AN ORDINANCE AlI4ENDING ORDINANCE NO. 821, ~NTITLED "AN
ORDINANCE REVISING AND CODIFYING THE ORDINANCES OF, AND PRO-
VIDING A CODE OF LAWS FOR, THi!i CITY OF' SAN Bl>Rl'/ARD1NO", PASSl!:D
AUGUST 8, 1921, AND APPROVED AUGUST 9, 1921.
The Mayor and Common Council of the City of San Ber-
nardino do ordain as follows I
SECTION ONE: That Ordinance No. 821, entitled t1An
Ordinance revising and codifying the ordinances of, and pro-
viding a code of laws for, the City of San Bernardino", passed
August 8, 1921, and approved August 9~ 1921, be and the same
is hereby amended by adding three new Sections thereto, to be
numbered and to read as follows:
t1Section 1503. That pursuant to the provisions of an
Act of the Legislature of the State of California entitled
'An Act to provide for the payment of not less than the gen-
eral prevailing rate of wages on public works, and not less
than the general prevailing rate of wages for legal holiday
and overtime work on public works, providing for the ascer-
tainmentof such general prevailing rate by the public body
awarding the contract and its insertion in the contract and
call for bids for the contract, providing for the keeping of
records of the wages paid all workers engaged in public work
and the inspection of such records by the proper public offi-
cials, providing for a forfeiture for each calendar day, or
portion thereof, any worker 1s pa1d less than the said rate
and for a stipulation to th1s effect in the contract, and pro-
viding other penalties for violation of the provis1ons there-
ofl, approved May 25,1931, the Mayor and Common Council have,
after due inquiry, ascertained the general prevailing rate of
per diem wages of the City of San Bernardino for each craft
or type of workman or mechan1c needed to execute contracts

All workmen, laborers, crafts and mechanics employed in
the execution of any contract with the City of San Bernardino,
and not otherwise classified in the foregoing, $4.00 per day,
time and one-half for overtime, and time and one-half for holi-
day time.
The rates per diem hereinabove set forth are for eight
hours work per day, and overtime shall be computed in all cases
where the employee labors more than eight hours per day for the
time during which said employee may be engaged in labor in ex-
cess of eight hours per day.
Nothing in this Ordinance, however, shall be construed
to prohibit the payment to any laborer, workman or mechanic
employed on any public work of more than the general prevailing
rate of wages, nor shall anything in this Ordinance be con-
strued to permit any overtime work in violation of Section 653c
of the Penal Code of the State of California."
"Section 1504. The prOVisions of Section 1503 of this
Ordinance shall apply only to contracts awarded by the Kayor
and Common Council of the City of San Bernardino for the con-
struction of public works, exclusive of maintenance work".
"Section 1505. The provisions of Section 1503 of this
Qrdinance shall be inserted in each Notice Inviting Proposals

for the doing of public work, and in each contract awarded by
the Mayor and Common Council of said City for any public works,
exclusive of maintenance work.
In the event that the provisions of Sections 1503, 1504
and 1505, of this Ordinance, shall ever be held or determined
to be in conflict with any of the provisions of the Charter of
the City of San Bernardino, then and in that event said Sec-
tions shall be deemed to be void and invalid, and the insertion
of all or any part of the provisions of Section 1503 hereof in
any Notice Inviting Proposals or in any contract awarded by
said Mayor and Common Council shall also be deemed to be void
and invalid, and shall not be deemed to be a part of such No-
tice or contract."
SECTION TWO: This Ordinance is required for the imme-
diate preservation of the public health, convenience and safe-
ty; that under the provisions of the Act of the Legislature
mentioned in Section One hereof and said Ordinance No. 821 of
said City of San Bernardino, no valid contract may be awarded
or entered into by the Mayor and Common Council of the City of
San Bernardino unless the scale of wages herein referred to
shall have been determined by said Mayor and Common Council
and included in each contract entered into by said Mayor and
Common Council for public work; and that said Mayor and Common
Council now have pending before them the awarding and execu-
tion of certain contracts for certain public works within said
City, the construction of which is required for the immediate
preservation of the public health, convenience and safety;
that this Ordinance shall be adopted by a two-thirds vote of
the Common Council of the City of San Bernardino, and that
upon the adoption and approval thereof by the Mayor, the same
~hall immediately become in full force and effect.

SECTION THREE: The City Clerk shall certify to the
passage of this Ordinance, and shall cause the same to be pub-
lished for three consecutive days in the SAN BERNARDINO DAILY
SUN, a daily newspaper hereby designated for that purpose.
