2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING
ORDINANCE NO. 1991 KNOWN AS THE "LAND USE ZONING ORDINANCE"
3 AND PROVIDING FOR LIMITED CHANGES IN ZONING PROVISIONS
RELATING TO ON PREMISES SALE AND CONSUMPTION OF ALCOHOLIC
4 BEVERAGES IN C-l ZONES

BERNARDINO DO ORDAIN AS FOLLOWS:

SECTION 1. Ordinance No. 1991, Section 10.2 is
hereby amended to read as follows:
"Section 10.2 CONDITIONS TO USE - All structures
built in this district shall be subject to Commission review
and approval.
The on or off-sale of alcoholic beverage is prohibited
in this district excepting therefrom the off-sale of packaged
beer and wine provided the requisite State off-sale liquor
license has been obtained for the premises involved, and pro-
vided further, that there shall be no consumption of alcoholic
beverages including beer and wine on such premises. Not-
withstanding the foregoing provisions to the contrary, the
on-sale and consumption of alcoholic beverages shall be permitted
on any premises in this district which are being lawfully so
used on the effective date of this amendment by a club or
fraternal organization when another club or fraternal organizatio
uses from said date and continuously thereafter all or a portion
of the premises of said existing organization or club for such
on-sale and consumption of alcoholic beverages.
SECTION 2. This ordinance is an urgency measure, which
shall take effect and become operative upon its adoption and
approval.
The facts constituting such urgency are that the City of

1 San Bernardino has received a federal grant for remodeling
2 the existing Elks Lodge building as a new pOlice facility.
3 Said public works project requires the immediate relocation
4 of the Elks Lodge activities in order to comply with grant
5 provisions and agreements involving the Cit~ the Redevelopment
6 Agency and the Elks Lodge. Should the immediate relocation of
7 the Elks Lodge be thwarted, the City would not qualify for
8 the grant and the public safety of the City would be impaired
9 because of the reduction of planned and more efficient
10 law enforcement services. Said ordinance provision will
11 permit the relocation of the Elks Lodge activities to
12 a feasible temporary location.
13 I HEREBY CERTIFY that the foregoing ordinance was duly
14 adopted by the Mayor and Common Council of the City of
