HomeMy WebLinkAbout3458 - I 1 ORDINANCE NO. _ -=)4 ~? e , AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 300 (LAFC 1474). 2 3 4 WHEREAS, heretofore, proceedings were initiated by the Common 5 Council of the City of San Bernardino, on its own motion, to annex to the 6 City of San Bernardino certain contiguous uninhabited territory hereinafter 7 described; and 8 WHEREAS, on the 16th day of September, 1974, a resolution was adopted 9 by the aforesaid Common Council of the City of San Bernardino, California, 10 declaring that proceedings had been initiated by said Council, and proposing 11 the annexation, for the reasons therein stated, of the aforementioned 12 uninhabited territory to the City of San Bernardino, and that said resolution 13 provided that the proposed annexation should be generally known and identified 14 as Annexation District No. 300; and 15 WHEREAS, said resolution set forth therein that all the property 16 included in the aforesaid territory should be taxed equally with the other 17 property within the City to pay the bonded indebtedness and any and all general 18 indebtedness and liability of the City of San Bernardino contracted prior to 19 or existing or outstanding at the time of the aforesaid proposed annexation 20 of the aforesaid property as provided in the hereinbefore mentioned Government 21 Code; and 22 WHEREAS, said resolution did fix, determine and declare that a 23 hearing be held on the 4th day of November, 1974, at the hour of 9:30 o'clock 24 A. M., in the Council Chambers of the City Hall, 300 North "D" Street, San 25 Bernardino, California, and the same was the day, hour and place designated 26 where any person owning real estate within such territory so proposed to be 27 annexed and having any objections to the proposed annexation, might object 28 before the Common Council and show cause why such territory should not be 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 annexed; furthermore, the said resolution provided that at any time not later 2 than the said hour set, as mentioned hereinbefore for the said hearing, any 3 owner of property within the said territory proposed to be annexed might file 4 written protest with the City of San Bernardino against such annexation; and 5 WHEREAS, there were/;~ written protests filed with the City Clerk 6 of the City of San Bernardino prior to 9:30 o'clock A. M. on November 4, 1974; _1,1 7 and thereafter, on the 't~ay of Y2 nJ.L'V~, 1974, Resolution No./if,;,3 8 was adopted by the Mayor and Common Council declaring that a majority protest 9 has not been presented; and WHEREAS, it appears to the Common Council of the City of San Bernardino that the aforesaid annexation proceedings have been completed and everything performed at this time in accordance with said Government Code, as mentioned hereinbefore, and any and all other laws in any way connected with the said annexation procedure having been complied with; and WHEREAS, the Common Council of the City of San Bernardino desires to approve at this time the annexation of the aforesaid territory. NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION ONE: That said territory herein described as Annexation District No. 300 is hereby annexed and incorporated in and made a part of the City of San Bernardino. SECTION TWO: The territory herein referred to as being annexed to the City of San Bernardino is particularly described as follows; to wit: That portion of Lot 4 Orange Grove Tract as per plat thereof recorded in Book 11 of Maps, page 14 records of the County Recorder of San Bernardino County, State of California; those portions of Tract No. 4756 as per plat thereof recorded in Book 59 of Maps, page 69 records of said County, and those portions of the adjoining Streets, described as follows: Commencing at a point on the Present Corporate Limit line of the City of San Bernardino, said point being the intersection - 2 - n 28 1 of the center lines of Marshall Boulevard and Golondrina Avenue; thence west along said City Limit Line and said centerline of Marshall Boulevard, a distance of 130 feet more or less to an angle point in said City Limit Line, said point also being the True Point of Beginning; thence South along said City Limit Line, a distance of 101 feet more or less to its intersection with the North line of Lot 65 of Tract No. 4589 as per plat thereof recorded in Book 59 of Maps, page 82 records of said County; thence leaving said City Limit Line West along said North line of Lot 65 and the North line of Lot 66 of said Tract No. 4589, a distance of 175 feet more or less to its intersection with the East line of Lot 67 of said Tract No. 4589; thence North along said East Line of Lot 67, a distance of 60 feet more or less to its intersection with the South line of said Marshall Boulevard; thence West along said South line of Marshall Boulevard, a distance of 250 feet more or less to its inter- section with the centerline of Osbun Road; thence North along said centerline of Osbun Road and its Northerly prolongation, a distance of 41.25 feet more or less to its intersection with the centerline of said Marshall Boulevard; thence West along said centerline of Marshall Boulevard, a distance of 20 feet more or less to the Southerly prolongation of the West line of said Lot 14 of said Tract 4756; thence North along said Southerly prolongation and the West line of Lots 14, 13, & 12 of said Tract No. 4756, a distance of 244 feet more or less to the Northwest corner of said Lot 12; thence East along the North line of said Lot 12 and its Easterly prolongation, a distance of 145 feet more or less to its intersection with the centerline of Bonnie Street; thence South along said centerline of Bonnie Street, a distance of 50 feet more or less to its intersection with the centerline of Edgemont Drive; thence East along the centerline of said Edgemont Drive, a distance of 110 feet more or less to its intersection with the Northerly prolongation of the East line of Lot 15 of said Tract No. 4756; thence south along said Northerly prolongation and the East line of said Lot 15, a distance of 152 feet more or less to the Southeast corner thereof, said point also being on the North line of said Marshall Boulevard; thence East along said North line of Marshall Boulevard, a distance of 192 feet more or less to its intersection with the West line of Lot 8 of Tract No. 4885 as per plat thereof recorded in Book 62 of Maps, page 78 records of said County; thence South along said West line of Lot 8, a distance of 2 feet more or less to the Southwest Corner thereof; thence continuing Southerly in straight line, a distance of 41.25 feet more or less to the Point of Beginning. (Containing approximately 2.3 acres) 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 w 21 23 24 25 26 SECTION THREE: That the above described property will be subject 27 to taxation equally with the property within such municipal corporation to pay its proportion of the following bonded indebtedness of the City of San - 3 - "ll'" 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 ! 26 , 27 28 Bernardino, which said bonded indebtedness was outstanding or theretofore authorized and is outstanding at the time of said annexation, to wit: A bonded indebtedness of $490,000,00 incurred for the acquisition and construction of a public library, including additions to and enlargements of the public library system of said City, the outstanding indebtedness thereon being $150,000.00, bearing interest at the rates of 4-3/4%, 3-1/4%, and 3-1/2% per annum; A bonded indebtedness of $1,116,000.00 incurred for the acquisition and construction of additions to, relocations of and replacements of the fire fighting system of said City, the outstanding indebtedness thereon being $540,000,00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2,9% and 2-1/2% per annum. SECTION FOUR: The property herein annexed is declared to be a part of Ward 4 and the boundaries of Ward 4 are hereby altered to include said annexed territory, with zoning classification in the R-1-7200 Single Family Residential District. SECTION FIVE: That the area included in the above annexation is hereby detached from County Service Areas No. 38 and 70, Improvement Zone "A" of County Service Area lf70, and County Service Area SL-l.
