AN ORDINANCE AllENDING ORDINANCE NO. 763, ENTITLED "AN ORDINANCE PROVIDING FOR THE LICENSING OF BUSINESS, SHOWS, EX- HIBITION AND GAllES CONDUCTED OR CARRIED ON IN THE CITY OF SAN BERNARDINO, FIXING THE RATE OF LICENSE THEREFOR, AND PROVIDING FOR COLLECTION THEREOF", PASSED MARCH 1, 1920, AND APPROVED MARCH 2, 1920. ~ The Mayor and Co.-on Council of the City of San Ber- nardino do ordain as follows: SECTION ONE: That Ordinance No. 763. entitled llAn Ordinance providing for the licensing of business. shows. ex- hibition and games conducted or carried on in the city of San Bernardino, fixing the rate of license therefor, and provid- ing for collection thereofll. passed.arch:!, 1920, and ap- proved March 2, 1920, be and the same is herepy amended py adding one new ~ectioDther.to, eto be designated "Section 78-A", and to read as follows: -... "Section 78-A: For every person, firm or corporation engaged in the business of a real estate broker, the sum of $10.00 per annum, payable annually, in advance. For every person, firm or corporation engaged in the business or occupation of a real estate salesman. $4.00 per annum, payable annually, in advance. For the purpose of this Ordinance. the term 'real estate broker' is de~(ned to be a person, copartnership or corporation who. for a compensation. sells or offers for sale, buys. or offers to buy, lists. or solicits for prospec- tice purchasers. or negotiates the purchase or sale or ex- change of real estate, or who, for compensation. negotiates loans on real estate. leases. or offers to lease, or nego- tiates the sale. purchase, or exchange of leases, rents, or places for rent. or collects rent from real estate. or im- ~ provements thereon, for others as a whole or partial vocation. -1- "'1 1 2 3 4 5 6 7 8 9 10 11 12 13 . 14 !!! II ~ II:: !iJ: !... 15 J::lq 1-" :J~' C) '" z 0: 16 ~ . z :I: Z = Q O(~~i 17 3 ~: . - II. ~ i 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 A real estate salesman within the meaning of this Section is one who for compensation is employed by a licensed broker to, sell, or offer for sale, or to list, or to buy, or to offer to buy, or to negotiate the purchase or Sale or exchange of real estate, or to solicit for prospective purchasers of real es- tate, or to negotiate a loan on real estate, or to lease, or to negotiate the sale, purchase or exchange of leases, or of- fer to lease, rent or place for rent, any real estate, or im- provements thereon, as a whole or partial vocation. In any prosecution for the violation ot this Section, , i , the fact that the Real Estate Department or Real Estate Com- mission of the State of California shall have issued a brok- arls license to do business at a location within the corpo- rate limits of the City of San Bernardino, as provided by the California Real Estate Act, approved May 27, 1919, or of any amendments of such Act, at any time during the calendar year to any person who shall be charged with the violation of this Section, such fact shall be deemed prima facie evidence of the fact that such person has engaged in business as a real estate broker within the City of San Bernardino during such calendar year.
