AN ORDINANCE AIIENDING ORDINANCE NO. 821, ENTITLED IlAN ORDINANCE REVISING AND CODIFYING THE ORDINANCES OF, AND PRO- VIDING A CODE OF LAWS FOR THE CITY OF SAN BERNARDINO", PASSED AUGUST 8, 1921, AND APPROVED AUGUST 9, 1921. The Kayor and Common Council of the City of San Ber- nardino do ordain as follows: SECTIO~ ONE: That Ordinance No. 821, entitled -An Ordinance revising and codifying the ordinances of, and pro- viding a code of laws for the City of San Bernardinoll, passed August 8, 1921, and approved August 9, 1921, be and the same is hereby amended by adding four new paragraphs thereto, to be numbered and to read as follows: "Section 1401. It shall be unlawful for any person, firm, co-partnership, corporation, association or other or- ganization, or any combination of any thereof, to engage in the business, or act in the capacity, of contractor, within the City of San Bernardino, without having a license there- for issued under the authority of and in pursuance of the Statutes of the State of California; and no contractor shall be issued a Contractor's License by the City of San Bernar- dino, in pursuance of any of the Ordinances of the City of -San Bernardino, without first procuring and holding a State Contractor's License issued under the laws of the State of California". "Section 1402. 'Contractor', within the meaning of this Ordinance, is a person, firm, co-partnership, corpora- tion, association, or other organization, or any combination of any thereof, who, for a fixed sum, price, fee, percentage or other compensation other than wages, undertakes with another for the construction, alteration, repair, addition to ,. or improvement of, any building, highway, road, railroad, ex- -1- '-1 1 2 3 4 5 6 7 8 9 10 11 12 13 .. . i 14 ii: z: 0 15 x~q 5 t=. i o ~ ~ ~ 16 ~ z II Q 3 ~! I 17 _ o. ~ . ~ 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 cavation or other structure, project, development or improve- ment other than to personalty, or any part thereof; provided, that the term 'Contractor', as used in this Ordinance, shall include sub-contractors, but shall not include anyone who merely fUrni.~s materials or supplies without fabricating the same into or consuming the same in the performance of the work of the contractor as herein defined". "Section 1403. It is the intention of this Ordinance to provide for requirement of a Contractor's License issued in pursuance of the laws of the State of California in addi- tion to all the requirements now in effect governing con- tractors' license in the City of San Bernardino, and this Ordinance shall not be deemed to repeal or conflict with any of the requirements for obtaining a Contractor's License now in force under any of the Ordinances of the Ci ty of San Bernal'- dino; but the requirement of the State License shall be in addition to the said requirements for the City of San Bernar- dino license now in force and effect". "Section 1404. No permit shall be issued by the Building Inspector, Plum~ing Inspector, or City Electrician pursuant to the provisions of any Ordinance of the City of San Bernardino requiring the issuance of any permit for build- ing construction, plumbing, or wiring installation to any con- tractor making application for such permit, unless and until such contractor exhibits to the Building Inspector, Plumbing Inspector, or City Electrician, as the case may be, a license of such contractor, issued under the authority of and pur- suant to the statutes of the State of California. SECTION THREE: The City Clerk shall certify to the passage of this Ordinance, and shall cause the same to be published for three consecutive days in the SAN BERNARDINO DAILY SUN, a daily newspaper hereby designated for that pur- pose. I HEREBY CERTIFY that the foregoing Ordinance was duly adopted by the Mayor and Common Council of the City of San Bernardino, at a regular meeting thereof held on the J~~day of October, 1931, by the following vote, to-wit: ::~/JJ~AL/::::~~...~~ City Clerk.
