HomeMy WebLinkAbout3411 20 21 22 23 1 ORDINANCE NO. ,5/-// 2 ORDINANCE OF THE CITY OF SAN BERNARDINO CALLING A SPECIAL ELECTION TO BE HELD IN THE CITY OF SAN BERNARDINO ON TUESDAY, THE 4th DAY OF JUNE, 1974, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF SAID CITY FOR THEIR APPROVAL OR DISAPPROVAL I I I I I FOUR PROPOSED CHARTER AMENDMENTS TO THE CHARTER OF THE CITY RE- I LATING TO THE DATES FOR CONDUCTING MUNICIPAL ELECTIONS; THE SALARYI. OF THE MAYOR; THE PURCHASING OF MATERIALS, SUPPLIES AND EQUIPMENT; AND DEBT LIMITATIONS FOR THE BOARD OF WATER COMMISSIONERS. I I I I I 3 4 5 6 7 8 WHEREAS, the Mayor and Common Council of the City of San Bernardino desire to call a special municipal election for the 9 purpose of submitting the hereinafter proposed Charter amendments 10 to the qualified electors of the City of San Bernardino for their 11 12 13 14 15 SECTION 1. That a special municipal election is hereby 16 called and will be held in the City of San Bernardino on Tuesday, the 4th day of June, 1974, for the purpose of submitting to the 17 qualified electors of said City for their approval or disapproval, those certain Charter amendments as proposed and submitted by 18 19 the Mayor and Common Council by Resolution No. 11637, Resolution No. 11682, Resolution No. 11683, and Resolution No. 11684, which said resolutions were duly and regularly passed and approved by the Mayor and Common Council. SECTION 2. That said proposed Charter amendments will be 24 in the form as shown below in "Measures Submitted to Vote of 25 Voters.. Said election and the voting thereat shall be by ballot. 26 Said ballots shall be prepared, printed and distributed as pre- 27 scribed by law. Each ballot used at said election shall have 28 printed thereon, in addition to any other matter required by law, 1 the following: 2 MEASURES SUBMITTED TO 3 VOTE OF THE VOTERS 4 5 PROPOSED CHARTER AMENDMENT NO.1: Shall Article II, Section 10, 13 and 14 of the 6 Charter of the City of San Bernardino be amended as set forth in City Resolution 7 No. 11637 providing for the dates of municipal elections and terms of elective 8 offices. 9 PROPOSED CHARTER AMENDMENT NO.2: Shall 10 Article II, Section 24 of the Charter of the City of San Bernardino be amended as 11 set forth in City Resolution No. 11682 providing that the office of Mayor be a 12 full time position and the salary be set by the Common Council. 13 14 PROPOSED CHARTER AMENDMENT NO.3: Shall Article VIII, Section 163 of the Charter 15 of the City of San Bernardino be amended as set forth in City Resolution No. 11683 16 providing the Board of Water Commissioners may incur indebtedness not exceeding the 17 income provided for the year. NO : . 18 19 PROPOSED CHARTER AMENDMENT NO.4: Shall Article VIII, Section 140 of the Charter of the City of San Bernardino be amended as set forth in City Resolution No. 11684 providing that purchases of supplies ex- ceeding $3000 be made by competitive bidding. : YES 20 21 22 : NO 23 SECTION 3. To vote for the Charter amendment~ the qualifie 24 elector or voter may punch the ballot card in the hole after the 25 word "YES", to the right of the description of said amendments. 26 If the voter punches the ballot card in the hole after the word 27 "YES" his vote shall be counted in favor of the adoption of the 28 measure. -2-- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 To vote against the Charter amendments, the qualified elector or voter may punch the ballot card to the right after the word "NO", to the right of the description of said amendments. If a voter punches a ballot card in the hole after the printed word "NO", his vote shall be counted against the adoption of the measure. All distinguishing marks or erasures are forbidden and shall make the ballot void. If a voter wrongly punches, tears or defaces the ballot, he may return it to the inspector of the election and obtain another ballot. SECTION 4. That said special municipal election be and the same is hereby consolidated with the statewide direct primary election to be held on Tuesday, the 4th day of June, 1974, and the election precincts, polling places, voting booths and electio offices for said election shall be the same election precincts, polling places, voting booths and election offices for this special municipal election; and the proposed amendments herein- above submitted shall be printed upon the same ballot used in said statewide primary election. SECTION 5. That within the time prescribed by the Consti- tution of the State of California, the entire proposed amendments shall be published once in the San Bernardino Sun Telegram, being a newspaper of general circulation, printed, published and circu- lated in said city. In addition, and pursuant to the provisions of said State Constitution, copies of said proposed Charter amendments shall be printed in pamphlet form, and mailed to each of the qualified electors of said City, and a notice shall be published in the aforesaid newspaper as required by said Consti- -3- 10 3 cation therefor. 4 SECTION 6. The passage of this ordinance is an emergency 5 matter relating to elections and said ordinance shall be in force 6 and take full effect immediately after its passage and approval. 7 I HEREBY CERTIFY that the foregoing ordinance was duly 8 adopted by the Mayor and Common Council of the City of San Bernar- 9 dino at a '~Nj~ of.
