2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO APPROVING THE ANNEXATION OF DISTRICT NO. 301 (LAFC 1481).

WHEREAS, heretofore, proceedings were initiated by the Common
5
Council of the City of San Bernardino, on its own motion, to annex to the
6
City of San Bernardino certain contiguous uninhabited territory hereinafter
7
described; and
8
WHEREAS, on the 7th day of October, 1974, a resolution was adopted
9
by the aforesaid Common Council of the City of San Bernardino, California,
declaring that proceedings had been initiated by said Council, and proposing
the annexation, for the reasons therein stated, of the aforementioned
uninhabited territory to the City of San Bernardino, and that said resolution
provided that the proposed annexation should be generally known and identified
as Annexation District No. 301; and
WHEREAS, said resolution set forth therein that all the property
included in the aforesaid territory should be taxed equally with the other
property within the City to pay the bonded indebtedness and any and all genera
indebtedness and liability of the City of San Bernardino contracted prior to
or existing or outstanding at the time of the aforesaid proposed annexation
of the aforesaid property as provided in the hereinbefore mentioned Government
Code; and
WHEREAS, said resolution did fix, determine and declare that a
hearing be held on the 18th day of November, 1974, at the hour of 9:30 o'clock
A. M" in the Council Chambers of the City Hall, 300 North "0" Street, San
Bernardino, California, and the same was the day, hour and place designated
where any person owning real estate within such territory so proposed to be
annexed and having any objections to the proposed annexation, might object
before the Common Council and show cause why such territory should not be

1 annexed; furthermore, the said resolution provided that at any time not later
2 than the said hour set, as mentioned hereinbefore for the said hearing, any
3 owner of property within the said territory proposed to be annexed might file
4 written protest with the City of San Bernardino against such annexation; and
5
WHEREAS, there were 110 written protests filed with the City Clerk
of the City of San Bernardino prior to 9:30 o'clock A. M. on November 18, 1974;
and thereafter, on the .~day of -'t~74' Resolution No.//9c, /
was adopted by the Mayor and Common Council declaring that a majority protest

has not been presented; and
WHEREAS, it appears to the Common Council of the City of San
Bernardino that the aforesaid annexation proceedings have been completed and
everything performed at this time in accordance with said Government Code, as
mentioned hereinbefore, and any and all other laws in any way connected with
the said annexation procedure having been complied with; and
WHEREAS, the Common Council of the City of San Bernardino desires to
approve at this time the annexation of the aforesaid territory.
NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO DO ORDAIN AS FOLLOWS:
SECTION ONE: That said territory herein described as Annexation
District No. 301 is hereby annexed and incorporated in and made a part of the
City of San Bernardino.
SECTION TWO: The territory herein referred to as being annexed to
the City of San Bernardino is particularly described as follows; to wit:
That portion of the Irvington Land and Water Company Sub-
division as per plat thereof recorded in Book 1 of Records of
survey, page 32 records of the County Recorder, San Bernardino
County, State of California; and those portions of the ad-
joining streets, described as follows:
Beginning at a point on the Present Corporate Limit Line of
the City of San Bernardino, said point being the intersection
of the centerlines of Palm Avenue and U.S. Highway 395
(State Highway 31); thence northerly along said City Limit

Line and said centerline of Palm Avenue, a distance of 350
feet more or less to an angle point in said City Limit Line;
thence Easterly along said City Limit Line and being the
centerline of Kendall Drive a distance of 5620 feet more or
less to an angle point therein; thence Southerly along said
City Limit Line, and being the centerline of Orange Street
(vacated), a distance of 1200 feet more or less to an angle
point therein; thence leaving said City Limit Line, Westerly
along said Centerline of U.S. Highway 395, a distance of
5770 feet more or less to the Point of Beginning.

SECTION THREE: That the above described property will be subject

to taxation equally with the property within such municipal corporation to
9
pay its proportion of the following bonded indebtedness of the City of San
Bernardino, which said bonded indebtedness was outstanding or theretofore
authorized and is outstanding at the time of said annexation, to wit:
A bonded indebtedness of $490,000.00 incurred for the acquisition
and construction of a public library, including additions to and enlargements
of the public library system of said City, the outstanding indebtedness
thereon being $120,000.00, bearing interest at the rates of 4-3/4%, 3-1/4%,
and 3-1/2% per annum;
A bonded indebtedness of $1,116,000.00 incurred for the acquisition
and construction of additions to, relocations of and replacements of the fire

fighting system of said City, the outstanding indebtedness thereon being
$540,000.00, bearing interest at the rates of 4%, 3%, 2-3/4%, 2.9% and 2-1/2%
per annumo
SECTION FOUR: The property herein annexed is declared to be a part
of Ward 5 and the boundaries of Ward 5 are hereby altered to include said
annexed territory, with zoning classifications as shown on Map titled Exhibit
"A" and described as follows:
"0" Open District
A portion of Sections 12 and 13, T. 1 N., R. 5 W., S.B.B.
& M., being a portion of the Muscupiabe Rancho, unsurveyed
portion, as recorded in Map Book 7, page 23, records of San
Bernardino County, State of California, and a portion of

Blocks 46, 52, 58 and an unnamed block of Irvington Land
& Water Company's Subdivision of a portion of the Muscupiabe
Rancho as recorded in Record of Surveys' Book 1, page 32,
records of San Bernardino County, State of California and
more particularly described as follows:

Beginning at a point on the center line of Kendall Drive,
said point being S. 570 49' 19" E. 2726.90 feet from the
center line intersection of Palm Avenue and Kendall Drive;
thence N. 57049' 19" W. 80.60 feet; thence S. 40 04' 19"
E. 718.93 feet; thence along a 2065 feet radius curve con-
cave to the left for a distance of 1041.40 feet; thence S.
330 00' 00" E. 830.14 feet; thence along a 1935 foot radius

a point on the northeasterly property line of the Atchison,
Togeka & Santa Fe Railway Right of Way; said point being S.

410 39' 41" E. 31.42 feet; thence N. 170 35' 36" E. 458.98
feet; thence along a 2070 ft. radius curve concave to the
right from a tangent bearing N. 440 39' 04" E. for a distance "'

along a 2065 foot radius curve concave to the left from a
tangent bearing N. 200 30' 00" E. for a distance of 1928.20

1935 ft. radius curve concave to the right for a distance of
975.84 feet; thence N. 40 04' 19" W. 623.61 feet to a point

Beginning at a point on the center line of Kendall Drive,
said point being S. 570 49' 19" E. 2726.90 feet from the

SECTION FIVE: That the area included in the above annexation is
hereby detached from County Service Area No. 70 and the Central Valley Fire
Protection District.
