ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE
NO. 821 SECTION 2435 RELATING TO GASOLINE PRICE SIGNS; AND PRO-
VIDING THAT SAID SIGNS SHALL BE VISIBLE FROM THE ENTRANCES TO
GASOLINE SERVICE STATIONS AND THAT SUCH PORTABLE SIGNS SHALL NOT
BE' 'MORE THAN 24 SQUARE FEET OR LESS THAN 6 SQUARE FEET IN SIZE
AND SHALL NOT EXCEED 6 FEET IN HEIGHT.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
6 DO ORDAIN AS FOLLOWS:

SECTION 1. Ordinance No. 821 Section 2435 Subsection (a)
8 is hereby amended to read as follows:

"(a) Every person, firm, co-partnership, association or
10 corporation offering for sale or selling any gasoline or other
11 motor vehicle fuel to the public from any place of business in
12 the City of San Bernardino shall post or display a sign which is
13 clearly visible from any entrance to such place of business, and
14 which indicates the actual price per gallon, including all taxes,
15 at which his grade of gasoline or other motor vehicle fuel is
16 currently being offered for sale or sold."

SECTION 2. Ordinance No. 821 Section 2435 Subsection (b)
18 is hereby amended to read as follows:

"(b) When any such sign is portable it shall not be more
20

than 24 square feet or less than 6 square feet in size and shall
not exceed 6 feet in height."
SECTION 3. This ordinance is hereby declared an urgency
measure necessary for the immediate protection and preservation

of the public peace, health, safety and welfare in that the appar-
ent scarcity of supply of gasoline and other motor vehicle fuels
has resulted in widely divergent and rapidly fluctuating prices
27
between service stations and even from day-to-day at the same
28
service station. Inability of the motoring public to determine
the price of such commodities until they are at the pump has
resulted in aggravation and threats of violence. Immediate
passage of this ordinance is therefore necessary in order to
assure the health, safety and welfare of the public, including
personnel who dispense such commodities. Therefore, this ordin-
ance shall take effect immediately upon its adoption.
