ORDINANCE OF THE CITY OF SAN
SALE OF MOTOR VEHICLE FUELS.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
4 DO ORDAIN AS FOLLOWS:

Section 1. Ordinance No. 821 Chapter 24 is hereby amended
6 by adding thereto Section 2435 to read as follows:

"SECTION 2435: Motor Fuels Sales; Signs
(a) Every person, firm, co-partnership, association, or
9 corporation offering for sale or selling any gasoline or other
10 motor vehicle fuel to the public from any place of business in
11 the City of San Bernardino shall post or display a sign which is
12 clearly visible from any street or highway adjacent to such place
13 of business, and which indicates the actual price per gallon,
14 including all taxes, at which his grade of gasoline or other
15 motor vehicle fuel is currently being offered for sale or sold.

(b) No person, firm, co-partnership, association, or
17 corporation shall advertise, either in connection with the sign
18 required hereunder or otherwise, any grade of gasoline or other
19 motor vehicle fuel, which is not immediately available for sale
20 to the public on the business premise.

(c) Any sign posted or displayed pursuant hereto shall
22 not be inconsistent with the provisions of Article 8 of Chapter
23 70f Division 8 (Sections 20880, et seq.) of the California
24 Business and Professions Code, and shall be in compliance with
25 the provisions of any City ordinance regulating size and con-
26 struction of signs."

Section 2. This ordinance is hereby declared an urgency
28 measure necessary for the immediate protection and preservation
I of the public peace, health, safety and welfare, in that the
2 apparent scarcity of supply of gasoline and other motor vehicle
3 fuels has resulted in widely divergent and rapidly fluctuating
4 prices betweeen service stations and even from day-to-day at the
5 same service station. Inability of the motoring public to deter-
6 mine the price of such commodities until they are at the pump has
7 resulted in aggravation and threats of violence. Immediate
8 passage of this ordinance is therefore necessary in order to
9 assure the health, safety, and welfare of the pUblic, including
personnel who dispense such commodities. Therefore, this

ordinance shall take effect immediately upon its adoption.
