"I--;/-C:;P 3 AN ORDINAliCB RJJ:GULA.TDTG Tn Ol'Jl:RATION OF KOTOR TlIHICLSS TRANSPORTING l'ASSJmGERS FOR HIRJ: 'fITHIN T1L!: CITY OJ' SAli B.l!:RHARDINO. 4 5 6 The ~yor and Comaon Council of the City of San Ber- 7 n&rdino do ordain as follows I 8 SlCTION~: ~e t.~ -..taaobile for hire", as used 9 in this ordinance, shall include every automobile or motor 10 prope11ed vehicle by means of which passengers are transported 11 for hire. upon any publiC street of the city of San Bernardino, and 12 not over a regular or defined route, excepting vehicles embraeed 13 within the term "taxicab", as herein defined,and ~xoepting 14 vehicles of transportation companies as herein defined. 15 DOTION NOI The term "taxicab", as u..cl.J.;a this 16 ordinance, shall include every automobile or motor propelled 17 .shicle by means of which passengers are transported for hire 18 upon any public Itreet of the City of San Bernardino, andnot 19 over a regular or defined route, where the charge for such 20 transportation is measured, by the diltance traveled, or the time 21 required during luch tranlportation, excepting vehicles of 22 transportation companiel as herein defined. 23 SECTION ~: The term "transportation companiel" 24 as used in this ordinance shall be synonymous wi th the phrale 25 "transportation company" as defined in that certain act of the 26 legislature of the State of California,~~~o.ed "y 10th. 1917. 27 providing for the supervision and regulation of the transporta- 28 tion of persons and property for compensation over public highway 29 by automobiles. jitney busses, auto trucks. stages and auto 30 stages. and all amendments to said act. 31 SllCTION FOUR: It shall be unlawful to operate an 32 automobile for hire or a taxicab upon any public street within ,. 1. " 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28\ 29 30 31 32 1 the City of San Bernardino without having obtained a permi t 2 so to do in accordanoe wi th the prov i8ion8 hereof. 3 SSCTION ~l No permit for the operation of an automobile for hire or a taxicab shall be issued. save and " 5 except upon the filing by the applicant therefor with the City Clerk of a verified application addressed to the M.,or and Cammon Council of said City setting forth the name. age. and place of residence of applicaat. aad kin. and number of motor 6 7 8 9 ! vehicles to be used pursuant to such pe1'lll1t. and designating whether or not the permit desired i8 for an automobile for hire or a taxicab. Upon the filing of such application. the City Clerk shall forthwith present the same to the Chief of Police of said City. who shall within ten days thereafter endorse thereon, I his app:"-al or disapproval of such application. The Chief of Police shall. after having endorsed:.thereon his approval or di8approval. return said application to said City Clerk. who 8hall immediately thereafter present said application to the Mayor, and Common Council. and give notice to the applicant of the time of such presentation at least five days prior to the time when such application will be heard. At the time of .the hearing of application. said Mqor and GOIIIIIIon Council may ex&m1ne the applicant and all persons interested in the matters set forth ! suc~ in said application. and if said Mayor and Gommon Council shall determine that the public interest. convenience and rece..ity require the issuance of the permit applied for. it may by resolution order the city Clerk to i88u8 a permit in accortance with said application. subject to the filing anclapproYal of an undertaking by the applicant as herein provided. SECTION SI~ Before a permit shall be i88uedby the City Clerk. the applicant to Wham a permit 8hall have been aWarded pursuant to application. as aforesaid. 8hall deliver to the Mayor and Cammon Council an undertaking executed by a surety .. 2. ., 1 2 3 4 IS 8 7 8 9 10 11 12 13 14 15 18 17 18 1/ vl9 20 21 22 23 24 25 26 27 28 29"/ 30 31 32 fl campauy duly authori5ed under the l..s ot the State ot Calitornia to execute surety bondi, by thej!rovisions ot which undertaking the .aid applicant and said surety caapany promise and undertake to pay in tull all claims tor damages to persons or property resulting tram the operation ot the motor vehicle or *otor vehicles referred to in said application; provided, that the maximum amount for which liabili t7 shall be ....umed for injury to one per.on or the death of one per.on in one accident shall be $5,000.00, and tor injury to m~mthan one person or the death of more than one person in anyone accident shall be 410,000.00, and the maximum amount assumed for injury to or destruction of I ",.."..,~.. property in anyone accident shall be $1500.0~; and prOVided, turther, that tor motor vehicles having a seating capacity ot more than ten persons the maximum liability assumed for injury to more than one perEon or the death ot more than one person in any one accident shall be $20,000.00~ / SECTION &sv~: It shall be unlawful to operate, or permit the operation ot, any autamobile for hire or taxicab unless an undertaking coyering liability occasioned by the operation thereof, as aforesaid, shall then be in full torce and ettect, and on file in the ottiee of the City Clerk ot .aid City in accordance with the provisions hereot. SECTION EIGHTI It shall be unlawtul to operate or permit the operation of any automobile tor hire or taxicab wit)out prepaying any license tee or other charges provided by law tor transaction at such business or the operation of such vehicles. >- SECTION NUlJIc No automobile for hire or taxieab for which a permit shall havebeen granted shall rEIII&1n standing upon any portion ot any public street within said City for the period of more than three minutes; provided, that the Mayor and Cammon Council may by order specify stands at which such au tomobiles tor hire and such taxicabs may be parked pursuant ,. 3. The owner and operator of any automobile for hire or taxieab which shall be engaged and shall be in use for the conyeyance of a passenger, as herein provided, shall carry such passenger safely and expeditiously to his destination by the most direct and most accessible route, and ahall not until such pauenger shall have reached his destination take on any additiona i. passengers whatsoever. SECTION~: It ahall be unlawful to solicit patronage for an autamobile for hire or taxicab upon any public ,. 4. <, 1 street within the City of' San Bernardino, save and except at 2 the place where a stand therefor has been granted by the Mayor 3 and Common Counci~, as herein provided. 4 SBCTIOH TWELVEt It ahall be unlawful for the operator 5 of any automobile for hire or taxioab to solioit or take on 6 passengers therefor upon any public street within said City. 700nstituting the route of' a street railw~ oompany or transporta- I I' 8 'tion company for the conveyanoe of passengers for hire; provided, 9 that suoh passengers m~ be solioited and, ,taken on at the stand 10 provided thewefor as herein specified. 11 SETIOH THIRT'EEN: An application for a permi t shall 12 be denied, and a permit already issued may be revoked for any 13 of the following causest 14 1. Where the driver of the automobile for hire or 15 taxicab therein referred to is under the aie of twenty-one 16 years, or incompetent for any reason to properly operate such 17 i vehicle; 18 2. Where such automobile for hire or taxicab is 1n, 19 such mechanical condition that the operation thereof may endanger 20 life or property; 21 22 3. Where the applioant or the driver of such automobile or taxicab, for hire~whether he be the applioant or his agent, has violated 23 any law or ordinanoe now in force or that m~ be hereaftee 24 enacted; 25 4. Where the applioant, or the driver of any automobile 26 for hire or taxioab, whether he be the applioant or his agent, 27 has been guilty of unfair oompetition or has otherwise committed 28 fraud upon the public or other persons similarly engaged in the 29 iloperation ot such vehioles; 30 I 5. " 17 20 21 22 23 24 25 26 27 28 29 30 31 32 1 SlllCTION FOURTED: In aJ.l proceedings for the revocation 2 of a pennit. the grounds relied upon for such revocation shall 3 be reduced to writing by the city Clerk and certified by him. and 4 a copy thereof seryed upon the pennittee at least ten days 5 prior to the date of hearing requiring him to Bhow cause at the 6"/ time! therein specified why such penni t should not be revoked. sI/S.:. SlICTION FIFTElm: 7 That any person. firm or corporation 8 violating any of the provisions of thi_ ordinance shall be . 9 deemed guilty of & misdemeanor. and upon oonviction thereof shall be punishable by a fine of not more than $500.00. or by imprison- ment in the City Jail for a period of not more than six months, or by both'" fine and imprilonment.
