THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. There is hereby created and established a Central City Parking Place Commission which shall consist of 9 members, all of whom shall be owners or lessees of property or the holders of licenses for businesses located within the limits of the Central City Parking District, or the designees of either. The members shall be nominated as follows: two members by the Mayor and one by each member of the Common Council. Members shall be appointed by the Mayor subject to the approval of the Common Council and shall serve without compensation. SECTION 2. Of the initial nine (9) appointees, four shall be appointed for terms expiring on April 1, 1979, and five shall be appointed for terms expiring on April 1, 1981. All subsequent terms shall be for four years and appointments may be made to fill a vacant office for the balance of any unexpired term. All members shall serve at the pleasure of the Mayor and Common Council. SECTION 3. The members shall choose from their member- ship a Chairman and Vice-Chairman who shall serve for a period of two years or until a re-election is held. The Commission shall meet at least once each month in the City Hall, with the time and date of such regular meeting to be established by the Commission. The City Administrator, or his designated representative, shall serve as the executive officer of the Commission. .1. . I ,--T- 1 SECTION 4. The Commission shall be responsible for 2 recommending operating policies and procedures for Parking 3 Lots 1, 2 and 3, and such other parking places and facilities 4 as may be assigned for such responsibility by the Mayor and 5 Common Council, including the provision of security, enforce- 6 ment of regulations, lighting, maintenance, repair and needed 7 improvements. 8 SECTION 5. The Commission may recommend time-limit 9 parking to be effective in said parking facilities and such 10 other measures as it may consider necessary in order to 11 effectively control and operate the facilities. The 12 Commission may also recommend rental fees or charges for all 13 or a portion of the parking places under its control. 14 SECTION 6. The Commission, in the exercise of its 15 responsibilities for maintaining and operating an effective 16 system of public, off-street parking within the District, may 17 recommend such time-limit parking controls and restrictions 18 with respect to on-street parking as it may believe to be 19 necessary to implement the overall goals and objectives of 20 the Parking District. 21 SECTION 7. No improvements, modifications or deletions 22 of any parking places under the charge of the Commission 23 shall be made unless, or until, said improvements, modifica- 24 tions or deletions shall first have been reviewed by the 25 Commission and a recommendation made thereon to the Mayor and 26 Common Council. SECTION 8. All requests for the waiver of any required off-street parking within the District shall be referred to the Commission for review and recommendation prior to any such waiver being granted by any other agency of the City. SECTION 9. Annually, on or before April 30th of each year, the Commission shall cause to be prep~red an estimate of proposed expenditures required for meeting the costs of security, operation, maintenance, repair and improvement of parking places within the District for the ensuing fiscal year, together with such funds as may be required for any additional parking spaces which the Commission may be recommending for acquisition. SECTION 10. Concurrently with the submission of the aforesaid estimate of proposed expenditures, the Commiss~on shall also submit an estimate of the District resources required to meet the financial needs of the Parking District, including unexpended funds, projected revenues from parking fees and charges, if any, and the amount to be raised by taxation. The Commission shall cause to be prepared a listing by July 15th, of the amounts recommended to be levied on each parcel of property within the District during the ensuing year in order to meet the obligations of the District.
