HomeMy WebLinkAbout3670 !I 1 ORDINANCE NO. i3 (.; 7 0 ORDINANCE OF TH~ CITY OF SAN BERNARDINO AMENDING ORDINANCE NO. 3646 ENTITL~D IN PART "ORDINANCE CREATING A CENTRAL CITY PARKING PLACE COMMISSION . . ."; CORRECTING AND MODIFYING A CLERICAL ERROR IN A PRIOR ENACTMENT; AND REPEALING ORDINANCE NO. 3657. 2 3 4 5 6 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 1 8 9 SECTION 1. Ordinance No. 3646 Section 1 is hereby amended to read as follows: 10 "Section 1. There is hereby created and established a Central City Parking Place Commission which shall consist of nine 11 (9) members, all of whom shall be owners or lessees of property 12 or the holders of licenses for businesses located within the 13 limits of the Central City Parking District, or the designees of 14 ither. The members shall be nominated as follows: two members 15 by the Mayor and one by each member of the Common Council. Member 16 shall be appointed by the Mayor subject to the approval of the 17 Common Council and shall serve without compensation at the pleasur 18 of the Mayor and Common Council. 19 The Mayor and Common Council declare that the individuals 20 appointed to the Commission are intended to represent and further 21 the interest of the holders of licenses of all businesses and the 22 owners or lessees of all property located within the District, and 23 that such representation and furtherance will ultimately serve the 24 public interest. Accordingly, the Mayor and Common Council find 25 that for the purposes of persons who are members of the Commission, 26 the holders of licenses of all businesses and the owners or lessee 27 of,preperty rocated in the District are tantamount to and con- 28 stitute the public generally within the meaning of Section 87103 '~ 10 11 12 13 14 15 16 17 18 19 20 21 22 ,~u., I: _ i' ii I, I 1 of the Government Code." 2 SECTION 2. Ordinance No. 3646 Section 2 is hereby amended 3 to read as follows: 4 "section 2. Of the initial nine (9) appointees, four shall 5 be appointed for terms expiring on April 1, 1979, and five shall , be appointed for terms expiring on April 1, 1981. All subsequent 7 i terms shall be for four years and appointments may be made to fill 8 ' il a vacant office for the balance of any unexpired term. All member II il shall serve at the pleasure of the Mayor and Common Council." SECTION 3.
