HomeMy WebLinkAbout3454 28 -I 1 ORDINANCE NO. . c7;f-) i( 2 ORDINANCE OF THE CITY OF SAN BERNARDINO PROVIDING FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY BY ESTABLISHING 3 MINIMUM REGULATIONS FOR THE INSTALLATION, ALTERATION OR REPAIR OF PLUMBING, GAS AND DRAINAGE SYSTEMS AND INSPECTIONS THEREOF; DESIG- 4 NATING AN ADMINISTRATIVE AUTHORITY; PROVIDING PENALTIES FOR VIO- I LATIONS, ADOPTING AND ESTABLISHING RULES AND REGULATIONS FOR THE 5 INSTALLATION, ALTERATION AND REPAIR OF PLUMBING, GAS AND DRAINAGE SYSTEMS AND RELATED MATTERS; ADOPTING THE UNIFORM PLUMBING CODE, 6 1973 EDITION, INCLUDING ITS APPENDICES "A" THROUGH "H" INCLUSIVE, AND TABLES; AND REPEALING ORDINANCE NO. 3092. 7 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 8 DO ORDAIN AS FOLLOWS: 9 SECTION 1. This ordinance shall be known as the "Uniform 10 Plumbing Ordinance". 11 SECTION 2. Those certain rules and regulations which pro- 12 vide for and govern the installation, alteration and repair of 13 plumbing, gas and drainage systems and the inspections thereof in 14 the City of San Bernardino; and penalties for violations thereof, 15 as set forth in that certain code printed in book form, and 16 entitled "Uniform Plumbing Code, 1973 Edition", as prepared and 17 promulgated by the International Association of Plumbing and 18 19 Mechanical Officials, three (3) copies of which Code have hereto- fore been filed with, and are on file in the office of the City Clerk of the City of San Bernardino, and which copies are identi- fied by certificates attached hereto, reading substantially as 20 21 22 follows: 23 "I LUCILLE GOFORTH, hereby certify that the ann~xed code entitled 'Uniform Plumbing Code, 1973 Edition', was filed in the office of the City Clerk of the City of San Bernardino on the . , and is a true, correct and e copy 0 aid code which is sought to be adop ed by reference by ordinance of the Mayor and Common Council of said City. 24 25 26 27 LUCILLE GOFORTH City Clerk of the ci ty of San Bernardino" 28 1 be and the same are hereby established as rules and regulations and a Code of said City and each and every part of said Code, and each and every provision therein contained, including its Appendices "A" through "H" inclusive and Tables, is hereby re- ferred to and designated as the "Uniform Plumbing Code, 1973 Edition", and is hereby adopted and made a part hereof as though fully set forth at length in this Ordinance. 2 3 4 5 6 7 8 SECTION 3. The following sections and provisions of the 9 Uniform Plumbing Code, 1973 Edition, are hereby amended to read 10 as follows: 11 "section 102. (c) ADMINISTRATIVE AUTHORITY. Whenever the 12 term "Administrative Authority" is used in this Code it shall be 13 construed to mean the City Superintendent of Building and Safety 14 or his authorized representative. 15 (a) Every house or building which shall Section 409. 16 hereafter be connected to a public sewer shall be protected from 17 backflow of sewage whenever the finished floor of such house or 18 building is at a lower elevation than the top of the first manhole 19 upstream from point of connection with the public sewer. Protec- 20 . tion shall be accomplished by installing a backflow preventer acceptable to the Administrative Authority. 21 22 Section 613. VERTICAL WET VENTING. 23 (a) vertical wet venting is limited to sections of vertica 24 drainage piping serving not more than two fixtures set on the 25 same floor level in private living quarters (residential uses 26 only) and having a discharge rating of not more than two (2) units 27 each. (b) In each such installation the vertical drain shall be -2- lone (1) pipe size larger than the upper fixture inlet, but in no 2 case smaller than the lower fixture inlet, whichever is the 3 larger, and the developed length between any two (2) such inlets 4 shall at no time be greater than five (5) times the diameter of 5 the intervening wet vented section. Identical fixtures, in- 6 stalled back to back, shall have their fixture inlets at the same 7 level. 8 (c) The unit load of the common vent serving the two (2) 9 fixtures shall be the sum of the unit values of such fixture. 10 (d) Fixtures that rough-in above the floor shall not be 11 combined with fixtures that rough-in below the floor. 12 Section 702. (c) Each waste outlet for a plumbing fitting 13 that requires roughing-in above the floor shall be immediately in 14 the rear of the fixture trap and no concealed change of direction 15 or offset shall be installed between any such fixture trap and its 16 vent. Any exposed fitting installed between a trap and its vent 17 shall be so located as to be readily removable for cleaning pur- 18 poses. 19 Section 704. TRAPS PROHIBITED. No form of trap which de- 20 pends for its seal upon the action of movable parts or concealed 21 interior partitions shall be used. Full "s" traps are prohibited. 22 No fixture shall be double trapped. Drum traps without vents may 23 be installed only when permitted by the Administrative Authority 24 for special conditions. 25 Section 907. (e) SETTING. Fixtures shall be set level 26 and in proper alignment with reference to adjacent walls. No 27 water closet shall be set closer than fifteen inches (15") from 28 its center to any vertical surface. SECTION 4. Said Uniform Plumbing Code is hereby amended by deleting therefrom the following sections, subsections and pro- visions: Section 310 (e) Section 1310 (a) SECTION 5. said Uniform Plumbing Code is hereby amended by adding thereto the sections and subsections hereinafter set forth to read as follows: "Section 207. (d) An approved two-way cleanout fitting shall be installed at the lower end of every building drain and shall be located two feet (2') outside the dwelling or building which it serves. Such cleanout shall be extended to the finish grade and made readily accessible. Section 306. PERMIT ISSUANCE. (a) To Whom Permits May be Issued: Any permit required by this Code may be issued to the following: (1) Any person holding a valid unexpired and unre- voked State of California Plumbing Contractors License (Classifi- cation C-36) as required by Chapter 9 of Division 3, Section 7058 of the Business and Professions Code and enforced by the Contractors State License Board. (2) Any person holding a valid unexpired and unre- voked State of California General Building Contractors License (Classification B) as required by Chapter 9 of Division 3, Section 7057 of the Business and Professions Code and enforced by the -4- 1 I [, I I Contractors State License Board. 2 (3) Any person who is the bonafideowner or bonafide 3 owner's agent of a one family or two family dwelling unit and 4 including the usual accessory buildings used in connection with 5 such dwelling units, provided that said owner or agent is properly 6 qualified to supervise or perform all labor in connection there- 7 wi tho 8 (b) FEES-VIOLATIONS-PENALTIES. Any person, firm or cor- 9 poration violating or causing or permitting the violation of any 10 of the provisions of this Code or Ordinance shall be deemed guilty 11 of a misdemeanor and upon conviction thereof shall be punishable 12 by a fine not to exceed five hundred dollars ($500.00) or by 13 imprisonment in the County Jail for not to exceed six (6) months, 14 or by both such fine and imprisonment. Each separate day or any 15 16 portion thereof during which any violation of this Code or II Ordinance occurs or continues shall be deemed to constitute a 17 separate offense and upon conviction thereof shall be punishable 18 las herein provided. 19 The issuance or granting of a permit or approval of plans land specifications shall not be deemed or construed to be a permit for, or an approval of, any violation of any of the provisions of 20 21 22 this Code. No permit presuming to give authority to violate or 23 ,cancel the provisions of this Code shall be valid, except insofar 24 as the work or use which it authorizes is lawful. 25 26 The issuance or granting of a permit or approval of plans shall not prevent the Administrative Authority from thereafter 27 28 requiring the correction of errors in said plans and specifications or from preventing construction operations being carried on there- -5- 1 under when in violation of this Code or any of any other 2 ordinance or from revoking any certificate or approval when 3 i issued in error. 4 Every permit issued by the Administrative Authority under 5 the provisions of this Code shall expire by limitation and become 6 null and void, if the work authorized by such permit is not 7 commenced within sixty (60) days from the date of issuance of 8 such permit, or if the work authorized by such permit is suspended 9 or abandoned at any time after the work is commenced for a period 10 of one hundred twenty (120) days. Before such work can be 11 recommenced a new permit shall be first obtained to do so. 12 (c) COST OF PERMIT. Every applicant for a permit to in- 13 stall, add to, alter, relocate or replace a plumbing or drainage 14 II system or part thereof, .shall state in writing on the application 15 I form provided for that purpose, the character of work proposed to 16 be done and the amount and kind in connection therewith, together 17 with such information pertinent thereto as may be required. 18 Such applicant shall pay for each permit issued at the time 19 of issuance, a fee in accordance with the following schedule and 20 at the rate provided for each classification shown therein. 21 Any person who shall commence any plumbing work for which 22 a permit is required by this Code without first having obtained a 23 permit therefor, shall, if subsequently permitted to obtain a 24 permit, pay double the permit fee fixed by this section for such 25 work; provided, however, that this provision shall not apply to 26 emergency work when it shall be proven to the satisfaction of the 27 Administrative Authority that such work was urgently necessary 28 and that it was not practical to obtain a permit therefor before -6- I' I , 1 the commencement of the work. In all such cases a permit must be 2 obtained as soon as it is practical to do so and if there be an 3 unreasonable delay in obtaining such permit, a double fee as 4 herein provided shall be charged. 5 For the purpose of this section, a sanitary plumbing outlet 6 on or to which a plumbing fixture or appliance may be set or 7 attached shall be construed to be a fixture. Fees for reconnectio~ I 8 and retest of existing plumbing systems in relocated buildings 9 shall be based on the number of plumbing fixtures, gas systems, 10 water heaters, etc. involved. 11 When interceptor traps or house trailer site traps are in- 12 stalled at the same time as a building sewer on any lot, no sewer 13 permit shall be required for the connection of any such trap to an 14 appropriate inlet fitting provided in the building sewer by the 15 permittee constructing such sewer. 16 When a permit has been obtained to connect an existing 17 building or existing work to the public sewer or to connect to a 18 new private disposal facility, backfilling of private sewage 19 disposal facilities abandoned consequent to such connection is 20 included in the building sewer permit. 21 SCHEDULE OF FEES 22 Permit $ 3.00 23 24 Plumbing fixture or trap or set of fixtures on one trap including water, drainage piping and backflow protection therefor 2.00 5.00 5.00 25 26 House sewer Cesspool 27 Private sewage disposal system 10.00 2.00 28 Water heater and/or vent -7- 1- 1 iRepair or alteration of drainage or vent piping 2 Gas piping system of one to five outlets 3 'Gas piping system of six or more, per outlet $ 2.00 2.00 .50 4 Industrial Waste, pretreatment interceptor including its trap and vent excepting type grease interceptors 5 functioning as fixture traps 2.00 6 Installation, alteration or repair of water piping and/or water treating equipment 2.00 7 8 Lawn sprinkler system on anyone meter including backflow protection devices therefor 2.00 9 Vacuum breakers or backflow protection devices on tanks, vats, etc. or for installation on unprotected plumbing fixtures including necessary water piping - one to five 10 11 12 Shower pan 2.00 2.00 2.00 Garbage disposal (when added to existing construction) 13 14 (d) WORK WITHOUT A PERMIT. Where work for which a permit 15 is required by this Code is completed prior to the issuance of 16 said permit, an additional fee of ten percent (10%) of the cost 17 of the project, or the sum of two hundred dollars ($200.00), which 18 ever is less, shall be paid and it shall be the duty of the 19 Administrative Authority to levy and collect said additional 20 fees. The payment of such fee shall not relieve any persons or 21 firms from fully complying with other provisions of this Code or 22 from the payment of any other penalties or fees prescribed herein. 23 Section 318. (3) LIABILITY OF CITY OFFICIAL OR EMPLOYEE. 24 This Ordinance and said Uniform Plumbing Code shall not be con- 25 strued to impose upon the City of San Bernardino or its employees 26 or agents any liability or responsibility for damages caused by 27 defective plumbing or drainage systems on the installation thereof 28 and the City of San Bernardino and its officials, agents or -8- 1 employees shall not be held as assuming any such liability or 2 responsibility by reason of any inspection required or authorized 3 thereunder. 4 Section 403. (c) The minimum size of the building drain 5 installed in any commercial construction shall be four inches (4"). 6 Section 410. HOUSE DRAINS SHALL CONNECT TO ONE OUTLET. 7 In a single family dwelling, all plumbing drains shall connect to 8 one outlet. Such outlet shall not exceed ninety degrees (900) 9 from the direction of flow of the closest public sewer or if there is no public sewer then from the proposed public sewer. If more I than one stub-out is used, the person installing the plumbing shalll connect all such stub-outs to each other so that there shall be 10 11 12 13 one outlet. The materials used shall be as required elsewhere in 14 this Code. 15 section 1002. (e) No person shall advertise, sell or 16 offer for use or sale, any water treating chemical or substance, 17 water using or water treating chemcial or substance, water using 18 or water operated equipment, mechanism or contrivance, if the 19 County Health Officer finds that the use of such chemical or 20 substance, equipment, mechanism or contrivance may cause contam- 21 ination or pollution of the domestic water system. Such devices 22 may be permitted when equipped with backflow protection meeting 23 the requirements of the Uniform Plumbing Code. 24 Section 1009. (n) All horizontal water piping, including 25 lawn sprinkler systems, installed underground, shall have not 26 less than six inches (6") of earth cover. 27 Section 1102. (c) The following are the only materials 28 approved for the installation of sewers for buildings and -9- \- 1 structures in the City of San Bernardino: 2 Wedge Lock Pacific Clay Products 3 Speed Seal Gladding McBean Co. 4 Band Seal Mission Clay Products 5 Transite Johns-Manville 6 Acrylonitrile-Butadine-Styrene (A.B.S.) as approved by International Association of Plumbing and Mechanical Officials." 7 8 SECTION 6. The word "City" in the aforesaid sections and 9 Code shall be deemed to refer to and designate the City of San 10 Bernardino, and any reference to any act or legislative enactment 11 therein referred to shall be deemed to designate and embrace the 12 statutes of the State of California and amendments thereof dealing 13 with the subject matter thereby and therein referred to. 14 SECTION 7. REVOCATION. The Mayor and Common Council of 15 the City of San Bernardino shall have the power, upon recommenda- 16 tion of the Administrative Authority to suspend or revoke the 17 business license of any person, firm or corporation violating the 18 terms and provisions of said Plumbing Code, provided that such 19 suspension or revocation shall not be ordered by said Mayor and 20 Common Council without first holding a public hearing thereon and 21 without giving reasonable notice of such hearing to the person, 22 firm or corporation so charged with said violation. 23 SECTION 8. If any section, subsection, sentence, clause 24 or phrase of this Ordinance or said Code is for any reason held 25 to be invalid or unconstitutional by the decision of any court 26 of competent jurisdiction, such decision shall not affect the 27 validity of the remaining portions of said Ordinance or Code. 28 The Mayor and Common Council of the City of San Bernardino hereby -10- 1 declare that they would have passed said Ordinance and Code, and 2 each section, subsection, sentence, clause and phrase thereof, 3 I irrespective of the fact that anyone or more other sections, 4 subsections, clauses or phrases be declared invalid or uncon- 5 stitutional. 6 7 8 SECTION 9. Ordinance No. 3092 is hereby repealed.
