ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE
NO. 821; INCREASING THE PENALTY FOR DELINQUENT PAYMENT OF DOG
LICENSE FEES AND THE RECLAIMING AND POUND FEES.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1. Ordinance No. 821 Section 519 is hereby amended
to read as follows:

"Section 519: Each person, firm or corporation owning or
9
harboring a dog, either kept upon private property or otherwise,
within the City of San Bernardino, shall on or before the first
10

day of July of each year, pay to said City in advance for the
fiscal year, a license and tag fee of five dollara ($5.00) for
12
13
each dog, which shall include the cost of a tag for such dog, and
in the event any of said fees are not paid prior to the first day
of September of each year, then a penalty of five dollars ($5.00)
shall be added to each such license fee. A fee of one dollar
($1.00) shall be charged for any additional tag issued to replace

a lost, stolen, misplaced or damaged tag. A fee of one dollar
($1.00) shall be charged for the transfer of ownership of a
licensed dog to a new owner in lieu of a fee for a new license
during the first year of such transfer.
Monies received during the current fiscal year for a
license shall be first applied to the payment of delinquent fees,
sums and penalties due during the preceding fiscal year, and
any balance remaining thereafter shall be applied to the payment
of the current license fees and penalties. A license issued dur-
ing any prior fiscal year to the same owner for the same dog,
as shown in an application for a current license, shall be prima

facie evidence in any court or administrative proceeding that
the dog was continuously owned by the same owner from said prior
year to the current fiscal year."

SECTION 2. Ordinance No. 821 Section 520 is hereby amended
5 to read as follows:

"section 520: That no license to own or harbor a dog, as
herein provided, shall be issued except upon an application to
authorized employees of said City setting forth the name and

address of the owner or possessor of the dog and a brief descrip-
tion of the dog."

SECTION 3. Ordinance No. 821 Section 523 is hereby amended

"section 523: The Animal Control Officer shall have the
14 right to seize any dog or animal within the City of San Bernardino
15
16
having or suspected to have rabies or hydrophobia and in the
event he shall determine that such dog or animal is at1icted
with
17 rabies or hydrophobia the dog or animal shall be forthwith killed
18 by said Officer; provided that if such dog or animal shall be
19 suspected of having rabies or hydrophobia, it may be confined by
20 said Officer for such time as is necessary, and if said Officer
21 shall then determine that said dog or animal does not have rabies
22 or hydrophobia, it shall be returned to the owner upon payment
23 by the owner of the sum of three dollars ($3.00) per day for
24 each day that the dog or animal shall be confined."

SECTION 4. Ordinance No. 821 Section 528 is hereby amende
26 to read as follows:

"Section 528: Each vicious or dangerous dog or animal
28 found running at large or unrestrained shall be impounded by

authorized employees of said City for a period of seventy-two (72)
hours. The reclaiming fee for such impounded dog or animal shall

be ten dollars ($10.00) plus three dollars ($3.00) per day pound

shall not, on or before the expiration of such period of seventy- I

and there any sums due or owing, said dog or animal shall be dis- I

day pound fee; the second or any subsequent time the same dog is
impounded the reclaiming fee shall be twenty dollars ($20.00) PlU'
three dollars ($3.00) per day pound fee. In the event the owner
of or the person possessing said dog shall not, on or before the
expiration of said period of seventy-two (72) hours, call for
and claim said dog, paying any sums then due or owing, said dog
shall be disposed of by said Officer."

adopted by the Mayor and Common Council of the City of San Ber-
