PRESCRIBING RULES 3 AND REGULATIONS GOVERNING THE PLATTING AND SUBDIVIDING OF LAND . . ."; AND PROVIDING FOR THE CONVERSION OF MOBILEHOME PARKS TO 4 MOBILEHOME SUBDIVISIONS. 5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 6 7 Section 1. SECTION SEVEN AND TWO-THIRDS is hereby added 8 9 to Ordinance No. 1984 to read as follows: "SECTION SEVEN AND TWO-THIRDS: MOBILEHOME SUBDIVISIONS 10 A. DESCRIPTION AND PURPOSE: This Section permits the 11 12 subdividing of land for the use of mobilehomes for residential purposes on individually owned lots within the proposed sub- 13 division provided the person or subdivider desiring to subdivide 14 the land shall first obtain a conditional development permit 15 pursuant to the provision of Ordinance No. 1991, known as the 16 "Land Use Zoning Ordinance", and provided the person or sub- 17 divider shall comply with the subdivision standards and procedures 18 of this Ordinance. 19 Existing mobilehomes or a mobilehome park shall not be 20 21 permitted to be converted to a mobilehome subdivision unless there is compliance with each of the following standards, conditions, and regulations. B. GENERAL USES PERMITTED: One mobilehome shall be 24 permitted for each lot. The minimum size of the mobilehome shall 25 be determined prior to the approval of the conditional develop- 26 ment permit application and said minimum size shall be recorded 27 as a part of the covenants and restrictions placed on the mobile- 28 home subdivision by the subdivider. 1 C. USES SPECIFICALLY PROHIBITED: No permanent residential 2 structures shall be permitted on any lot or parcel. 3 D. ACCESSORY USES AND STRUCTURES PERMITTED: A cabana, a 4 ramada, a porch, an awning, a patio slab, a garage, a carport, a 5 storage closet, a swimming pool, and similar uses shall be per- 6 mitted in the mobilehome subdivision. 7 E. PARKING AND STORAGE REQUIREMENTS: One covered parking 8 space shall be provided on the same site for each mobilehome. A 9 paved driveway area shall be provided from either a street or an 10 alley. 11 Not more than two individual storage cabinets may be 12 located or maintained on one mobilehome lot. Material that may 13 Icreate a fire hazard shall not be stored in a storage cabinet. A 14 storage cabinet may be located adjacent to a mobilehome or 15 mobilehome accessory building or structure, or beneath an awning 16 or carport provided that it does not obstruct openings for light 17 and ventilation of the mobilehome, 'o:r:tequired open space or 18 screening of mobilehome accessory building or structure, or pre- 19 vent inspection of mibilehome equipment and utility connections. 20 The maximum cabinet storage area shall not exceed one hundred 21 (100) square feet. 22 F. HEIGHT LIMITATIONS FOR MOBILEHOME: Maximum building 23 height shall be one-story not to exceed fifteen (15) feet. 24 G. MINIMUM LOT AREA REQUIRED: Each lot shall be at least 25 fifty (50) feet in width and shall have an area not less than 26 6000 square feet. The mobilehome together with accessory 27 structures shall not occupy more than forty percent (40%) of the 28 area of the lot. -2- 1 H. YARD REQUIREMENTS: 2 Front: Twenty-five (25) feet Rear: Ten (10) feet 3 4 Side: Five (5) feet 5 Street side on corner lot: Fifteen (15) feet 6 I: ii Ii requirements of Section 20.10 of Ordinance No. 1991. APPROVAL CONDITIONS: Other conditions of approval of i i I the site may be imposed as a part of the approval of the con- ditional development permit. 11 12 These conditions may include but 13 not be limited to: Requirement of a wall or fence around the 14 iperiphery of the development or individual lot; a review and 15 approval of the covenants and restrictions placed on the mobile- 16 home subdivision by the subdivider; screening of area between 17 ground level and the floor of the mobilehome by a masonry or 18 metal product. 19 K. MOBILEHOME REQUIREMENTS AND RESTRICTIONS: It is unlaw- 20 ful for any person in a mobilehome to use or cause or permit to be 21 used for occupancy: 22 1. Any mobilehome from which an axle or wheel hub has been 23 removed therefrom except for the purpose of making temporary 24 repairs. 25 2. Any mobilehome supplied with fuel, gas, water, 26 electricity, or sewage connections, unless such connections and 27 installations conform to regulations of the City of San Bernardino 28 3. Any mobilehome which is permanently attached with -3- 1 underpinning or foundation to the ground. 2 4. Any mobilehome which does not conform to the registra- 3 tion requirements of the vehicle code. 4 5. Any mobilehome in an unsanitary condition. 5 6. Any mobilehome which is structurally unsound and does 6 not protect its occupants against the elements. 7 7. Any mobilehome which the occupants use any water 8 heater, clothes washer, or clothes dryer, requiring plumbing, 9 mechanical, gas or electrical connections unless such appliance 10 is within the mobilehome or an approved building. No such 11 appliance outside the mobilehome shall be interconnected with the 12 plumbing, mechanical, gas or electrical system of the mobilehome. 13 8. Any mobilehome which does not have the space directly 14 beneath it kept clean and free from refuse, rubbish or other 15 impediments. Such space shall not be used for storage purposes. 16 9. Any mobilehome which does not have a current annual 17 vehicle license. 18 10. All mobilehomes which are sold or offered for sale 19 within this City shall bear insignia of approval issued by the 20 State Department of Housing and Community Development. 21 It is unlawful for any person to alter or convert, or 22 cause to be altered or converted, installations or equipment of a 23 mobilehome which bears a department insignia of approval, when 24 such mobilehome is used, occupied, sold, or offered for sale 25 within this state, unless performance is in compliance with the 26 regulations of the Department of Building and Safety. 27 L. PERMIT PROCEDURE: Any person who uses or permits to 28 be used a mobilehome for residential purposes in a mobilehome -4- 28 1 subdivision shall first obtain a permit issued by the Department 0 2 Building and Safety of the City of San Bernardino, authorizing 3 such person to occupy said mobilehome. Application forms for such 4 permit may be secured from the Department of Building and Safety. 5 A permit issued by the City Building Official must be prominently 6 displayed in such a manner as to be visible from the exterior of 7 the mobilehome. 8 M. INSPECTIONS: Upon receipt of the application filed 9 pursuant to this section and the payment of the fee herein 10 specified, the Department of Building and Safety shall cause to 11 be made an inspection of the premises and the mobilehome 12 installation, and if found to be in conformity with the require- 13 ments of this and other sections of the San Bernardino City Code, 14 the California Health and Safety Code, the Uniform Building Code, 15 the Uniform Plumbing Code, the Uniform Electrical Code, the 16 Uniform Heating Code, and the California Administrative Code Title 17 25, Chapter 5, pertaining to mobilehome parks and mobilehomes, and 18 any other applicable regulations, the permit shall be issued. 19 N.
