthermore, the said resolution provided that at any time not later 2 than the said hour set, as mentioned hereinbefore for the said hearing, any 3 owner of property within the said territory proposed to be annexed might file 4 written protest with the City of San Bernardino against such annexation; and WHEREAS, there were~4t9 written protests filed with the City Clerk 6 of the City of San Bernardino prior to 9:30 o'clock A. M. on January 21, 1974; r 7 and thereafter, on the~ay o~ ~_'I/A'A~A, 1974, Resolution No.i/.:;,(,/I ./ .j 7 8 was adopted by the Mayor and COIlllJlO Council}declaring that a majority protest 5 9 has not been presented; and 10 WHEREAS, it appears to the COllllJlon Council of the City of San 11 Bernardino that the aforesaid annexation proceedings have been completed and 12 everything performed at this time in accordance with said Government Code, as 13 mentioned hereinbefore, and any and all other laws in any way connected with 14 the said annexation procedure having been complied with; and 15 WHEREAS, the COllllJlon Council of the City of San Bernardino desires to 16 approve at this time the annexation of the aforesaid territory. 17 NOW. THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 18 BERNARDINO DO ORDAIN AS FOLLOWS: 19 SECTION ONE: That said territory herein described as Annexation 20 District No. 296 is hereby annexed and incorporated in and made a part of the 21 City of San Bernardino. SECTION TWO: The territory herein referred to as being annexed to 22 23 the City of San Bernardino is particularly described as follows; to wit: 26 Those portions of Sections 32 and 33, Township 1 North, Range 3 West, San Bernardino Base and Meridian; those portions of Tract 2006 as per plat thereof recorded in Book 29 of Maps, Page 9, records of the County Recorder San Bernardino County, State of California and those portions of the adjoining Streets, described as follows: 24 25 27 Beginning at a point on the Present Corporate Limit Line of the City of San Bernardino, said point being the intersection 28 - 2 - 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 of the center lines of Palm Avenue and Atlantic Avenue; thence East along said City Limit Line and the centerline of said Atlantic Avenue, a distance of 660 feet more or less to an angle point in said City Limit Line; thence North along said City Limit Line, a distance of 694 feet more or less to an angle point therein; thence East along said City Limit Line, a distance of 660 feet more or less to an angle point therein; thence South along said City Limit Line, a distance of 694 feet more or less to an angle point therein; said point also being on the centerline of said Atlantic Avenue; thence East along said City Limit Line and the centerline of Atlantic Avenue, a distance of 660 feet more or less to an angle point in said City Limit Line; thence leaving said City Limit Line and continuing East along said centerline of Atlantic Avenue, a distance of 2063 feet more or less to its intersection with the centerline of existing Boulder Avenue; thence South along said centerline of Boulder Avenue, a distance of 1324 feet, more or less, to its intersection with the centerline of Pacific Street; thence West along said centerline of Pacific Street, a distance of 4010 feet more or less to its inter- section with the centerline of said Palm Avenue; thence North along said centerline of Palm Avenue, a distance of 150 feet more or less to its intersection with the Easterly prolongation of the Northerly right of way line of the Atchison, Topeka and Santa Fe Railway Company's right of way; thence North- westerly along said Northerly line of said Right of Way, a distance of 655 feet more or less to the Southerly prolonga- tion of the West line of Lot 22 of said Tract No. 2006; thence North along the said Southerly prolongation, a distance of 65 feet, more or less, to the Southwest corner of said Lot 22; thence East and Southeast along the South line of Lots 22, 21, 20, 19, 18, 17 and 16 of said Tract No. 2006, a distance of 409 feet more or less to the Southeast corner of said Lot 16; thence North along the West line of Lot 14 of said Tract 2006, a distance of 98.84 feet more or less to the Northwest corner of said Lot 14; thence.East along the North line of said Lot 14 and its Easterly prolongation, a distance of 230 feet more or less to its intersection with the centerline of said Palm Avenue; thence North along said centerline of said Palm Avenue, a distance of 932 feet more or less to the Point of Beginning. (Containing approximately 141 acres) 2 3 4 5 6 7 8 9 SECTION THREE: That the above described property will be subject to taxation equally with the property within such municipal corporation to pay its proportion of the following bonded indebtedness of the City of San Bernardino, which said bonded indebtedness was outstanding or theretofore authorized and is outstanding at the time of said annexation, to wit: A bonded indebtedness of $490,000.00 incurred for the acquisition - 3 - 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 and construction of a public library, including additions to and enlargements 2 of the public library system of said City, the outstanding indebtedness 3 thereon being $150,000.00, bearing interest at the rates of 4-3/4%, 3-1/4%, 4 and 3-1/2% per annum; 5 A bonded indebtedness of $1,116,000.00 incurred for the acquisition 6 and construction of additions to, relocations of and replacements of the fire 7 fighting system of said City, the outstanding indebtedness thereon being 8 $600,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2% 9 per annum. 10 SECTION FOUR: The property herein annexed is declared to be a part 11 of Ward 4 and the boundaries of Ward 4 are hereby altered to include said 12 annexed territory, with zoning classifications as shown on Map titled Exhibit 13 "B" and described as follows: 14 M-1 - Light Industrial District: Portion NE 1/4, Sec 32, TIN, R3W, SBBM, and Lots 14 and 15, Tract 2006, Zirmnerman ADD. described as follows: beginning at intersection of east line of Cole Avenue and north line of AT & SF RR R/W, th southeasterly along N line of AT & SF RR R/W 625' + to west line of Palm Avenue (60' wide), th N along west line of Palm Avenue 108'+; th northwesterly 210'+ to a point on east line of Lot 16, Tr. 2006, that is 4.73' - N of southeast corner of said Lot 16, Tr. 2006, thence S 4.73' to SE cor of Lot 16, TR. 2006, th northwesteriy along south line of TR. 2006 to s/w Cor of Lot 22, Tr. 2006 (being east line of Cole Avenue) th south along southerly prolongation of W line of lot 22, Tr. 2006 (E line of Cole Avenue) 65'+ to POB.
