HomeMy WebLinkAbout3694 1 ORDINANCE NO. ^~9~ 2 ORDINANCE OF THE CITY OF SAN BERNARDINO PROVIDING FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY BY ESTABLISHING MINIMUM REGULATIONS FOR THE: INSTALLATION, ALTERATION OR REPAIR OF PLUMBING, GAS AND DRAINAGE SYSTEMS AND INSPECTIONS THEREOF; DESIGNATING AN ADMINISTRATIVE AUTHORITY; PROVIDING PENALTI~S FOR VIOLATIONS, ADOPTING AND ESTABLISHING RULES AND REGULATIONS FOR THE INSTALLATION, ALTERATION AND REPAIR OF PLUMBING, GAS , AND DRAINAGE SYSTEMS AND RELATED MATTERS; ADOPTING THE UNIFORM !I PLUMBING CODE, 1976 EDITION, .INCLUDING ITS APPENDIXES "AR THROUGH Ii "I" INCLUSIVE, AND TABLES; AND REPEALING ORDINANCE NO. 3454. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO II DO ORDAIN AS FOLLOWS: I! SECTION 1. This ordinance shall be known as the "Uniform 3 4 5 6 7 8 9 10 Plumbing Ordinance". 11 SECTION 2. Those certain rules and regulations which provi e for and govern the installation, alteration and repair of plumbing I gas and drainage systems and the inspections thereof in the City I of San Bernardino; and penalties for violations thereof, as set 12 13 14 15 forth in that certain code printed in book form, and entitled "Uniform Plumbing Code, 1976 Edition", as prepared and promulgated by the International Association of Plumbing and Mechanical 16 17 18 Officials, three (3) copies of which Code have heretofore been filed with, and are on file in the office of the City Clerk of 19 20 the City of San Bernardino, and which copies are identified by certificates attached hereto, reading substantially as follows: 21 22 "I, LUCILLE GOFORTH, hereby certify that the annexed code entitled 'Uniform Plumbinq Code, 1976 Edition', was filed in the office of the City Clerk o~ City of San Bernardino on the~ d.y of , 1977, and is a true, correct sompl.te copy 0 said code which is sought to be a40pte4 by reference by ordinance of the Mayor and Common Council of said City. 23 24 25 26 27 LUCILLE GOFORTH City Clerk of the City of San Bernardino"; 28 11 13 20 22 23 24 1 ,'be and the same are hereby established as rules and regulations I' " 2 and a Code of said City and each and every part of said Code, 3 and each and every provision therein contained, including its 4 Appendixes "A" through "I" inclusive and Tables, is hereby 5 referred to and designated as the "Uniform Plumbing Code, 1976 6 Edition", and is hereby adopted and made a part hereof as though 7 fully set forth at length in this Ordinance. 8 SECTION 3. The following sections and provisions of the 9 Uniform Plumbing Code, 1976 Edition, are hereby amended to read 10 'as follows: Section 20.3. VIOLATIONS-PENALTIES. Any person, firm 12 I 1 or corporation violating or causing or permitting the violation of any of the provisions of this Code or Ordinance shall be 14 deemed guilty of a misdemeanor and upon conviction thereof, shall 15 be punishable by a fine not to exceed five hundred dollars 16 ($500.00) or by imprisonment in the County Jail for not to 17 exceed six (6) months, or by both such fine and imprisonment. 18 Each separate day or any portion thereof during which any viola- 19 tion of this Code or Ordinance occurs or continues shall be deemed to constitute a separate offense and upon conviction 21 thereof shall be punishable as herein provided. The issuance or granting of a permit or approval of plans and specifications shall not be deemed or construed to be a permit for, or an approval of, any violation of any of the 25 provisions of this Code. No permit presuming to give authority 26 to violate or cancel the provisions of this Code shall be valid, 27 except insofar as the work or use which it authorizes is lawful. 28 The issuance or granting of a permit or approval of plans -2- 1 shall not prevent the Administrative Authority from thereafter 2 !requiring the correction of errors in said plans and specifica- 3 itions or from preventing construction operations being carried ! 4 ion thereunder when in violation of this Code or of any other 5 ordinance or from revoking any certificate or approval when 6 : issued in error. 7 i I Every permit issued by the Administrative Authority I under the provisions of this Code shall expire by limitation and become null and void, if the work authorized by such permit is 8 9 10 not commenced within sixty (60) days from the date of issuance of such permit, or if the work authorized by such permit is 11 12 suspended or abandoned at any time after the work is commenced 13 for a period of one hundred twenty (120) days. Before such work 14 can be recommenced a new permit shall be first obtained to do so. 15 Section 20.6. APPLICATION FOR PERMIT. (a) No permit 16 shall be issued to any person to do or cause to be done any I work regulated by this Code, except to a person holding a valid II unexpired and unrevoked Plumbing Contractor's Certificate of II Qualification or Registration as required by Section 2.3, except I when and as otherwise hereinafter provided in this section. i , I (b) A permit may be issued to a properly licensed person II not acting in violation of any current contractor licensing law. (c) Any permit required by this Code may be issued to any person to do any work regulated by this Code in a single family dwelling used exclusively for living purposes, including the usual accessory buildings and quarters in connection with 17 18 19 20 21 22 23 24 25 26 27 such buildings in the event that any such person is the bona fide owner of any such dwelling and accessory buildings and 28 -3- I' 1 quarters, and that the same are occupied by said owner. 2 Any person legally entitled to apply for and receive a 3 permit shall make such application on forms provided for that 4 purpose. He shall give a description of the character of the 5 work proposed to be done, and the location, ownership, occupancy 6 and use of the premises in connection therewith. The Administra- 7 tive Authority may require plans, specifications or drawings 8 and such other information as he may deem necessary. 9 If the Administrative Authority determines that the plans, 10 specifications, drawings, descriptions or information furnished 11 by the applicant is in compliance with this Code, he shall issue 12 the permit applied for upon payment of the required fee as here- 13 inafter fixed. 14 Section 20.7. COST OF PERMIT. Every applicant for a 15 permit to do work regulated by this Code shall state in writing, 16 on the application form provided for that purpose, the character 17 of work proposed to be done and the amount and kind in connection 18 therewith, together with such information, pertinent thereto, 19 ,as may be required. 20 Such applicant shall pay for each permit, at the time of 21 issuance, a fee in accordance with the following schedule, and 22 at the rate provided for each classification shown herein. 23 Where work for which a permit is required by this Code 24 is completed prior to the issuance of said permit, an additional 25 fee of ten percent (10%) of the cost of the project, or the sum 26 of two hundred dollars ($200.00), whichever is less, shall be 27 paid and it shall be the duty of the Administrative Authority 28 levy and collect said additional fees. The payment of such to I , I , -4- I, 1 '! fee shall not relieve any persons or firms from fully complying ii 2 ,with other provisions of this Code or from the payment of any 3 I other penalties or fees prescribed herein. ! 4 For the purpose of this section, a sanitary plumbing 5 outlet on or to which a plumbing fixture or appliance may be 6 set or attached shall be construed to be a fixture. Fees for 7 reconnection and retest of plumbing systems in relocated buildings shall be based on the number of plumbing fixtures" gas systems, 8 9 water heaters, etc., involved. 10 When interceptor traps or mobilehome site traps are 11 installed at the same time as a building sewer on any lot, no sewer permit shall be required for the connection of any such trap to an appropriate inlet fitting provided in the building 12 13 14 sewer by the permittee constructing such sewer. 15 When a permit has been obtained to connect an existing 16 building or existing work to the public sewer or to connect to 17 a new private disposal facility, backfilling of private sewage 18 disposal facilities abandoned consequent to such connection is II included in the permit. (a) DRAINAGE SYSTEMS. Every house or build- 15 ing which shall hereafter be connected to a public sewer shall be 16 protected from backflow of sewage whenever the finished floor of 17 such house or building is at a lower elevation than the top of the 18 first manhole upstream from point of connection with the public 19 sewer. Protection shall be accomplished by installing a backflow 20 preventer acceptable to the Administrative Authority. 21 Section 613. VERTICAL WET VENTING. (a) Vertical wet 22 venting is limited to sections of vertical drainage piping serving 23 not more than two fixtures set on the same floor level in private 24 living quarters (residential uses only) and having a discharge 25 rating of not more than two (2) units each. 26 (b) In each such installation the vertical drain shall be 27 one (1) pipe size larger than the upper fixture inlet, but in no 28 case smaller than the lower fixture inlet, whichever is the -6- Ii 1 2 larger, and the developed length between any two (2) such inlets shall at no time be greater than five (5) times the diameter of 3 the intervening wet vented section. Identical fixtures, installed 4 back to back, shall have their fixture inlets at the same level. 5 I . I f1xtures shall be the sum , (c) The unit load of the common vent serving the two (2) 6 of the unit values of such fixtures. 7 (d) Fixtures that rough-in above the floor shall not be 8 combined with fixtures that rough-in below the floor. 9 Section 907. (e) SETTING. Fixtures shall be set level 10 and in proper alignment with reference to adjacent walls. No 11 water closet shall be set closer than fifteen inches (15") from 12 its center to any vertical surface. No urinal shall be set 13 closer than twelve inches (12") from its center to any side wall 14 or partition or closer than twenty-four inches (24") center to 15 center. 16 SECTION 4. Said Uniform Plumbing Code is hereby amended by 17 adding thereto the sections and subsections hereinafter set forth to read as follows: 18 19 Section 406. (j) CLEANOUTS. An approved two-way clean- 20 out fitting shall be installed at the lower end of every building 21 drain and shall be located two feet (2') outside the dwelling or 22 building which it serves. Such cleanout shall be extended to the 23 finish grade and made readily accessible. 24 Section 410. HOUSE DRAINS SHALL CONNECT TO ONE OUTLET. 25 In a single family, all plumbing drains shall connect to one out- 26 let. Such outlet shall not exceed ninety degrees (900) from the 27 direction of flow of the closest public sewer or if there is no 28 public sewer then from the proposed public sewer. If more than -7- lone stub-out is used, the person installing the plumbing shall 2 connect all such stub-outs to each other so that there shall be 3 one outlet. The materials used shall be as required elsewhere 4 in this Code. 5 Section 1002. (el UNLAWFUL CONNECTIONS. No person shall 6 advertise, sell or offer for use or sale, any water treating 7 chemical or substance, water using or water treating chemical or 8 substance, water using or water operated equipment, mechanism or 9 contrivance, if the County Health Officer finds that the use of 10 such chemical or substance, equipment, mechanism or contriv.ance 11 may cause contamination or pollution of the domestic water system. 12 Such devices may be permitted when equipped with backflow pro- 13 tection meeting the requirements of the Uniform Plumbing Code. 14 SECTION 6. The word "City" in the aforesaid sections and 15 Code shall be deemed to refer to and designate the City of San 16 Bernardino, and any reference to any act or legislative enactment 17 therein referred to shall be deemed to designate and embrace the 18 statutes of the State of California and amendments thereof dealing 19 with the subject matter thereby and therein referred to. 20 SECTION 7. REVOCATION. The Mayor and Common Council of 21 the City of San Bernardino shall have the power, upon recommenda- 22 tion of the Administrative Authority to suspend or revoke the 23 business license of any person, firm or corporation violating the 24 terms and provisions of said plumbing Code, provided that such 25 suspension or revocation shall not be ordered by said Mayor and 26 Common Council without first holding a public hearing thereon and 27 without giving reasonable notice of such hearing to the person, 28 firm or corporation so charged with said violation. -8- 1 I' , SECTION 8. If any section, subsection, sentence, clause 2 or phrase of this Ordinance or said Code is for any reason held 3 to be invalid or unconstitutional by the decision of any court of 4 competent jurisdiction, such decision shall not affect the 5 i validity of the remaining portions of said ordinance or code. The 6 Mayor and Common Council of the City of San Bernardino hereby 7 declare that they would have passed said ordinance and code, and 8 each section, subsection, sentence, clause and phrase thereof, 9 irrespective of the fact that anyone or more other sections, 10 subsections, clauses or phrases be declared invalid or uncon- 11 sti tutional. 12 SECTION 9.
