ARTICLE I

Words and Phrases Defined
9
SECTION ONE: The following words and phrases when used
10
in this Ordinance shall for the purpose of this Ordinance have the
11
meaning respectively ascribed to them by THE VEHICLE CODE" of the
12
State of California as of the effective data oP this Ordinance, or
13'
as hereafter amended, which said meaning is hereby adopted by
14
reference, and made a part of this Ordinance, to-wit: "AUTHORIZED
15
EMERGENCY VEHICLE", "AUTHORIZED EMERGENCY VEHICLE" (Privately
16
Owned), "BUSINESS DISTRICT", "CROSSWALK", "DRIVER, "INTERSECTION"
17
"bSOTORCYCLE", "MOTOR TRUCK", "MOTOR VEHICLE", "OPERATOR", "PERSON"
18
"I'RIPATE ROAD OR DRIVE77AY", "RESIDEPdCE DISTl~ICT", "ROADWAY", "SAFET
19 ZONE" "SIDEWALK" "STRUT" or "HIGHWAY" "THROUGH HIGHWAY" and

21 SECTION TWII: Whenever in this ordinance the following
22 words and phrases set forth in this Article are used, they shall,
23 for the u ose of this ordinance have the means
p rp , ngs respectively

25 SECTION THREE: "ALLEY". Any street less than twenty-
26 five (25) feet in width between property line a.
27 SECTION FOUR: "LOADING ZONE". That spaoe adjacent t o a
28 curb reserved for the eselusive use oP vehicles during the loading
29 or unloading of passengers or freight.
30 SECTION FIFE: "OFFICIAL TRAFFIC CONTROL DEVICES". All
31 signs, signals, markings, and devices not inconsistent with this
32 ordinance, placed or erected by authority of a public body or

1 official having ~uriadiotion, for the purpose of regulating, warn-
2 ing or guiding traffio.
3 SECTION SIg: "OFFICIAL TRAFFIC SIGNALS". Any device,
4 whether manually, eleatrioally, or mechanically operated, by which
8 traffio is alternately direoted to atop and to proceed, and which
g is erected by authority of a public body or official having
7 3urisdidtion.
S SECTION SEPEN: "PA.RK`NAY". That portion of a street
g other than a roadway or a sidewalk.
10 SECTION EIGHT: "PASSENG~'R LOADING 2ANE". That space
11 adjaoent to a ourb reserved for the exelusi ve use of vehicles dur-
12 ing the loading or unloading of passengers.
13 SECTION NtATE: "PEDESTRIAN". Any person afoot.
14 SECTION TEN: "POLICE OF'FIC'E ". Seery officer of the
15 Polioe department of this oity.
16 SECTION ELEVEN: "SHALL" AisID "MAY". "Shall" is mandatory
17 and "may" is permissive.
18 SECTION TWF~.VE: (a) "STOP" -- when required, means com-
19 plate cessation of movement. 1
20 (b) "STOP OR STAND" -- when prohibited, means aay~ stop-
21 ping of a vehicle except when necessary to avoid conflict with
22 other traffic or in caatpliance with the direction of a police of-
23 ficer or official traffic control device.
24 (o) "FARKTM -- The stopping or standing of a vehicle,
25 whether occupied or not, otherwise than temporarily for the purpose
of and while actually engaged in loading or unloading passengers

or materials.

28 ARTICLE II
Required Obedience to Traffic Regulations

SECTION ONE: OBEDIENCE TO POLICE. Officers oY the
30
Polioe Department, and such individuals as are designated by the
31
Chief of Polioe or his representative, are hereby authorized to

direct all traffic bymeans of visible or audible signal, and it
shall be unlawful for any parson to refuse ar fail to comply with
any such lawful order, signal or direction. It shall be unlawful
for any minor to direct or attempt to d ireet traffic, except when
so authorized so to do by the Chief of Police or. said Chiefs
representative.
SECTION TI90: EY,ENSPTIONS TO AUTHORIZED EbSEftGENCY
The provisions of this Ordinance regulating the operation, parking,
and ataxd ing of vehicles shall not apply to "AUTHORIZED EMERGENCY
VEHICLES", or "AUTHORIZED EMERGENCY 9EHIC LES" (Privately Owned),
as defined in this Ordinance.

SECTION ONE: TRAFFIC SIGNALS, SAFETY 7ANES, Ttk2NING
MARKEEtS, "II" TURN, RIGHT AND LEFT TURNS. The City Council shall,
by resolution, authorize:
(1) The installation and maintenance of official traffic
signals, at such intersections, and other places as it may deem
neoessary for the regulation of traffic;
(2) The establishment of safety zones at such places as
it may deem neoessary for the protection of pedestrians;
($) The establishment of turning markers, "II" turn,
right and left turns at such places as it may deem necessary for
the regulation of traffic.
(a) Provided, however, the Chief of Police is hereby
authorized to designate Safety Zones, Turning Markers, *II" turn
and right and left turns, in all eases of emergency at suoh place
or places as he may deem necessary and shall erect pffieial traffic
signs or signals at such place or places.
The Chief of Police shall inst411 and maiatain, or cause
to be installed and maintained, suoh official traffic signals,
safety zones, turning mark ers, "Hl" turn, right and left turns as

are authorized by the Council.
SECTION TWO: OBEDIENCE TO NO-TiktN SIGNS AND TURNING-
MARKERS. sAlhsnever authorized signs are erected indicating that
no right or left or "II" turn is permitted no driver of a vehicle
shall disobey the directions of any such sign, and when authorized
ma~lcs, buttons, or other indications are placed within an inter-
aecti on indicating the course to be travelled by vehicles turning
thereat, no driver of a vehicle shall disobey the directions of
such indications.
SECTION THREE: SIGNALLING DEVICES. Where automatic
signalling devices are installed and in operation, and traffio
lanes are delineated pursuant to the direction of the Superintendent
of Streets upon the pavement Barr a distance of fifty feat from such
intersection, a vehicle in the traffic lane ad3acent to the right-
hand curb ms~y be tt¢ ned at such intersection to the right is
violation of and against su ch automatic signalling device, provided
su031 vehicle shall be brought to a oomplete stop before entering
such intersection at a point within ten feet thereof.
SECTION FOUR: ENFORCEH~NT. No provision of this Or-
dinanee for which signs are required shall be enforced against an
alleged violater if at the time and place of the alleged violation
as official sign is not in proper position and sufficiently legible
to be seen by an ordinarily observa~ person.
ARTICLE IV
Stopping, Standings and Parking
SECTION ONE: PARKING T1a+:E LI1t~IR'ED IN CERTAIN PLACES.
(s) `Nhenever the Council, by resolution, has declared
that public convenience and necessity require-that any street or
part of a street, or alley, shall be limited as to the time of
parking thereon, the Chief of Police shall cause signs to be placed
snd maintained on said street or part of a street, or alley, in-
dicating such limitation as may be provided in said resolution.

1 (b) It shall be unlawful for the driver of any vehicle
2 to park said vehicle on any street or part of a street, or alley,
3 upon which signs have been placed indicating a parking time limi-
4 tatioa as herein progided, for a longer time than is indicated on
S said signs.
g SECTION T~~A: PARKING PROHIBITED AT ANY TIME. V6henever
~ the City Council shall, by Ordinance or Resolution, determine
g that the stopping, at ending or parking of any vehicle upon any
g street, part of a Street, or Alley, will create a traffic haaard,
10 oT tend to create traffic congestion, the Chief of Police shall
11 indicate such place, or places, by appropriate signs, or cause the
1S Superintendent of Streets to place and maintain red paint upon the
13 entire curb surface of such street, partof a street, or alley.
14 SECTION THREE: ANGLE PARKING. The City Council is
15 hereby authorized to determi ne, by Resolution, those streets, or
lg parts of streets, upon which angle parking shall be permitted
17 (other than upon those state highways where such parking is pro-
lg hibited by the State Pehich a Code) and the Chief of Police shall
19 indicate such place, or places, by causing the Superintendent of
20 Streets to place and maintain white lines upon the surface of the
21 roadway indicating the angle at which parking is permitted.
22 ~ SECTION FOUR: METHOD OF PARKIN:. No person shall stand
23 or park a vehicle in a roadway other than parallel with the edge
24 of the roadway headed in the direction of traffic and with the
25 right hand wheels of the vehicle within eighteen inches of the
2g curb line or edge of the roadway, ezcept upon those streets which
27 have been marked or signed icy angle parking, upon which streets
28 vehicles may be parked at the angle to the curb indicated by sucsh
29 marks or signs.
SECTION FIFE: LOADING AND UNLOADING PASSENGERS AND FRE

31 It shall be unlawful for the operator of a vehiole to atop said
ve~hicl a for a period of time longer than is necessary for the

1 loading or unloading of passengers or freight, provided, that in
2 no event shall such vehicle be stopped for a period in excess of
3 three minutes for the loading or unloading of passengers, nor in
4 excess of twenty minutes for the loading or unloading of freight,
5 in any of the following places:
8 1. At any curb ~°vhere the grade of the street exceeds
~ twelve per cent;
8 2. In any alley;
9 3. In any loading zone.
10 SECTION SIX: VEHICLE CLEANANCE. No person shall park,
11 stand or leave any vehicle, truck, wagon or cart upon the public.
12 streets of the City of San Bernardino, so that any portion of such
13 vehicle occupies any portion of the roadway of any such street
14 other than that portion of the roadway thereof within sixteen feet
15 of the curb line of such street, except loading or unloading pas-
18 sengers or merchandise.
17 SECTION SEVEPI: TIVENTY T.~".INUTE PARKNG. Where pursuant to
18 the determination of the Chief of Police, the Street Superintenden
19 shall have caused the curb to be painted or marked green, a vehicl
20 may be parked for the period of not more than twenty minutes.
21 SECTION EIGHT: BUS, APdD TAXICAB STl3NDS.
22 (a) The driver of a bus, or taxicab shall not stand or I
23 park upon any street in any business district at any place ether ',
~ than at a bus stop, or taxicab stand respectively, except that thi,
25 provision shall not prevent the driver of any such vehicle from
28 temporarily stopping in accordance with other stopping or parking
27 regulations at any place for the purpose of and while actually en-
28 ;aged in loading or unloading passengers.
29 (b) No person shall stop, stand, or park a vehicle other
30 than a bus in a bus stop, when any such stop has been officially
31 designated and appropriately signed, except that the driver of a
32 passenger vehicle may temporarily stop therein for the purpose of

and while actually engaged in loading or unloading passengers when
such stopping does not interfere with any bus r~aiting to enter or
about to enter such zone.
SECTION NINE: STOPPING PROHIBITED WITHIN CERTAIN :°LACES.
It shall be unlawful for the operator of any motor vehicle to stop
such vehicle, except when necessary to avoid conflict with other
traffic, or in compliance with the direction of a police officer
or traffic sign or signal in any of the following designated place
At any point where the adjacent curb has been painted or

marked red by the Street Superintendent, pursuant to the direction'
of the Chief of Police, or at any place where by other appropriate
signs, placed and maintained by the Chief of Police, notice is
given that the stopping of vehicle is prohibited.
SECTION TEN: UNLAti`uFUL Ptu?KING FOR CERTAIN PURPOSES. No
person shall stand or park a vehicle upon any roadway for the
principal purpose of:
1. Lisplaying it for sale;
2. 'dVashing, greasing or repairing such vehicle except
repairs necessitated by an emergency;
3, tiVithin the business District from which said vehicle
merchandise is being sold.
ARTICLE V
Special Stops Required
SECTION ONE: THE CHIEF OF POLICE TO ERECT STOP SIGNS.
+henever any ordinance or resolution of this City designates and
describes any street or portion thereof as a through street, or
any intersections at which vehicles are required to stop at one os
more entrances thereto, the Chief of Police shall erect and main-
tain stop signs as follows:
A stop sign shall be erected on each and every street
intersecting such through st yet or portion thereof so designated

and at those entrances of other intersections where a stop is re-
quire d.
Every such sign shal 1 be placed at or near the entrance
to the highway or interseeti on where a stop is required and every
such sign shall conform to Rhe requirements of ttbe Vehicle Code.
SECTION T~10: STOP AT THROUGR STREET OR STOP INTERSECTI
When stop signs are created as in this ordinance provided, at the
entrance to any intersection, every driver of a vehicle and every
motorman of a street cer shall stop at every such sign, before
entering the intersecti on, except when directed to proceed by a
police officer or traffic a ontrol signal.
SECTION TF3ftE~: Et~~...k+'?GING FROM ALLEY OR PRIVATE DRIVEWAY.
The driver of a vehicle emerging from en alley, driveway or build-
ing, shall stop such vehicle immediately prior to driving onto a
sidewalk or into the sidewalk area eatending across any alley way.
ARTICLE VI
Operation of Vehicles
SECTION ONE: INTEF2FX.~tENCE ~~'ITH OPERATION OF FIRE APP
(That it shall ba unlawful f ~ any person operating any vehicle upon
the public streets of the City of San Bernardino to obstruct the
streets with such vehicle so as to interfere in any manner with the
operation of any fire apparatus upon snah street.
SECTION T4Y0: DISTANCE TO BE T~PT FROM FIRI: APi ARATQS.
It shall be unlawful for any parson operatittgi any vehicle upon the
public streets of the City of San Bernardino to operate the same so
that it will move in the same directi on that any fire apparatus is
I, traveling until such fire apparatus shall be at least sic hundred
(600) feet distant and it shall be unlawful for. any parson to
operate any vehicle so as to appm ach within six hundred (600) feat
of anyy moving fire apparatus.
SECTION TFREE: EX"TINGUISfiING FIRE. When any fire
~tus shall be engaged in eatinguishing a fire it shall be unlawful fi

any person to operate any vehicle upon the same street, so as to
1 approach within three hundred (300) feet of such fire apparatus.
2 SECTION FOUR: CERTAIN VEHICLES PROHIBITED IN THE BUSINES
3 DISTRICT.
4 (a) It shall be unlawful for the operator of any of the
5 following vehicles to drive the same in the Business District be-
g tween the hours of seven A. N. and six r'. N,. of any day except
7 Sunday:
g (1) Any vek~icle so loaded that any part of its load
g extends more than three feet to the front or more than ten feet to
10 the rear of said vehicle; except with written permit of the Chief
11 of Police.
12 (2) any vehicle used exclusively for advertising
13 Purposes.
14 (b) ~lhe superintendent of Streets is hereby authorized
lg to establish over an ap~~ropriate street or streets, and to desig-
18 pate by appropriate signs, through traffic routes for the movement
17 of vehicles of two or more tons capacity designed for carrying mer~
lg chandise, freight or material. Vy"hen any such through traffic
1g routes are established and designated by appropriate signs, the
2p operator of any vehicle mentioned in this paragraph shall drive on
21~~ such route or routes, and none other, except when it is impractic
22 to do so, or when necessary to traverse another street or streets
23 to a destination for the purpose oP loading or unloading, but then
24 only by such deviation from the nearest freight route as is reason•
25 ably necessary.
28 SECTION FIVE: CROSSING FIRE HOSE. No street car or vehic:
27 shall be driven over any unprotected hose of the Fire Department
28 when laid down on any street, private driveway or street car track.
29 to be used at any fire or alarm of fire, without the consent of the
30 Chief Engineer of the Fire Department or the Assistant in command.
31 SECTION SIX: UNLAI'~B'UL TO DPIVE THPOUGH PROCESSION. It
32 shall be unlawful for the operator of any vehicle or street car to
drive betvaeen the vehicles comprising a funeral procession or other

authorized procession, provided that such vehicles are conspicu-
1 ously so designated.
2 SECTIOPd SEVEN: t~oliEN VEHICLE+'S NOT TO BE DRIVEN ON STREET
3 CAR TRACKS. It shall be unlawful for the operator of any vehicle
4 proceeding upon any street car tracks in front of a street car to
5 fail to remove said vehicle from said tracks as soon as practicablE
8 after signal from the operator of street car.
~ SECTION EIGHT: VEHICLES SHALL NOT BE DRIVEN ON SIDEWALKS.
8 The operator of a vehicle shall not drive writhin any sidewalk area
9 except at a permanent or temporary drivevaay.
10 SECTION NINE: ROLLER SKATES PROHIBITED UPON SIDEG'VALKS.
11 It shall be unlawful for any person to ride upon, or use in any mar
12 per any roller skate, or skates, or other kindred contrivance upon
13 any sidewalk within the Business District of the City of San Ber-
14 nardino.
15 SECTION TEN: USE OF COASTERS AND SIIt~lILAR DEVICES RES-
18 TRICTED. It shall be unlawful for any person upon roller skates off'
17 riding in or by means of any coaster, toy vehicle or similar device
18 to go upon any roadway. ',
19 SECTION ELEVEN: BICYCLES PROHIBITED ON SIDEWALKS. It shat,
2U be unlawful for any person to ride, propel or use in any manner, a~
21 bicycle or other such vehicle of propulsion upon any sidewalk vrithi~i
22 the City of San nernardino, or upon any sidewalk within any public'
23 park within said city.
24 The rider of a bicycle upon a roadway shall ride as pearl
25 as practicable within five (5) feet of the right hand curb or edge
28 of the roadway except when passing a standing or other vehicle or
27 slaking a left-hand turn at an intersection.
28 SECTION TwJELVE: ~.ECKLESS DRIVING OF ANIPfiALS. No person
29 shall carelessly or recklessly ride or drive any horse or other an'
30 upon any of the public streets or alleys of the City of San Bernar
31 dino, so as to endanger life or property.
SECTION THIRTEEN: DRIVING OVER PdL'VV STREET OR SIDEVI'AI.K. It~
32 shall be unlawful for any person to ride or drive, or cause to be
ridden or driven, any animal, or to ride, drive, or propel, or to

cause to be ridden, driven, or 'propelled, any//vehicle over or acro s
any street r~ ieh is being graded or repaire¢,Ior upon which concre a
sidewalks, or paving is being constructed,) or upon which concrete
sidewalks, or paving has been newly made, where across or around
such street th ere is a barrier, or at, over, or near which there
is a person or sign warning persons not to drive over or across
such street or sidewalk, or a sign stating that the street is close
SECTION FOiTRTEFN: PERMITS FOR PARADES AND PROCESSIONS. No
procession or parade, shall occupy, mariah or proceed along any stye
except in accordance with a permit issued by the Chief oP Police, o
his representative, and such other regulations as are set forth her
which may apply, except funeral processions, the Toroes of the IIni
States Army, or Navy, the military forces of this State, and the
forges of the Polie a and Fire Departments of the City of San Berns
dino.
SECTION FIFTEEN: LIMITATIONS ON BACKING. The driver of e
vehicle shall not back the same into an intersection or over a
walk, and shall not in any event or at any place back a vehicle
such movem®nt can be made in safety.
SECTION SIXTEEN: CLINGING TO MOVING VEHICLE: Any person
riding upon any bicycle, motorcycle, coaster, sled, roller skates,
or any toy vehicle shall not attach the same or himself to any stre
oar or moving vehicle upon any roadway.
SECTION SEVENTEEN: RIDING ON HANDLEBARS PROHIBITED: The
operator of a motorcycle or bioyale when upon any street shall not
carry any other person upon the handlebar, frame, or tank of any su
vehicle, nor shall any parson so ride upon any such vehicle. Nothi
herein contained shall be construed to prevent the use of any bicyc
or motorcycle permanently equipped to carry two passengers, providi~
such vehicle shall be so arranged that the driver shall not be ham-
pared or impeded in any way in the control of such vehicle by the
presence of the passenger.
~ ARTICLE VII
Pedestrians' Rights and Duties
SECTION ONE: PEDESTRIAN'S LIMITED RIGHT TO OSE OF ROADWAY.
When within the Business District no pedestrian shall Dross a roadwi
other than by a crosswalk, or at an intersection.

Outside of a Buaniess District, no pedestrian shall cro
a roadway other than by a route at right angles to the curb, and
when crossi ng at any place other than a crosswalk or at an ihte~-
section shall yield the right of way to all vehicles upon the roed-
way .
It shall be unlawful for any person to be in any roadway
other than in a safety zone or crosswalk, provided that this pro-
vision shall not be construed to event the necessary use of a
roadway by a pedestrian.
It aha 11 be unlawful for any parson to stand in a r
for the purpose of or while soliciting a ride from the operator of
anq private vehicle.
SECTION TWO: PEDESTRIANS STANDING ON SIDEWALKS. In a
Business District, it shall be unlawful for any pedestrian to stand
on the sidewalk, except a~ near as is physically possible to the
building lice or the curb line.
SECTION TERSE: WALKIP~ UPON NEtr1 PAVE?BENT OR SIDE`NALK
PROHIBITED. It shall be unlawful for any parson to w41k upon any
newly made pavement or cement or concrete sidewalk upon any street
where across ar around such street there is a barrier, or at, or
over or near which there is a person or sign warning persons not to
'~ walk or drive over or across such street, or a sign stating that t
street is closed.
ARTICLE VIII
Street Cars and Railroad Trains
SECTION ONE: BOARDING flt ALIGHT ING FROM STRUT CARS. NO
person shall board or alight from any street ear while such street
car is in motion.
SECTION TtYn: UNLA;`iFUL RIDING. No person shall ride oa
any street ear upon any portion thereof not designed or intended
the use of passengers. This provision shall not apply to an emp
engaged in the nedessary discharge of a duty.

SECTION THREE: RAIL~iAY TRAINS AND STRD~'T CARS NOT TO
BLOCK STRE',T. It shall be unlawful for the operator of any steam,
interurban, or street railway train or car to operate the same in
sash a manner as to prevent the use of any street for purposes of
travel for a period of time longer than eight minutes.
SECTION 1~UR: SPEED OF TRAINS AND CARS UPON PUBLIC
STREETS. It shall be unlawful for any person, firm or corporation
to operate, permit or cause to be operated any engine, train, loco-
motive, steam train, electric oar or electric train over, across,
upon or along any publio street within the City of San Bernardino,
ezcept as hereinafter specifically provided, at a rate of speed
greater than one mile in three minutes.
SECTION FIVE: SPEED OF TRAINS OVER RIGHT OF 'NAY. It
shall be unlawful for any person, firm or corporation to operate,
permit or pause to be operated any engine, train, locomotive steam
train, electric car or blectrie train upon the right of way now
owned and operated by the Atchison, Topeka & Santa Fe Railway, wh.
crossing over, upon or along any publio street within the City of
San Bernardino at a rate of speed greater than thirty miles per
'hour, except that said speed may be increased to a rata of speed
not greater than forty miles per hour in that section north from
Baseline to the limits of said City.
SECTION SIX: RAILWAY GATES. No person shall drive any
vehicle through or under any safety gate or railroad barrier which

ARTICLE IX
Loading Zpnes, Bus Stops, Crosswalks
SECTION ONE: LOADING ZONES AND BUS STCPS TO BE PA INTED
OR BR.ARKED. The Chief oP Police shall determine, and the Street
Superintendent shall mark, the location of all loading zones and

bus stops by causing the adjacent curb to be painted or marked
respectively yellow and red; That portion so marked yellow shall
be established as a "loading zoae", and the curb surface so
painted yellow shall have thereon in white letters the words
"loading zone", and such loading zone so located and marked shall
be used only ae a place for the loading or unloading of passengers
and freight, subject to the limitations herein prescribed; That
portion painted red shall be established as a "bus stop", and the
curb surface painted red shall have thereon in white letters the
words "bus stop", and such bus stop so located and marked shall be
used only ae a place fcr the loading and unloading of passengers,
subject to the limitations herein prescribed; and the Chief of
Police may determine, and the Street Superintendent shall mark, the
location in front of and adjacent to hospitals, police st~tiona
and theatres where it shall be unlawful to stop, stand or park a
vehicle by causing the adjacent curb to be painted ar marked red.
SECTION TVJO: CHIEF OF POLICE TO ESTABLISH CROSSWALKS.
The chief of Police is hereby authorized and required to establish
cross crosswalks, approaimately equal in width to the adjacent
sidewalk at all intersections, or between intersections, where in
his opinion there is a particular danger to pedestrians crossing
the roadway, and when so designated by the Chief of Police, the
Superintendent of Streets shall designate upon the surface of the
roadway by vdiite painted lines said crosswalks.
ARTICLE %
Damage to Public or Private Property
SECTION ONE: DA~iltAGE TO PUBLIC PROPERTY - REPQRT.
(a) The driver of a vehic le, or the person in charge of
any animal, involved in any accident resulting in damage to any
property, publicly oavned, including but not limited to any fire
hydrant, ornamental lighting post or ornamental shade tree, located
in or along any street or within any public parks-*or resulting in
damage to any property owned by any public utility, including but

1 not limited to a telephone pole, electric light or power pole,
2 where the damage eaoeeds X25.00, shall within twenty-four hours
or cause to be made

15 Deparihmeat on or before the tenth day of the month following the
18 accident.
17 SECTION TfiREE: ACCIDENT REPORTS CONFIDENTIAL. All re-
18 quired accident reports shall be without prejudi ce to the in-
19 dividual so reporting and shall be for the confidential use of the
20 Police Department, eaeept that the Police Department shall disclose
21 the names and addresses of persons involved in, or witnesses to,
22 an accident, the registration numbers and descriptions of vehicles
~ involved, and the date, time and location of an accident, to any
24 person who may have a proper interest therein, including the driver
or drivers involved, or the legal guardian thereof, the parent of
25
a minor driver, the authorized representative of a driver, or to eny
` 26
person injured therein, and the owners of vehicles or property
27
damaged thereby, or all of them. No such report shall be used as
28
evidence in any trial, civil or criminal, arising out of an accident
29
ezeept that the department shall Furnish upon demand of any person
30
who has, or claims to have, made suoh a report or upon demand of anq
31
court, a certificate shoarirt~ that a specified accident report has ox

1 has not been made to the Police Department solely to prove a eom-
2 plienee or a failure to comply wi th the requirement that such a
3 report be mie~eto the Police Department.

ARTICLE XI
5I Penalties
g SECTION ONE: PEN_~TY. Any person violating any of the
7 provisions of this Ordinance, or any rule or regulation made by the
`~ ~'3 Council by resolution or by the Chief of Police pursuant there-
y to, shall be guilty of a misdemeanor, and upon conviction thereof
l0 shall be punished by a fine not ezeeeding X500.00, or by imprison-
11 merit in the City or County Jail not ezeeeding siz months, or by
12 both such fine and imprisonment.
13~~ ACTION T'r"40: EFFECT OF ORDINANCE. If any section, sub-
14~~ section, sentence, clause or phrase of this Ordinance is for any
15 reason held to be unconstitutional, such decision shall not effect
lg the validity of the remaining portions of this Ordinance. The ~bt
17 Council hereby declares that it would have passed this Ordinance a
18~each section, subsection, sentence, clause and phrase thereof,
19lirrespective of the fact that any one or more sections, subsections,
20 aentenoes, clauses or phrases be declared unconstitutional.
21 SECTION TREE: REPEAL. That Ordinances Number 222, 532,
22 628, 668, 850, and 1573, end sections Number 403, 404, 406, 408,
23 410, 412, 415, 418, 420, 421, 422, 423, 425, 428, 430, 431, 432,
~ 433, 434, 435, 436, 438, 440, 441, 442, 444, 445, 479, 482, 483,
and 488 of Ordinance Number F321 are, and each oP them is hereby

SECTION FOUR: PUBLICATION. The City Clerk shall

certify to the passage of this Ordinance, and shall cause the same
28
to be published three consecutive times in the San Bernardino Daily
29
Sun, a daily newspaper hereby designated for that purpose.
