HomeMy WebLinkAbout3471 1 ORDINANCE NO. ~'l?/ 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE NO. 1991 KNOWN AS THE "LAND USE ZONING ORDINANCE"; AND SETTING 3 FORTH REQUIREMENTS FOR STREET IMPROVEMENTS AND RELOCATION OF PUBLIC FACILITIES IN ARTERIAL OR COLLECTOR STREETS OR STATE 4 HIGHWAYS WHEN ADJOINING PROPERTY IS DEVELOPED OR ENLARGED. 5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 6 7 8 9 SECTION 1. Ordinance No. 1991 Section 20.2 Subsection E Paragraph 1 is hereby amended to read as follows: "1. No building shall be erected or enlarged by more than 10 25% on, or moved to, any lot in any zoning district, except the 11 'R-l' and 'R-2' Districts, if such lot abuts or adjoins a street 12 designated as an arterial street, collector street or state high- 13 way in the Select System of City Streets or General Plan of the 14 City of San Bernardino if such street or highway is deemed 15 16 17 deficient by the standards established therefor, unless that half of the street located on the same side as such adjoining lot has first been dedicated and improved on the entire adjoining frontage 18 or side of the lot. Such dedication and improvement shall not 19 be required in the event the erection or enlargement of the build- 20 ing is on a lot or lots which have an adjoining frontage or side 21 of less than 100 feet unless the erection or enlargement of the 22 building is on a corner lot or on a lot or lots on an arterial or 23 collector street in the Select System or on a lot or lots adjacent 24 to or adjoining property on such street which has been previously 25 dedicated and improved pursuant to a street widening project or 26 was required to be so dedicated and improved by this ordinance or 27 other law." 28 SECTION 2. Ordinance No. 1991 Section 20.2 Subsection E 28 1 Paragraph 6 is hereby amended to read as follows: 2 "6. Any person required to make street improvements re- 3 quired by the provisions of this Subsection shall make and con- 4 struct the same in compliance with the requirements of the City 5 Engineer." 6 SECTION 3. Ordinance No. 1991 Section 20.2 Subsection E 7 Paragraph 8 is hereby amended to read as follows: 8 "8. Upon approval of the Superintendent of the Building 9 and Safety Department and the City Engineer the owner, developer 10 or applicant for the building permit may delay the construction 11 of said improvements no later than the time for final inspection 12 under any building, plumbing, wiring or other permit relating to 13 said building; provided, however, that whenever the property being 14 erected or enlarged is on a corner lot with street improvements 15 required to be made on at least two adjoining streets and the City 16 Engineer approves the filing by the owner, developer or applicant 17 of a good and sufficient bond, cash or certificate of deposit 'in 18 such amount as the City Engineer shall estimate and determine to 19 be necessary to cover the costs of all the improvements required' 20 the City Engineer and the Superintendent of Building and Safety 21 may, for good cause shown, extend the time for the completion of 22 the required street improvements for a period of not more than one 23 year after final inspection and issuance of the certificate of 24 " occupancy. 25 I HEREBY CERTIFY that the foregoing ordinance was duly 26 adopted by the Mayor and co~on c~ncil of Bernardino at a /5 "'Ad':::--fd.J otf2r,~ v, / the City of San 27 meeting thereof, hel, / on the ~~ day /. ,y/v ;T A" 19~, by the following vote -2- 20 21 22 23 24 25 26 27 28 /' -~ /' ,//A-7t' --< .J f/ -, /' '/L: ;?
